EDWARD HARVEY,>.,~1K~-- Defendants PETITION TO ISSUE UBPOENAS Comes the Plaintiff, Dr. Choi, by his local counsel and sets forth the following in support of this Petition: 1. This Petition concerns a California State Case in which the Plaintiff would like to hold depositions in Pennsylvania because the witnesses and documents involved are located here. This case has been filed as ~hQ v_. Harvey, Solano County, California Superior Court, Case No. 012225. 2. Plaintiff requests the issuance of subpoenas to compel the attendance of witnesses and to provide documents. The witnesses are employees of United Concordia of Camp Hill, Pennsylvania. The records requested are in the possession of United Concordia, anon-party to this litigation, with its main office in Cumberland County. 3. Plaintiff will pay and any fees or costs for the issuance of the subpoenas requested. 4. In particular, Plaintiff seeks to take the deposition of Connie Sweigert and Wayne Silverman at Pennsylvania Blue Shield and to subpoena documents relating to an audit or review of Edward L: Harvey, DMD of Fairfield, California in 1997. Copies of the subpoenas requested are attached. WHEREFORE, Plaintiff Choi respectfully requests that the subpoenas requested be issued.
