Bennett, h/w, of Carlisle, Pennsylvania, are about to execute contemporaneously herewith, a contract, with Michael L. martin, Inc., of Lewisberrg Pennsylvania, for the erection of a two story dwelling building upon a lot of land situate in Middlesex Township, Cumberland County, Pennsylvania, more particularly bounded and described as follows, to wit: HLL that certain tract of land situate in MIDDLESEX TOWNSHU?, Cumberland Connty, Pennsylvania, being identified as Lot #11 as shown on a plan of lots ]mown as Pheasant Crossing prepared for Realand, Inc. by Hoover Engineering Services, Inc., dated Bngust l0, 1998, approved October 7, 1998 by the Middlesex Township Board of Supervisors and recorded November 6, 1998 in the Office of the Recorder of Deeds in and for Cumberland Connty, Pennsylvania in Plan Book 77 on page 128, and being more folly described as follows, to wit: BEGINNIIIC at a point in the centerline of T-573 (Hoover Road); thence by Lot l2 of the aforementioned subdivision North 05 degrees 26 minutes 56 seconds East a distance of five hundred twenty-five (525.00) feet to an iron pin; thence by Lot l2 of the aforementioned subdivision South 88 degrees l5 minutes 00 seconds West a distance of three hundred fifty-one and eighty-seven hundredths (351.87) feet to an iron pin; thence by land now or formerly of-Robert Line, Jr. and J. Edward Clouse, and by land now or formerly of William Seig, and by land now or formerly of Vincent Corrado and by land now or formerly of William Verbos North Ol degrees 45 minutes 00 seconds West a distance of one thousand one hundred ninety-nine and twenty-three hundredths (1,199.23) feet to an iron pin; thence by Lot 9 of the aforementioned subdivision North 88 degrees 15 minutes 00 seconds East a distance of one hundred twenty-seven and eighteen hundredths (127.18) feet to an iron pin; thence by Lot 8 and 6y Lot 4 of the aforementioned subdivision South 52 degrees O6 minutes 54 seconds East a distance of one thousand two hundred (1,200) feet to an iron pin; thence by Lot 1 of the aforementioned subdivision South 37 degrees 53 minutes 06 seconds West a distance of one hundred seventy-five and three hundredths (175.03) feet to an iron pin; thence 6y Lot 13 of the aforementioned subdivision North 87 degrees 20 urinates 23 seconds West a distance of five hundred thirty-nine and eighty hundredths (539.80) feet to an iron pin; thence by Lot 13 of the aforementioned subdivision South 05 degrees 26 minutes 58 seconds West a distance of eight hundred seventy-five (875:00) feet to a point in the centerline of T-573; thence in along and through the centerline of T-573 North 84 degrees 33 minutes 04 seconds West a distance of fifty (50.00) feet to a point in the centerline of T-573 (Hoover Road) and place of BECINNIIIG. Containing 16.373 acres of land as surveyed. IT BEINC part of the same premises which John J. Snyder, by deed dated July 17, 1998 and recorded in the Office of the Recorder of Deeds in and for Cumberland Connty, Pennsylvania in Record Book l8l at page 724, granted and conveyed title unto Realand, Inc., and grantor herein, FURTHER UNDER gND SUBJECT to the Protectiae Covenants and Restrictions set forth in that certain instrument recorded in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania in Record Book 594 at page 1073. Now, September 7, 2001, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said Owners to the said Contractor to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with Michael L. Martin, Inc. and the further consideration of One Dollar, to Contractor paid by Greg R Bennett & Hllyson S. Bennett, h/w, it is agreed that no lien shall be filed against the building 6y the contractor, or any sub-contractor, nor by any of the material men or worlmien or any other person for any labor, or materials purchased, or extra-labor or materials purchased for the erection of said building, the right to file such liens being expressly waived.
