Whereas, Brian S. Foster and Robyn L. Foster, his wife of 878 Grahams Woods Road, Newville, Cumberland
County, Pennsylvania have executed or are about to execute contemporaneously herewith, a contract with J &

home addition upon a lot of land situate in Upper Frankford Township, Cumberland County, Pennsylvania,
being known as 878 Grahams Woods Road, as recorded in Cumberland County Plan Book 108, Page 153.
ALL that certain messuage or tenement and tract of land situate in the Township of Upper
Frankford, County of Cumberland, and State of Pennsylvania, bounded and described as follows:
ON the West and North by lands now or formerly of Joim Chronister and Cemete~ lot; on the
East by a public road; and on the South by lands now or formerly of Charles Baughman.
CONTAINING three (3) acres and twenty-four (24) perches, more or less; together with the
. improYements, rights, privileges and appurtenances to the same belonging.
BEING the same premises which Betty Nelson, Ruth Hoover and George Foster, Executors of
the Estate ofMahle L Foster, by their Deed dated July 7, 1994 and recorded July 8, 1994, in the Office
oftbe Recorder of Deeds in and for Cumberland County, Pennsylvania, in Deed Book 108, Page 153,
granted and conveyed unto Brian S. Foster and Robyn L. Reihart, Grantors herein. The said Robyn L.
Reihart is now known as Robyn L. Foster by virtue of her marriage to the said Brian S. Foster.
Now, October 9, 2001, at the time of and immediately before the execution oftbe principal contract, and
before any authority has been given by the said Owners to the said Contractor to commence work on the said
building, or purchase materials for the same in consideration of the making oftbe said contract with them and
the further consideration of one Dollar, to Contractor paid by Owners it is agreed that no lien shall be filed
against the building by the contractor, or any sub-contractor, nor by any of the material men or workmen or any
other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said
building, the right to file such liens being expressly waived.
