STIPULATION AGAINST LIENS
THIS AGREEMENT made thea3r_day of , 2001, by and between
ROBERT GOLDSMITH, hereinafter referred to as Contractor, and WAYNE M. YORKGITIS
and MICHELE MELNYK-YORKGITIS, hereinafter referred to as Owner, whereby the former
undertook and agreed to erect and construct a commercial office building on that certain lot of
ground known as Lot 13 of Central State Plaza situate in South Middleton Township, Cumberland
County, Pennsylvania, more fully described in Exhibit "A" attached hereto and made a part hereof.
NOW THEREFORE, WITNESSETH: That the said Contractor, for and in consideration of
the sum of ($1.00) Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves
and their subcontractors, and all parties acting through or under them, covenant and agree that no
mechanic's liens or claims shall be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise, for, towards, in, or about the
erection and construction of the said buildings on the lot above described, and the said Contractor,
for themselves, their subcontractors and others under them hereby expressly waive and relinquish
the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any
of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant.

ALL THAT CERTAIN tract of land situate in South Middleton Township, Cumberland County,
Pennsylvania, more particularly bounded and described according to Land Subdivision of Central
State Plaza (Final Plan) dated June, 1988, revised through November 2, 1988, and recorded in
Cumberland County Plan Book 56, page 121, as follows:
BEGINNING at an iron pin on the northeastern dedicated right-of--way line of State Avenue at the
southeastern corner of Lot No. 12 as shown on the above-described subdivision plan; thence by said
Lot No. 12, North 51 degrees, 38 minutes, 40 seconds East 318.85 feet to an iron pin in line of land
now or formerly of Robert C. Houser; thence by said land now or formerly of Robert C. Houser,
South 83 degrees, OS minutes, 00 seconds East 294.20 feet to an iron pin at corner common to the
within tract, said land now or formerly of Robert C. Houser, land now or formerly of the LeTort
Regional Authority and Lot No. 14 as shown on the above-described subdivision plan; thence by said
Lot No. 14, South 04 degrees, 39 minutes, 00 seconds East 146.66 feet to an iron pin; thence
continuing by said Lot No. 14, South 76 degrees, 12 minutes, 00 seconds West 516.54 feet to an iron
pin on the northeastern dedicated right-of-way line of State Avenue; thence by said right-of-way line
of State Avenue by a curve to the left having a radius of 280.00 feet, an arc length of 120.00 feet to
a point on said right-of--way line, the point and place of BEGINNING.
CONTAINING 2.3749 acres and being designated Lot No. 13 as shown on the above-described
subdivision plan.
