Stoner (Obligee), her heirs, administrators, and assigns, of 4 Chester Road, Enola, PA 17025, the sum of One Hundred Thirty-Four Thousand Dollars ($134,000.00) at no interest unless obligation hereunder is in default, in which event the Obligee will be entitled to interest at the rate of seven (7) percent on the unpaid balance. Payments shall be made as follows: A. On or before December 19, 2001, Obligor shall pay the sum of Eighty-Five Thousand ($85,000.00) Dollars to Obligee. B. The balance of $49,000.00 by March I5, 2002, or upon sale of the house property of Obligor at 467 Maryland Street NE, Warren, Ohio 44483, whichever date shall first occur. UPON FAILURE to make payment in full as the Agreement states and in accordance with this Note, at the written option of Obligee, Note shall be in default and shall become immediately due and payable, without demand or notice. AND FURTHER, Obligor does hereby authorize and empower the Prothonotary or any attorney of any Court of Record in Pennsylvania or elsewhere, to appear for and confess judgment (where action commenced by Complaint under PaRCP 2951(6) and in accordance with PaRCP 2955 and Form PaRCP 2962) for any sums due and payable hereon, with or without declaration, with costs of suit, release of errors, without declaration, with costs of suit, release of errors, without stay of execution; with 5% added for attorney's fees; and also waives the right of inquisition on any real estate that may be levied upon to collect this Note; and does hereby voluntarily condemn the same and authorize the Prothonotary to enter said voluntary condemnation upon any Fieri Facias that may be issued to collect said judgment; and further agrees that said estate may be sold on a Fieri Facias, and does hereby waive and release all relief from any and all appraisement, stay of execution, exemption or bankruptcy laws of this or any other state now in force of hereafter to be passed.
