WHEREAS, RON WILLIS of 413 Wiconisco Street, Harrisburg, Pennsylvania, is about to
execute contemporaneously herewith, a contract, with HAUBERT HOMES, INC. of 15 Central Blvd.,
Camp Hill, Pennsylvania, for the erection of a building upon premises commonly known as LOT 59
INVERNESS DRIVE, Township HAMPDEN, CUMBERLAND County, Pennsylvania, as set forth in
the deed dated December 8, 2000, rewrded at Deed Book 236, Page 479, in the Recorder's Office for
CUMBERLAND, County, Pennsylvania, as more specifically described in Exhibit "A" which is
incorporated herein and attached hereto.
NOW, August 1, 2001, at the time of and immediately before the execution of the principal
contract, and before any authority has been given by the said Owner to the said Contractor to commence
work on the said building, or purchase materials for the same in consideration of the making of the said
contract with Contractor and the further consideration of One Dollar ($1.00), to Contractor paid by
Owner, it is agreed that no lien shall be filed against the building by the Contractor, or any subcontractor,
nor by any of the materialmen or workmen or any other person for any labor, or materials purchased, or
extra labor or materials purchased for the erection of said building, the right to file such liens being
expressly waived.

ALL THAT CERTAIN tract or parcel of land being situate in Hampden Township, Cumberland
County, Pennsylvania, more particularly bounded and described as follows, to wit: _
BEGINNING at a point on [he southern right-of--way line of Inverness Drive, a 5Q foot wide
street, said point being the northeastern corner of Lot No. 58; thence along said right-of-way North 08
degrees 11 minutes 08 seconds East a distance of 64.46 feet ro a point; thence continuing along said right-
of-way line along a curve to the left having a radius of 425.00 feet an arc length of 16.00 feet, said arc
bei~ subtended by a chord of North 79 degrees 06 minutes 25 seconds East a distance of 16.00 feet to
a point, said point being [he northwestem corner of Lot No. 60; thence along the western line of said lot
South 1 t degrees 58 minutes 18 seconds East a distance of 126.74 feet to a point, said point being on the
northern line of lands now or formerly Phase 4; thence along the northern fine of said lands South 71
degrees 43 minutes 34 seconds West a distance of 86.17 feet to a point, said point being the southeastern
comer of Lot No. 58; thence along the eastern line of said lot Nortlt 09 degrees 48 minutes 52 seconds
West a distance of 139.03 feet to a point, the place of BEGINNING.
CONTAINING 11,010.00 square feet or 0.2525 acres.
BEING Lot No, 59 as shown on rite Final Subdivision Plan of Fairwinds, Phase III, recorded in
the Office of the Recorder of Deeds, Cumberland County, in Plan Boak 78, Page 40.
UNDER AND SUBJECT, NEPERTHELESS, to all easements, restrictions, encumbrances and
other matters of record or that which a physical inspection or survey of the premises would reveal.
ALSO UNDER AND SUBJECT to Declaration of Covenants and Restrictions applicable to
Fairwinds Residential Development, Hampden Township, Cumberland County, Pennsylvania, dated
December 9, 1996, recorded in the Office of the Recorder of Deeds of Cumberland County in Misc. Book

FURTHER, UNDER.AND SUBJECT to Firs[ Supplemental Declaration of Covenants and

Fennsylvania, dated April 8, 1999, recorded in the Office of the Recorder of Deeds of Cumberland
County in Misc. Book 610, Page 983, which imposes certain obligations upon the lots shown on the
