Plaintiff is Kenneth Aungst, Father, who currently resides at 4411 Packard Lane, Camp Hill, Cumberland County, PA 17011. 2. (Michelle Aungst was born during the marriage, and Joshua Aungst was adopted by Kenneth Aungst during the marriage.) 5. The children, Joshua and Michelle Aungst, are presently in the custody of Mother, Jennifer Aungst, who currently resides at 561 Summit Drive, Carlisle, Cumberland County, PA 17013. 6. The Father of the children is Kenneth Aungst, who currently resides at 4411 Packard Lane, Camp Hill, Cumberland County, PA 17011. 9. The parties are married. 10. The relationship of Plaintiff to the children is that of Father. Plaintiff currently resides with the following person: Person Relationship None. 11. Plaintiff and Defendant have not participated as a party or witness, or in another capacity, in other litigation concerning the custody of the children in this or another court. 13. The parties shall share or alternate having custody of the Children on holidays as arranged by agreement. 5. Unless otherwise agreed between the parties, the party receiving custody shall be responsible to provide transportation for the exchange of custody. Each party shall notify the other party in the event he or she will be more than 15 minutes late for an exchange of custody. 6. The Father shall continue his course of counseling to address issues concerning the parties' separation which may affect the Father's ability to communicate and cooperate with the Mother in co- parenting the Children. The counseling shall be expanded to address issues which have arisen in the relationship between the Father and Son (or both Children) when appropriate and as recommended by the counselor. 7. Counsel for either party may contact the Conciliator to schedule an additional Custody Conciliation Conference within 6 months of the date of this Order to review the custody arrangements if necessary. The parties hereto are parents of two children, JOSHUA AUNGST, born October 8, 1988, and MICHELLE Aungst, born March 8, 1995. 2. On October 22, 2001, this Honorable Court entered an Order controlling custody of the parties' children. The Order provided primary physical custody to Petitioner and partial custody to Respondent on alternating weekends and every Tuesday evening. A copy of the Court's Order is attached hereto as Exhibit "A". 3. Respondent has struggled with depression which evidences itself in SAIDIS SNUFF, FLOWER & LINDSAY AITOR EYS•AT-LAW 26 W. High Street Carlisle, PA violence, most notably toward the Defendant. As a result, on July 23, 2001, this Honorable Court entered a Protection from Abuse Order to the No. 01-2829. On September 27, 2001, Respondent was held in contempt of the terms and conditions of the July 23, 2001, Order. 4. On or about April 29, 2005, Respondent attempted to kill himself by discharging a hand-gun into his mouth. Prior to the suicide attempt, he had been abusing alcohol. 5. On information and belief, as a result of the gun-shot wound, Respondent suffered brain damage in the nature of a lobotomy. After release from Hershey Medical Center, he was transferred to Roxbury for a rehabilitation program which lasted between ten days and two weeks. Upon information and belief, he was released from the Roxbury program with instructions to attend AA meetings and to continue in therapy. 6. Respondent has quit both AA attendance and his therapy and has begun drinking heavily once more. 7. Respondent demands that Petitioner comply with the terms of the October 22, 2001, Court Order. 8. Petitioner believes and therefore avers that it would not be in the interest of the children to resume contact with the Respondent pursuant to the Court Order, although she has ensured that the children have had an opportunity to visit with their father. The Father agrees to follow the recommendations of his physician with regard to initiating treatment with a psychiatrist/psychologist/counselor and agrees to select the appropriate professional and initiate treatment as soon as possible. 3. The Mother agrees to continue counseling for the Children with Karen Jaskot or other professional selected by the Mother. After initiating treatment under the preceding paragraph of this Order, the Father shall contact the Children's counselor to schedule an individual meeting to discuss issues concerning the relationship between the Father and the Children. Thereafter, the parties shall follow the recommendations of the Children's counselor with regard to family counseling for the purpose of addressing issues which have risen in the relationship between the Father and the Children and re-establishing contact as appropriate to serve the Children's best interests. The Father shall sign any authorizations requested by the counselor if necessary to obtain medical or mental health information concerning the Father. 4. Counsel for either party may contact the conciliator within six months of the date of this Order to schedule an additional custody conciliation conference, if necessary to review the custodial arrangements. The parties shall participate in a course of co-parenting counseling with a professional to be selected by agreement between the parties and counsel. The purpose of the counseling shall be to assist the parties in establishing sufficient communication and cooperation to enable them to effectively co-parent their Child. The parties shall participate in a minimum of four (4) joint session and shall thereafter follow the recommendations of the counselor as to the frequency and duration of counseling sessions. The parties shall select the counselor and contact the counselor's office within ten (10) days of the custody conciliation conference to schedule their initial individual sessions with the counselor. 3. The parties shall initiate counseling with a professional for the purpose of improving the relationship between the Father and the Child. The parties recognize that this counseling may be more effective following substantial co-parenting counseling. Accordingly, as the parents engage in co- parenting counseling, the Mother shall make arrangements for the Child to begin sessions with the selected counselor under this provision to enable the counselor to establish a rapport with the Child prior to introducing the Father and the Mother into the process. The parties shall follow the recommendations of the co-parenting counselor as to when it is appropriate for the Father to begin the counseling sessions with the Child under this provision. The parties shall schedule all appointments recommended by the counselor for themselves and the Child on a timely basis. 4. Within six (6) months of the date of this Order, counsel for either party may contact the conciliator to schedule an additional custody conciliation conference after the parties have enga ed in co-parenting counseling and the counseling for the Father and Child has been initiated. g 5. This Order is entered pursuant to an agreement of the parties at a custody con conference. The parties may modify the provisions of this Order by mutual consent.
