STIPULATION AGAINST LIENS
WHEREAS, Joseph J. Spilaand Margaret I. Spila, ofShippensburg, Pennsylvania,
is about to execute contemporaneously herewith, a contract with Michael Manning &
Associates of Cumberland County, Pennsylvania, for the erection of a dwelling upon a lot of
land situate as follows:
ALL THAT CERTAIN piece or parcel of land situate in the Township of East
Pennsboro, Cumberland County, Commonwealth of Pennsylvania, being morefullydescribed
as follows:
BEGINNING at a point on the southeastern dedicated right-of-way line of
Sullivan Street at the dividing line of Lot No. 15 and Lot No. 16, Hickory Ridge, Phase I,
recorded in Plan Book 77, Page 143; thence by said dividing IineSouth 66 degrees46minutes
45 seconds East, a distance of 206.30 feet to a point at the dividing line of lands now or
formerly of Irvin E. and Thelma G. Stambaugh, Tract No. 1 and the lands herein described;
thence by the same, South 03 degrees 48 minutes 20 seconds East, a distance of 35.14 feet
to a point at the dividing line of lands now or formerly of Ray and Marie Stambaugh; thence
by the same, the following two courses and distances: 1) South 10 degrees 14 minutes 26
seconds East, a distance of 99.57 feet to a point; 2) South 10 degrees 15 minutes 45 seconds
East, a distance of 40.54 feet to a point at the dividing line of Lot No. 17 and Lot No. 16,
herein described; thence by said dividing line, North 54 degrees 04 minutes 16 seconds West,
a distance of 311.45 feetto a point on the dedicated right-of-way I ine of Sull ivan Street; thence
by said right-of-way line, the following two courses and distances: 1) by a curve to the left
having a radius of 175.00 feet and an arc distance of 38.83 feet to a point; 2) North 23 degrees
13 minutes 15 seconds East, a distance of 41.18 feet to a point, the Place of BEGINNING.
BEING Lot No. 16 as shown on Final Subdivision Plan of Hickory Ridge, Phase
I, recorded in Plan Book 77, Page 143, and being subject to all easements of record.
CONTAINING 27,143.52 square feet.
UNDER AND SUBJECT TO restrictions recorded in Miscellaneous Book 608,
Page 194.
NOW,the a7~ day of August,2001, atthetimeofandimmediatelybefore
the execution of the principal contract, and before any authority has been given by the said
Joseph J. Spila and Margaret I. Spila, to the said Michael Manning & Associates to commence
work on the said building, or purchase materials for the same in consideration of the making
of the said contract with Michael Manning & Associates and the further consideration of One
Dollar, to Michael Manning & Associates paid by Joseph J. Spila and Margaret I. Spila, it is
agreed that no {ien shall be filed against the building by the contractor, or any sub-contractor,
nor by any of the material men or workmen or any other person for any labor, or materials
purchased, or extra labor or materials purchased for the erection of said building, the right to
file such liens being expressly waived.
