Morton, husband and wife, are adult individuals currently residing at 130 Walnut Street, Lemoyne, Cumberland County, Pennsylvania, as tenants pursuant to a lease with Defendants Stankovic as landlord for 130 Walnut Street. 4. Plaintiffs own in fee simple and possess all right, title and interest in and to the lot and ground known as Lot 4 on plan dated March 10, 1995, and recorded in the Office of the Recorder of Deeds in and for Cumberland County Pennsylvania, in Plan Book 69, Page 142, located in the Borough of Lemoyne, Cumberland County, Pennsylvania, and herein known as Tax Parcel 12-21-0265-440. The property is more fully set forth in the legal description which is attached hereto and made a part hereof as "Exhibit A" ("Trogner Property"). 5. Defendants claim an interest and estate in the Trogner Property adverse to Plaintiffs. 6. Defendants' claims are without any right whatsoever, and Defendants have no right, estate, title, lien or interest in or to the Trogner Property or in or to any part thereof. 7. Plaintiffs acquired title to the Trogner Property by virtue of a Deed from Hugh J.T. Simpson and Diana Hazard Simpson, husband and wife, dated February 23, 2000, and recorded February 25, 2000, in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania, in Deed Book 216, Page 771. A true and correct copy of the Deed is attached hereto and made a part hereof as "Exhibit B". 8. Defendants Stankovic are owners of the property known as 130 Walnut Street pursuant tb a Deed from Michael A. Cathcart and Susan T. Cathcart, his wife, dated November 14, 1985, and recorded November 15, 1985, in the Office of the Recorder of i Deeds in and for Cumberland County, Pennsylvania, in Deed Book 31 Page 99. A copy of the Defendants Stankovic's Deed is attached hereto and made a part hereof as "Exhibit C" and referred to herein as "Stankovic Deed". g. Michael A. Cathcart and Susan T. Cathcart acquired 130 Walnut Street by deed dated August 29, 1983, and recorded August 30, 1983, in the Office of the Recorder of Deeds in and for Cumberland County in Deed Book I-30 Page 899. A copy of the Catchcart Deed is attached hereto and made a part hereof as "Exhibit D". 9. The Stankovic Deed, Exhibit C, includes a reference to a survey that states that "Said description is drawn in accordance with a survey of Gerrit J. Betz Associates, Inc., Engineers and Surveyors, made August 25, 1983, Survey No. 83- 081". 10. The survey referenced in the Stankovic Deed, in fact, is recorded as part of the Cathcart Deed, Exhibit D. 11. The Stankovic Deed and its predecessor, Cathcart Deed, specifically set forth the southern boundary line of 130 Walnut Street. 12. Notwithstanding the boundary lines of 130 Walnut Street, it is believed and therefore averred that Defendants Stankovic and/or Defendants Morton trespassed onto a portion of the Trogner Property by, in part, erecting or placing a sandbox, posts and clothesline on a portion of the Trogner Property and by accessing the area surrounding the sandbox, posts and clothesline. The trespass area on the Trogner Property is south .. of the boundary line of 130 Walnut Street {"TRESPASS AREA"). 13. After notice to remove the erected sandbox, posts and clothesline and to discontinue their use of the Trogner Property, Defendants Morton have ceased their trespass or Claim in the Trespass Area; however, it is believed and therefore averred that Defendants Stankovic continue a claim or interest in the Trespass Area. 14. Defendants have no right, title or interest to the Trespass Area. WHEREFORE, Plaintiffs pray: a. That Defendants, and each of them, and all persons claiming under them, be required to set forth the nature of their claims of the Trogner Property; b. That all adverse claims to the Trogner Property be determined by a Decree of this Court; c. That said Decree declare and adjudge that Plaintiffs own in fee simple and are entitled to the quiet and peaceful possession of the Trogner Property; and that Defendants, and each of them, and all persons claiming under them, have no estate, right, title, lien or interest in or to the Trogner Property or any part thereof; d.
