Plaintiff, Rory Smith is an adult individual with a current address of 6790 D Old Harrisburg Road, Yorlx Springs, Pennsylvania 17372. 2. Plaintiff, Smith's Auto, Inc., is a Pennsylvania Corporation with its principal place of business located at 5215 Simpson Perry Road, Mechanicsburg, Pennsylvania 17055. 3. Defendant, Marvin Kantorilx, is an adult individual, doing business as Environmental Air Plow, with an address of Rd # 1 Austin Boulevard, P.O. Box 108, Acme, Pennsylvania 15610. 4. Venue in this court is appropriate in that the Plaintiffs live and have a registered office located in Cumberland County, and regularly conduct business there. 5. Plaintiffs are in the auto body repair business. 6. Defendant is a paint booth manufacturer. 1 COUNT I -BREACH OF CONTRACT 7. On or about November 2, 1998, Plaintiffs provided Defendant with a Two Thousand Five Hundred 02,500.00) dollar deposit on a paint booth. 9. Defendant orally agreed to provide the requested paint booth for the Plaintiffs. 10. Defendant agreed that if the Plaintiffs did not want the booth, then, once the paint booth was sold to another customer, he would refund the Two Thousand Five Hundred 02,500.00) dollar deposit to the Plaintiffs. 11. Plaintiffs' plans changed and they no longer required the paint booth 12. The Defendant sold the paint booth at least four (4) months ago. 13. Defendant has refused to return the Two Thousand Five Hundred 02,500.00) dollar deposit to the Plaintiffs. 14. Plaintiffs have made proper demand for payment. 15. Plaintiffs are entitled to payment. 16. Plaintiffs are entitled to their costs in pursuing this matter.
