Dorwart, an adult individual residing at 1375 Old Quaker Road, Etters, York County, Pennsylvania. 2. Defendants, Daniel Galloway and Michele Galloway, are adult individuals trading and doing business as The Flooring Factory, with a place of business at 208 Locust Alley, New Cumberland, Cumberland County, Pennsylvania. 3. Daniel Galloway and Michele Galloway registered the Fictitious Name, The Flooring Factory, on August 17, 1999, entity number 2893221. 4. Plaintiff is engaged in the construction of apartment buildings along Old Quaker Road in Fairview Township, York County, Pennsylvania, known as Quaker Station Apartments. 5. In connection with construction of those apartments, Plaintiff and his contractor, Michael C. Dorwart, purchased 1,764 square yards of carpet and 1,764 square yards of carpet pad from Defendant for use in 18 apartment units. 6. The purchase price for the carpet and carpet pad, with PA Sales Tax, totaled Fifteen Thousand Eight Hundred Ninety-Three and 64/100 ($15,893.64) Dollars, as set forth on Invoice No. 10123 dated 11/3/2000. A copy of said Invoice is attached hereto, made a part hereof, and marked as Exhibit "A." 7. Invoice No. 10123 was paid on November 6, 2000 by check drawn on the account of Michael C. Dorwart, contractor for Plaintiff, with funds provided by Plaintiff. Acknowledgment of the receipt of payment in full was made in writing by Daniel Galloway on November 6, 2000 as set forth at the bottom of Exhibit "A" attached hereto. 8. Although Plaintiff paid for 1,764 yards of carpet and 1,764 yards of carpet pad, Defendants failed to deliver 348 yards of carpet and 588 yards of carpet' pad, for a total value of Three Thousand Four Hundred Fifty-Three and 48/100 ($3,453.48) Dollars, including sales tax paid by Plaintiff. 9. Despite demand for delivery of the carpet and carpet pad to Plaintiff and his contractor, Defendant failed and refused to deliver the 348 yards of carpet and 588 yards of carpet pad. 10. Plaintiff demanded reimbursement for the value of the undelivered carpet and carpet pad in writing, by Certified Mail sent on April 12, 2001. A copy of the letter and return receipt is attached hereto, made a part hereof, and marked as Exhibit "B." -2- il. Defendant failed and refused to reimburse Plaintiff. 12. Plaintiff is entitled to prejudgment interest at six (6%) percent per annum from November 6, 2000 continuing until Defendant makes payment to Plaintiff. Mr Moore agreed to reinburse the Flooring factory as he received payment for installing carpeting, pad and the in the first two apartment buildings, whereas these monies would be used to purchase the remaining carpet and padding needed to complete the third building.
