Trolinger, who currently resides at 9 Gobin Drive, Carlisle, Cumberland County, Pennsylvania, where she has resided since May 3, 2003. 2. The Defendant is Galen G. The Plaintiff avers that she is entitled to a divorce on the ground that the marriage is irretrievably broken and Plaintiff is proceeding under Sections 3301 (c) and/or (d) of the Divorce Code. 7. Plaintiff has been advised of the availability of marriage counseling and of the right to request that the Court require the parties to participate in marriage counseling, and does not request counseling. Background: The parties hereto are husband and wife having been joined in marriage on August 28, 1982 in Carlisle, Pennsylvania. Wife resides at 300 Third Street, Boiling Springs, Pennsylvania 17007. She was born on June 29, 1960. Husband resides at 34 South Middlesex Road, Carlisle, Pennsylvania 17013. He was born on July 28, 1956. The parties are the parents of two children, Jason Trolinger who is emancipated and Brooke Trolinger, born September 8, 1993. The parties have been separated since May 2, 2003. At the time of their separation, SAIDIS, FIAWER Sz LINDSAY 26 West High Street Carlisle, PA Husband was employed by Carlisle Tire and Wheel, earning approximately $47,000.00 per year by working swing shift. Wife was employed at Moffitt Heart Association, earning approximately $29,000.00 per year. On January 1, 2004, Wife commenced working with Carlisle Pediatric Associates and earns approximately $22,000.00 per year. An initial Order of Support in the captioned case was entered on August 6, 2003. It concluded that Husband had net monthly earnings of $2,757.77 and Wife had net monthly r ti earnings of $1,976.27. On or about March 2, 2005, Wife filed a Petition for Alimony Pendente Lite. Wife also sought modification of the Child Support Order. The Court's Orders of March 30, 2005 provided child support of $521.00 per month and alimony Pendente lite in the amount of $147.00 per month. In September, 2005, Husband asked for a reduction in his support, alleging a reduction in force which caused him to lose his swing shift and to earn less money. At the support conference on that Petition, Husband was found to have a net monthly income of $1,726.00 and Wife a net monthly income of $1,679.0. Accordingly, the Child Support Order was reduced $319.00 per month and the Alimony Pendente Lite Order was no longer in effect. At separation, Wife moved from the marital home with the parties' child. Husband remained in the marital home, which had a value at the time of approximately $90,000.00. The home was encumbered by a mortgage with a payoff of approximately $34,000.00 and a home equity loan with a payoff of approximately $50,000.00. The monthly payment on the mortgages was approximately $940.00. Husband left the marital home in December 2003, but he stopped making the mortgage payments as of July 2003 and the house was taken in mortgage foreclosure. Husband resided, therefore, at no cost to himself in the marital home for a period of five months. On or about June 27, 2003, Wife filed a Petition in Bankruptcy under Chapter 7 of the SKIS, FLOWER ~ LINDSAY ~w 26 West High Street Carlisle, PA Bankruptcy Code. Husband filed a Petition in Bankruptcy under Chapter 7 on September 2, 2004. Initially, Husband was represented by Michael Scherer, Esquire. Requests to Mr. Scherer or documentation of the value of Husband's employment benefits were made in May 2006. Subsequent follow up inquiries revealed that Mr. Scherer would no longer be representing Husband. By Order of Court of November 15, 2006, the Court of Common Pleas permitted Mr. Scherer to withdraw from representation. Wife was required to schedule a records deposition in order to learn the value of the employment benefits. The parties are the natural parents of two children; one is emancipated, the other child resides with wife. The Master has been advised that the parties have reached an agreement with respect to the outstanding economic claims. The agreement-is going to be placed on the record. If we have time later this morning, we will have the parties return with counsel for wife and review the agreement for typographical errors, make corrections as necessary and then affix their signatures affirming the terms of settlement. It is understood that the agreement as placed on the record will be considered the substantive agreement of the parties, not subject to any changes or modifications except for correction of the typographical errors as previously mentioned. Husband will retain the 1989 Ford F-150 and the pop-up camper. Wife will retain the 1995 Ford Wind Star van. The parties will execute any documents required to transfer title within ten (10) days of the date of this agreement.
