An arrest for violation of this Order maybe made without warrant, based solely on probable cause, whether or not the violation is committed in the presence of law enforcement. Subsequent to an arrest, the law enforcement officer shall seize all weapons used or threatened to be used during the violation of this Order OR during prior incidents of abuse. Weapons must forthwith be delivered to the Sheriffs office of the county which issued this Order, which office shall maintain possession of the weapons until further Order of this court, unless the weapons are evidence of a crime, in which case, they shall remain with the law enforcement agency whose officer made the arrest. The facts of the most recent incident of abuse are as follows: On or about July 19, 2001, Defendant pulled Plaintiffs glasses off of her face, pushed Plaintiff onto the ground, grabbed her by the neck and choked her. Defendant stated to Plaintiff that he wished she would die, grabbed her by the arm, and pulled her across the ground. When Plaintiff attempted to stand up, Defendant pushed her down a second time. Plaintiff got up and fled to the residence. Defendant followed Plaintiff to the residence, grabbed the phone from her as she attempted to call police, and threw the phone on the ground causing it to smash into pieces. Defendant threw Plaintiff onto the couch, restrained her by pushing his knee on her chest, choked her, and stated he wished she would die. When Plaintiff managed to get free, the police arrived and arrested Defendant. Plaintiff suffered soreness, bruising, and scratches as a result of the incident of abuse. Defendant has only resided with his mother for a period of three months. Plaintiff suffered pain and reasonable fear of imminent serious bodily injury. 15. Prior incidents of abuse that the Defendant has committed against Plaintiff or the minor children, (including any threats, injuries, or incidents of stalking) are as follows: In or about 1995, Defendant punched Plaintiff in the mouth causing her lip to bleed and swell. 16. The police department(s) or law enforcement agencies that should be provided with a copy of the protection order are: Carlisle Police Department Harrisburg City Police York City Police, PA New York State Police 17. There is an immediate and present danger of further abuse from the Defendant. 18. FOR THE REASONS SET FORTH ABOVE, I REQUEST THAT THE COURT ENTER A TEMPORARY ORDER, and AFTER HEARING, A FINAL ORDER THAT WOULD DO THE FOLLOWING: a. Restrain Defendant from abusing, threatening, harassing, or stalking Plaintiff and/or minor children in any place where Plaintiff maybe found. b. Prohibit Defendant from having any contact with Plaintiff and/or minor children, either in person, by telephone, or in . writing, personally or through third persons, including but not limited to any contact at Plaintiffs school, business, or place of employment, except as the court may find necessary with respect to partial custody and/or visitation with the minor children. c. Order Defendant to pay the costs of this action, including filing and service fees. d. Order the following additional relief, not listed above: Defendant shall not harass Plaintiff s relatives. CUMBERLAND COUNTY, PENNSYLVANIA NO.O1-4596 CIVIL TERM Defendant :PROTECTION FROM ABUSE MOTION FOIE CONTINUANCE The Plaintiff, Dora Sullivan, by and through her attorney, Joan Carey of Legal MidPenn Services, moves the Court for an Order generally continuing the hearing in the above-captioned case on the grounds that: A Temporary Protection From Abuse Order was issued by this Court on August 1, 2001, scheduling a hearing for August 6, 2001, at11:15 a.m. 2. The Cumberland County Sheriff s Department deputized the Dauphin County Sheriff to serve the defendant with the Temporary Protection From Abuse Order and Petition for the above captioned matter. 3. The defendant was served with the Protection From Abuse Order and Petition on August 3, 2001, at 12:19 p.m. at the Dauphin County Prison, Dauphin County, Pennsylvania. 4. Since the defendant is currently incarcerated in the Dauphin County Prison, MidPenn Legal Services was informed by the Cumberland County Sheriff that they need a two or three day notice to arrange transportation for the defendant to a hearing. Furthermore, MidPenn Legal Services is requesting a Continuance to afford then time to negotiate a Consent Agreement. 1 The Plaintiff requests that the Temporary Protection From Abuse Order remain in effect for a period of eighteen months from the date it was entered, August 1, 2001, or until further Order of Court, whichever comes first.
