STIPULA TION A GAINST LIENS
THIS AGREEMENT made the ~ 7 day of fU~ , 2001, by and between
TIMOTHY D. HOFFMAN, t/d/b/a HOFFMAN' S CUSTOM CONTRACTING, hereinafterreferred
to as Co,~tractor, and WILLIAM R. FULTON and ROXANNA J. FULTON, hereinafter referred to
as Owner, whereby the former undertook and agreed to erect and construct a custom built home,
garage and other improvements, on that certain lot of ground situate at 345 Mooredale Road,
Carlisle, Dickinson Township, Cumberland County, Pennsylvania, more fully described in Exhibit
"A" attached hereto and made a part hereof.
NOW THEREFORE, WITNESSETH: That the said Contractor, for and in consideration of
the sum of ($1.00) bollar to Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves
and their subcontractors, and all parties acting through or under them, covenant and agree that no
mechanic's liens or claims shall be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise, for, towards, in, or about the
erection and construction of the said buildings on the lot above described, and the said Contractor,
for themselves, their subcontractors and others under them hereby expressly waive and relinquish
the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any
of them, and agree that this instnunent, waiving the right of lien, shall be an independent covenant.

ALL THAT CERTAIN tract or parcel of land situate in the Township of Dickinson, Cumberland
County, Pennsylvania, more particulazly bounded and described according to a survey and Plan
thereof made by John K. Bixler, III, registered surveyor, dated November 16, 1990, as follows, to
wit:
BEGINNING at a point mazked by a nail in Mooredale Road, T-466, at corner of land now or
formerly of Chris E. Renner; thence extending along the line of said land now or formerly of Chris
E. Renner, South 87 degrees 58 minutes 38 seconds East, 294.00 feet to a point; thence along the line
of land now or formerly of John R. McKeehan, South 88 degrees 14 minutes 03 seconds East, 553.37
feet to an iron pin in the line of lands now or formerly of Linwood B. Phillips; thence along the line
of said land now or formerly of Linwood B. Phillips, South Ol degrees, 24 minutes 57 seconds East,
517.95 feet to an iron pin at corner of land now or formerly of Irvin M. Zimmerman; thence along
the line of said land now or formerly of Irvin M. Zimmerman, North 83 degrees 58 minutes 50
seconds West, 1070.64 feet to an iron pin in Mooredale Road, T-466 aforementioned; thence along
and through Mooredale Road, T-466, North 25 degreesl6 minutes 25 seconds East, 288.19 feet to
a point; thence continuing along and through said Mooredale Road, T-466, North 25 degrees 26
minutes 12 seconds East, 190.85 feet to a point in said Road, at corner of land now or formerly of
Chris E. Renner, first above mentioned, at the point and place of BEGINNING. CONTAINING
10.578 acres, more or less.
