STIPULATIONAGAINSTLIELAS
THIS AGREEMENT made the day of September, 2001, by and between,
JAMES GRUVER and KENNYGRUVER, hereinafter referred to as Contractor,
AND
JOHN J. DEWALT, JR. and RUTHA. DEWALT, of Shippensburg, Pennsylvania, hereinafter
referred to as Owner,
WHEREAS, the said Contractor undertook and agreed to make certain improvements to
Owner's property situate in Southampton Township, Cumberland County, Pennsylvania, known as
Lot 7, Southampton Township, Cumberland County, Pennsylvania, more fully described in Exhibit
"A" attached hereto and made a part hereof.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for
and in consideration of the sum of One Dollar ($1.00) to said Contractor in hand paid by Owner, the
receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement
aforesaid, for himself, and his subcontractors, and all parties acting through or under them, covenant
and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them
against the said buildings and improvements and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of them under said contract or
otherwise, for, towards, in, or about the erection and construction of the said improvements on the
lot above described, and the said Contractor, for himself, his subcontractors and others under him
hereby expressly waive arid relinquish the right to have, file, and maintain any mechanic's liens or
claims against the said buildings or any of them, and agree that this instrument, waiving the right of
lien, shall be an independent covenant.

ALL that certain real estate lying and being situate in Southampton Township,
Cumberland County, Pennsylvania, bounded and described as follows:
BEGINNING at a point in Township Route 323, more commonly referred to as
Walnut Dale Road; thence by Walnut Dale Road, South 87 degrees 9 minutes 25 seconds
West 208.00 feet to a point; thence along lands now or formerly of Lonnie E. Snyder, Sr.
and John D. Stoner and Elizabeth M. Reip, North 4 degrees 29 minutes 38 seconds West,
410.50 feet to an existing iron pin; thence by lands now or formerly of John D. Stoner
and Elizabeth M. Reip, North 03 degrees 58 minutes 16 seconds West 191.94 feet to an
existing iron pin; thence along the same, North 85 degrees 52 minutes 00 seconds East
208.00 feet to a set iron pin; thence along remaining lands now or formerly of Harry A.
Doyle, Sr. and Juanita R Doyle, South 04 degrees 19 minutes 15 seconds East, 607.11
feet to a point, the place of BEGINNING.
CONTAINING 2.8956 acres and being, Lot No. 7 on a Subdivision Plan prepared
for Hany A. Doyle, Sr. and Juanita R Doyle by Thomas Michael Englerth Surveying,
dated June 4, 2001, and recorded in Cumberland County Plan Book 83, at Page 132.
BEING that same real estate that Harry A. Doyle, Sr., and Juanita R Doyle, his
wife, by their deed dated September 7, 2001 and intended to be recorded prior to the
recording of this mortgage in the Office of the Recorder of Deeds in and for Cumberland
County, Pennsylvania, conveyed to John J. DeWalt, Jr., and Ruth A. DeWalt, husband
and wife, Mortgagors herein.
