WHEREAS, an agreement was entered into by and between Nathan K. Ebersole
and Julia S. Ebersole, husband and wife, of 44 Kline Road, Shippensburg,
Pennsylvania 17257, hereinafter referred to as the "Owner", whether one or more, and
Weaver's Hauling and Excavating, 27 Goodhart Road, Shippensburg, Pennsylvania
17257, hereinafter referred to as the "Contractor", whereby the said Contractor
undertook and agreed to perform certain construction work and to provide certain
materials and perform certain work necessary to erect and/or improve a residential
building on the real estate of the Owner situate at 44 Kline Road, Shippensburg,
Pennsylvania 17257.
NOW, THEREFORE, THIS AGREEMENT WITNESSETH, That the said Contractor
for and in consideration of the sum of One ($1.00) Dollar to said Contractor in hand
paid, the receipt whereof is hereby acknowledged, and further consideration as agreed
upon, far the Contractor, the Contractor's subcontractors and all parties acting through
or under the Contractor or them, covenant and agree that no mechanics' lien or liens
shall be filed or maintained by them, or any of them, against said residential building
and/or addition to residential building of the Owner situated as above stated, and the
plot of ground appurtenant thereto, for or on account of arry work done or materials
furnished by them, or any of them, under the said contracts or otherwise, for towards, in
or about the said construction and work at the buildings of the Owner, and the
Contractor, the Contractor's subcontractors and others under them, for themselves,
hereby expressly waive and relinquish the right to file or maintain any mechanics' lien
or claim against said residential building andJor addition to residential building and the
plot of ground, and agree that this agreement waiving the right of lien shall be an
independent contract.
IN WITNESS WHEREOF, the said Contractor and the said Owner have executed
this agreement on this ~ day of July, 2001.
