THI€~ AGREEMENT made the a1~' day of August, 2001, by and
between CUMBERLAND DE3IGN AND BUILDING C07SPANY, TNC „ Builder, of
P.o. Box 248, Carlisle, Pennsylvania 17013, hereinafter referred
to as Contractor, AIOD pAVID E. WHITNEY and PATRICIA L. WHITNEY,
husband and wife, of 1773 Kendall Drive, Mechanicsburg,
Pennsylvania 17055, and GARDNER 12. WHITNEY and WANOA L. WHTTNEX,
husband and wife, of 509 8th Street, New Cumberland, Pennsylvania
17070, hereinafter referred to as Owner, whereby the former
undertooK and agreed to complete certain improvements on that
certain lot of ground situate at 57.42 Trindle Road,
Mechanicsburg, Hampden Township, Cumberland County, Pennsylvania,
being Lox No. 1, on the Subdivision Plan of Gilbert Miller Baer,
dated Mareh 7, 1973, said plan be3.ng recorded June 27, 1978 in
the Cumberland County Recorder of beads Office in Plan Book as,
Page 193. Beinq the same premises which 1iAMPDEN INDUSTRIAL
DEVELOPMI~NT AUTHORITY, by Deed dated October 16, 1992 and
recorded October 30, 1992 in the Cumberland Recorder of Deeds
Office in Deed Book X35, Page 794, granted and conveyed unto
Gardner 12. Whitney and Wanda L. Whitney, husband and wife and
pavid E. Whitney and Patricia L. Whitney, husband and wife.
NOW THERE7?'ORII, THIS AGREEMENT WITNESSETBS That the said
Contractor, for and in consideration of the sum of One ($1.00)
Dollar to him in hand paid by Owner, the receipt whereof is
hereby acknowledged, and the further consideration mentioned in
the agreement aforesaid, for themselves and their subcontractors,
and all parties acting through or under them, covenant and agree
that no mechanie~s liens or claims shall be filed or maintained

by them or any of them against the said buildings and the l,ot of
ground appurtenant thereto for or on account of any work done or
materials furnished by them or any of them under said contract or
otherwise, for, towarfls, in, or about the erection and
construction of the said buildings on the lot above described,
and the said Contractor, for themselves, their subcontractors and
others under them hereby expressly waive and relinquish the right
to have, file, and maintain any mechanics liens or claims
against the said buildings cr any of them and agree that this
instrument, waiving the right of lien, shall be an independent
covenant.

officers and its corporate seal to be affixed hereto, the day and
year above written.
