PETITION FOR CHANGE OF NAME

AND NOW, this ~ day of July, 2001, comes the above-named petitioner,
Stjepan Freml, by and through his attorney, Courtney L. Kishel, Esquire, and The Law
Offices of Richard C. Gaffney, who respectfully requests this Honorable Court to grant
this petition for change of name, pursuant to 54 Pa.C.S. §§701 and 702 and in support
thereof avers the following:
1. Petitioner, Stjepan Freml, is an adult individual residing 313 South
York Street in Mechanicsburg, Cumberland County, Pennsylvania,
17055, since August 2000. Petitioner resides there with this wife, Mira
Freml, and son, Vladimir Freml.
2. Prior to August 2000, Petitioner resided with his family at 1303 Loisa
Lane in Mechanicsburg, Cumberland County, Pennsylvania, 17055.
Petitioner and her family resided there from April 1999 to August
2000. Prior to that, Petitioner resided at 147 East Main Street in
Mechanicsburg, Cumberland County, Pennsylvania, 17055.
Petitioner has been a bona fide resident of the Commonwealth of
Pennsylvania for at least six (6) months prior to filing this petition.
4. On January 1, 1944, Petitioner was born in Matijevici, Croatia, under
the name Stjepan Zvonimir Fromml. (See Exhibit A).
Following the end of World War II, the occupying Communist
Government in Yugoslavia forced Petitioner to change his name from
Stjepan Zvonimir Fromml, to Stjepan Freml. (See Exhibit A).
6. On May 8, 1997, Petitioner became a permanent resident of the United
States. (See Exhibit B).
On October 25, 2000, the Croatian Government granted Petitioner's
request to change his name from Stjepan Freml, to the original spelling,
Stjepan Fromml. (See Exhibit C).
8. Petitioner hopes to obtain United States citizenship in October 2002.
9. Petitioner wishes to obtain citizenship under his original name, rather
than the name given to him by the Communist Government, because it
carries special meaning to him and reflects his heritage.
10. Petitioner has one son, Vladimir Freml, who has also requested, in a
separate petition, to have his name changed to the original family
spelling. Additionally, Petitioner's wife, Mira Freml, is also requesting
to change her name to Mira Fromml.
11. Petitioner currently has a mortgage with PNC Bank. The mortgage is
for Petitioner's current residence of 313 South York Street,
Mechanicsburg, Cumberland County, Pennsylvania, 17055.
12. Petitioner is not attempting to avoid any civil or criminal liabilities, nor
is he attempting to change his name for any other fraudulent purpose.
WHEREFORE, for the foregoing reasons, Petitioner, Stjepan Freml, respectfully
requests this Honorable Court to grant this petition to change his name from Stjepan
Freml, to Stjepan Zvonimir Fromml.

Odobrava se Stjepanu Freml iz SAD, posljednje prebivaliste u RH Ru-

majka Sara£ina Freml r. Kujundzic, promjena prezimena iz Frem1 u "Fromml"
Po pravomocnosti rjesenja nalaze se nadleznom maticaru izvrsenje
upravne radnje naknadnog upisa odobrene promjene prezimena u drzavnim
maticama.
O b r a z l o~ e n j e
Stjepan Freml iz SAD, obratio se ovom Uredu putem Veleposlanstva
RH a SAD, Washington, Odjel za konzularne poslove, kojom trazi promjenu
prezimena iz Freml u "Fromml".
U zamolbi navodi da deli promijeniti prezime u Fromml jer je to o-
biteljsko prezime, a izmijenjeno je poslije drugoga svjetskog rata na-
kon smrti njeaovog oca Ilije Fromml, koji je poginuo 24.12.1944. Bodi-
ne u selu Struga, Dvor. Istice da je prezime tads promijenjeno u £onets-
ki oblik Freml koje je koristeno sve do sada. Prilaze vjencani Iist svo-
jih roditelia iz kojeg je vidljivo da je prezime ~enika i njegovog oca
Fromml. Slijedom navedenog deli vratiti obiteljsko prezime Fromml.
Obavijest o promjeni prezimena objavljena je na oglasnoj ploci i na
nju nije bilo primjedbi.
U provederom postupku, utvrdeno je da nema zapreka iz cc"lanka 8, 9.
i 10. stavak 3. Zakana o osobnom imenu, to je primjenom clanka 5. stavak
1. istog Zakona, rijeseno kao u izreci.
Upravna pristojba na ovo rjesenje naplacena je u iznosu od 70,OOKn
upravnih biljega po Tbr. 1. i 2. Zakona o upravnim pristojbama /"Narod-
ne novine", broj:- 8/96).
UPUTA U PRAVNOM LIJEKU:
Protiv ovog rje~enja moze se izjaviti zalba u roku 15 Jana od dana
primitka rjesenja Ministarstvu pravosuHa, uprave i lokalne samouprave,
Zagreb, Republike Austrije 16, kao druaostupaniskom tijelu.

The Decision
It is allowed to Stjepan Freml from the USA, with last residence in the Republic
of Croatia in Rujevac lA, born on January Ol, 1944, at Matijevici, Dvor; father Ilija
Freml, mother Sarafina Freml nee. Kujundtic, the change of surname from Freml into
"Frbmml".
By the validation of the decision the authorized registrar is ordered to perform the
administrative action of subsequent registration of the allowed surname change in the
state register of births, marriages and deaths.
Explanation
Stjepan Freml from the USA has contacted this Office by the Embassy of the
Republic of Croatia in Washington Consular Affairs Department, with which he requires
the surname change from Freml into "Frtsmml".
In the request he states that he wishes to change the surname to Fromml, since it
is the family's surname, and had been changed after the World Waz Two following the
death of his father Ilija Fromml, who was killed on December 24, 1944 at village of
Struga, Dvor. He emphasizes that the surname had been changed to phonetic form of
Freml at that occasion, and was used until now. He encloses the certificate of marriage of
his parents', which makes visible that the name of the groom and his father is Frbmml. In
sequence to the stated, he wishes to regain his family's surname of FrSmml.
The notice on surname change has been posted on the notice board and no
objections to it have been raised.
In the procedure which was conducted, it has been established that no obstacles
from Articles 8, 9 and 10 item 3 of the Personal Name Law exist, and therefore by
application of the Article 6, item I of the Law, the decision has been made as in the
proposition.
LEGAL REDRESS ADVICE:
The complaint can be filed against this decision within the course of 15 days of
the day of the receipt of it, to the legal body of second instance, the Ministry of Justice,
Administration and Local Self-Govenng, in Zagreb, 16 Republike Austrije Street.
