HOCKENBERRY 6 MIDDLE ACRES NEWVII.I,E, PA 17241 DEFENDANTS CIVIL ACTION MORTGAGE FORECLOSURE The Chase Manhattan Bank, as Trustee of IMC Home Equity Loan Trust 1996-3 Under the Pooling and Servicing Agreement dated as of July 1, 1996, (hereinafter referred to as "Plaintiff ') is an institution, conducting business under the laws of the Commonwealth of Pennsylvania and brings this action to foreclosure the mortgage between Edward J. Hockenberry and Barbara E. Hockenberry, mortgagors (hereinafter referred to as "Defendant") and itself as Mortgagee by Assignment. Said mortgage was dated March 27, 1996 and was recorded in the office of the Recorder of Deeds and Mortgages in Cumberland County in Mortgage Book 1318, Page 50. A copy of the mortgage is attached and made a part hereof as exhibit `A'. 2. The Mortgage is secured by Defendants Note dated March 27, 1996 in the amount of $45,000.00 payable to Plaintiff in monthly installments with an interest rate of 12.35%. 3. The land subject to the mortgage is: 6 Middle Acres, Newville, PA 17241. 4. The Defendants, Edward 7. Hockenberry and Barbara E. Hockenberry are the real owners of the land subject to the mortgage and the Defendants' address is 6 Middle Acres, Newville, PA 17241. 5. The Mortgage is now in default due to the failure of the Defendants to make payments as they become due and owing. The following amounts are due: Principal Balance $43,529.98 Interest to 5/15/Ol 1,998.20 Accumulated Late Charges 640.15 BPO/Inspections/NSF 184.95 Deferment Interest 910.50 Attorney Fees/Costs 3,700.00 Suspense Balance [237.52] TOTAL $51,201.30 plus interest from 5/16/01 at $14.73 per day, costs of suit and attorney fees. 6. In accordance with the provisions of the Act of January 30, 1974, P.L. 13 No. 6, Section 403 (41 P.S. 403), a Notice of Intention to Foreclose is required and the Notice of Homeowners' Emergency Mortgage Assistance was sent to Defendants May 23, 2001. The Defendants have not cured the default.
