COMPLAINT FOR EQUITABLE INTERPLEADER
1. Plaintiff Allstate Insurance Company (hereinafter "Allstate') is a
corporation doing business in the Commonwealth of Pennsylvania.
2. Defendant John Rhoades is an adult individual, residing at 779 Hamilton
Court, Carlisle, Pennsylvania 17013, and is the Administrator of the Estate of Aaron
Rhoades, his son, who is deceased.
3. Defendant Adam Rhoades is an adult individual residing at 247 Arch Street,
Carlisle, Pennsylvania 17013.
4. Defendant Jeremy Walsh is an adult individual residing at 4129 Enola Road,
Newville, Pennsylvania 17241.
5. On or about December 13, 1998, Allstate's insured, Joshua D. Husler was
operating a 1987 Ford Mustang when he lost control of the vehicle and struck a utility
pole.
6. At the time of the accident, Adam Rhoades, Jeremy Walsh, and decedent
Aaron Rhoades were passengers in the Mustang that was being operated by Mr. Husler.
7. As a result of the accident, decedent Aaron Rhoades was killed.
8. As a result of the accident, Defendant Adam Rhoades suffered numerous
injuries, including a right radial fracture, right tibial fracture, both of which required open
reduction and internal fixation, a right foot hallulx fracture, tongue laceration, and
multiple facial abrasions.
9. As a result of the accident, Defendant Jeremy Walsh sustained a fractured
left ankle, laceration to his right eye, and closed head injury, a hematoma on his back, and
a right ankle sprain.
10. Allstate admits, for the purposes of this action only, that its insured is solely
liable for the damages sustained by the Defendants.
11. At the time of the accident, Mr. Husler had an automobile liability insurance
policy with Allstate, which provided liability coverage in the amount of $25,000.00 per
person/$50,000.00 per occurrence. (A true and correct copy of the official Allstate
computer printout evidencing coverages is attached hereto as Exhibit "A").
12. Allstate is not aware of any other liability coverage to cover its insured, Mr.
Husler for this loss.
13. Allstate is not aware of any other potential claims to the aforementioned
liability policy other than the claims of the Defendants herein.
14. As a result of the aforementioned accident, the following three lawsuits have
been filed:
(a) Tohn Rhoades, Administrator of the Estate of Aaron Rhoades
deceased, and Adam Rhoades v. Fast Eddie's Billiard Parlor & Salon
Inc. and William G. Magaro and Richard E. Phelan, t/d/b/a Magaro
And Phelan, a Pennsylvania Partnership v. Toshua Husler;
Cumberland County Docket No.: 2000-1983 Civil Term;
(b) Teremy Walsh v. Toshua Husler, Cumberland County Docket o.: 2000-
7550 Civil Term;
(c) Tohn Rhoades, Administrator of the Estate of Aaron Rhoades,
Deceased, and Adam Rhoades v. Toshua D. Husler, Cumberland
County Docket No.: 2000-1796 Civil Term.
15. Counsel for Defendant John Rhoades, Administrator of the Estate of Aaron
llhoades; Defendant Adam Rhoades; and counsel for Defendant Jeremy Walsh have
agreed to allocate the $25,000.00 per person limit of Allstate's insurance policy to settle the
claims on John Rhoades, Administrator of the Estate of Aaron Rhoades; however, counsel
is unable to agree upon an appropriate allocation of the remaining $25,000.00 available
under the Allstate policy issued to Mr. Husler.
16. In light of the number of claimants and the severity of the damages arising
out of the December 13,1998 accident, Allstate desires to interplead its liability limits into
the Court of Common Pleas of Cumberland County for distribution to the
claimant/Defendants as the Court deems appropriate.
17. This Court has the equitable power to accept interpleader of these funds and
to direct the Prothonotary to place the money into a financial institution with interest
accruing to the benefit of all claimants.
18. Allstate respectfully asks that this Court exercise its equity powers and
order the following:
(a) That the $50,000.00 liability limit of Allstate s insurance policy for Mr.
Husler be paid to the Prothonotary of the Cumberland County Court
of Common Pleas;
(b) That Allstate Insurance Company's payment of it's liability limits
completely extinguishes Allstate Insurance Company's liability with
respect to the claimants/ defendants;
(c) That the funds be placed into two interest bearing accounts by the
Prothonotary of the Cumberland County Court of Common Pleas,
each account receiving the $25,000.00 per person limit, and which
each account is neither managed or controlled by a person related to
Allstate Insurance Company and which Allstate Insurance Company
does not have a beneficial interest in the income or the corpus; and
(d) That the Prothonotary of the Cumberland County Court of Common
Pleas will hold such funds in interest bearing accounts until the Court
orders a distribution of the principal and all accrued interest to the
claimants.
WHEREFORE, Plaintiff Allstate Insurance Company respectfully requests that this
Court exercise its equitable powers as set forth herein.
