WHEREAS, GREG R. EHGARTNER and SUSANNE E. EHGARTNER of 715 Hilltop Drive,
New Cumberland, Perulsylvania, is about to execute contemporaneously herewith, a contract, with J. W.
Mumper Construction, Inc. of 1 Bull Run Court, Mechanicsburg, Pennsylvania, for the erection of a
building upon premises commonly known as 520 EAST HALYARD ROAD, Township EAST
PENNSBORO, CUMBERLAND County, Pennsylvania, as set forth in the deed dated April
8, 1999, recorded at Deed Book 197, Page 691, in the Recotder's Office for CUMBERLAND County,
Pennsylvania, as more specifically described in Exhibit "A" which is incorporated herein and attached
hereto.
NOW, July 13, 2001, at the time of and immediately before the execution of the principal contract,
and before any authority has been given by the said Owner to the said Contractor to commence work on
the said building, or purchase materials for the same in consideration of the making of the said contract
with Contractor and the further consideration of One Dollar ($1.00), to Contractor paid by Owner, it is
agreed that no lien shall be filed against the building by the Contractor, or any subcontractor, nor by any
of the materialmen or workmen or any other person for any labor, or materials purchased, or extra labor
or materials purchased for the erection of said building, the right to file such liens being expressly waived.
WITNESS, our hands and seals the day and year aforesaid.

ALL THAT CERTAIN piece, parcel or lot of lands situate to East Pennsboro
Township, Cumberland County, Pennsylvania; designated as Lot No. 22 of Rlver
Bend - A Planned Community; and being further bound and described as follows,
to wit:
BEGINNING at a point on the Western right-of-way line of Halyard, a 40 foot
wide public street, at a corner of Lot No. 21; thence by said Lot North 04 degrees
51 minutes 28 seconds East a distance of 352.48 feet to a stone at a corner of
lands now or formerly of S.G. Diamond; thence by said lands of Diamond North 89
degrees 02 minutes 57 seconds East of 261.66 feet to a point, at a corner of Lot
No. 23; thence by said Lot South 25 degrees 22 minutes 55 seconds West a
distance of 426.09 feet to a point on the Western right-of-way line of Halyard;
thence along said right-of-way line, by a line curving to the left, having a radius of
316.39 feet, an arc length of 113.33 feet, and a chord bearing North 74 degrees
52 minutes 49 seconds West a distance of 112.73 feet to a point, the Place of
BEGINNING.
CONTAINING 69,130 square feet or 1.59 acres, more or less.
AND SUBJECT, NEVERTHELESS, to any and all liens, mortgages,
easements, covenants, conditions, restrictions, reservations, rights-of-way, zoning
ordinances, building lines and any and all other matters that are of record or visible
on the premises.
