COMPLAINT
The Plaintiff, BOBCAT FINANCIAL SERVICES, a Division of CITICAPITAL COMMERCIAL
CORPORATION, by its attorneys, KNUPP, KODAK & IMBLUM, P.C., brings this action of Assumpsit against
the Defendant to recover the sum of EIGHT THOUSAND, SEVEN HUNDRED SEVENTY-EIGHT DOLLARS
AND NINETY-THREE CENTS ($8,778.93), along with interest thereon from March 13, 2002, upon a cause of
action of which the following is a statement:
1. The Plaintiff, BOBCAT FINANCIAL SERVICES, is a Division of CITICAPITAL COMMERCIAL
CORPORATION, a corporation organized and existing under the laws of the State of Delaware, having its principal
office and place of business at 250 East John Carpenter Freeway, Post Office Box 141029, Irving, Texas 75014.
2. The Defendant, CHRONISTER LANDSCAPES INC., is a corporation organized and existing under
the laws of the Commonwealth of Pennsylvania, having its principal office and place of business at 564 South Third
Street, Lemoyne, Cumberland County, Pennsylvania 17043-2006.

3. On or about December 28, 2000, Defendant did enter into a Retail Installment Contract with Plaintiff
for the purchase of equipment known as a Bobcat Skid Steer Loader and Bobcat Snowblower. A true and correct
copy of said Retail Installment Contract is attached hereto, marked as Exhibit "A" and made a part hereof.
4. Defendant did default in the payment terms of the Retail Installment Contract and notification of said
default was provided to Defendant under date of February 13, 2002. A true and correct copy of said notification
is attached hereto, marked as Exhibit "B" and made a part hereof.
5. Due to Defendant's continued default, said equipment was repossessed and after proper procedures,
said equipment was sold to the highest bidder as evidenced by the Bill of Sale attached hereto, marked as Exhibit "C"
and made a part hereof.
6. Defendant was issued all credits due and owing to it and, further, was credited with the payment made
on account of the deficiency as set forth on Plaintiff's Statement of Account attached hereto, marked as Exhibit "D"
and made a part hereof.
7. The balance due and owing by Defendant to Plaintiff is the sum of EIGHT THOUSAND, SEVEN
HUNDRED SEVENTY-EIGHT DOLLARS AND NINETY-THREE CENTS ($8,778.93), as appears by the
Statement of Account hereto attached, made a part hereof and marked as Exhibit "D", less EIGHT HUNDRED
DOLLARS ($800.00) in payment.

Please be advised that the obligor under the above-described Contract is in default in its payment to
the outstanding indebtedness due and owing to Bobcat Financial Services ("CitlCapital"). The
amount presently in default, including any applicable late charges and expenses, as of February 13,
2002 is $3,075.41 (the "Default Amount"). Under the terms of the Contract, CitiCapital is entitled to
accelerate the entire unpaid indetedness of the Contract which as of February 24, 2002 is $32,218.00
(the "Remaining Indebtedness").
Please be advised that, if CitiCapital does not receive the Default Amount at the address below
within ten (10) days from the date of this letter, then CitiCapital will immediately accelerate the
Remaining Indebtedness and may elect to pursue any or all of its remedies in enforcing its rights
under the Contract to the extent permitted by law, including, but not limited to, demand of the
surrender of the collateral securing the obHgor's obligations under the Contract. Please be advised
that, in the event of such acceleration, any amounts received after such acceleration shall only be
applied against the Remaining Indebtedness, the latter of which will remain fully due and payable.
Furthermore, please be advised, to the extent permitted by law, the obligor remains liable for: la) any
additional interest that accrues on the amounts shown above until such amounts are paid in full; and
lb) attorney's fees and other costs and expenses incurred by CitiCapital in its enforcement of its
rights under the terms of the Contract.

Property, the buyer affirms that it has not relied on the Seller's skill or judgement to select
or furnish the Property for any particular purpose. THE SELLER MAKES NO WARRANTY,
EXPRESS OR IMPLIED, AS TO THE QUALITY, WORKMANSHIP, DESIGN, SUITABILITY, OR
FITNESS FOR ANY PARTICULAR PURPOSE OR ANY OTHER REPRESENTATIONS OR
WARRANTIES WHATSOEVER, EXPRESS OR IMPLIED OR STATUTORY, THAT EXTEND
BEYOND THE DESCRIPTION OF THE PROPERTY ON THE FACE HEREOF.
This is a final and exclusive expression of the agreement of the Seller and the Buyer and no
course of dealing, usage of trade or, course of performance shall be relevant to, explain,
modify, or supplement any term expressed in this.agreement.
By acceptance of delivery of the Property, the Buyer acknowledges that the Buyer had either
examined the Property as fully es desired, or has been given the opportunity for such
examination and has refused to make such examination.
