Marshall, counsel for the plaintiff in the above action (or actions), respectfully represents that: 1. The above-captioned action is at issue. 2. The Principal amount of the claim of the plaintiff in the action is $695.00. There is no counterclaim of the defendant in this action. 3. The following attorneys are interested in the case(s) as counsel or are otherwise disqualified to sit as arbitrators: Joseph L. Hatchings, Esquire and Charles Rees Brown, Esquire. 4. A case involving the same parties and the same transaction at issue in this landlord-tenant case (with Defendant as Plaintiff) has been filed in the Court of Common pleas at Case No. 2001-5677. Tow different case numbers exist as there were two appeals from the same r„ magistrate case. An arbitration has been scheduled in that case before John B. Mancke, Esquire, Douglas C. Lovelace, Jr., Esquire and Anthony T. Lucido, Esquire for October 1, 2003. See Exhibit "A". 5. Plaintiff requests that the arbitrations be heard at the same time arbitrators at the same time and date. COMPLAINT AND NOW, comes the Plaintiff, BANKERS FINANCIAL SERVICES, INC., t/d/b/a USA HOME LOANS, improperly designated as MARK CAMPISI bd/b/a USA HOME LOANS, by and through its attorneys, DILLON McCANDLESS KING COULTER & GRAHAM L.L.P., per Matthew F. Marshall, Esquire, and files the following Complaint in Civil Action: 1. Plaintiff, BANKERS FINANCIAL SERVICES, INC., is a Pennsylvania corporation with a registered fictitious name of USA HOME LOANS ("USA Home Loans"), with an office located at 505 Hansen Avenue, Butler, Pennsylvania 16001. USA Home Loans was improperly designated as Mark Campisi t/d/b/a USA Home Loans in the district justice proceeding below. 2. Defendant, DETWEILER ENTERPRISES, INC. ("Detweiler"), is a corporation with an office located at 3310 Market Street, Camp Hill, Pennsylvania 17011. ,~~ 3. On or about June 27, 2000, Detweiler and USA Home Loans entered into a lease for approximately 695 feet of space known as Suite B, Second Floor, 5137 Devonshire Road, Harrisburg, PA 17112. A copy of the lease is attached hereto as Exhibit "A". 4. The lease expired on January 31, 2001. 5. USA Home Loans has received from Detweiler neither the return of its security deposit under the lease, nor a written notification from Detweiler itemizing any alleged deductions from the security deposit. 6. USA Home Loans is entitled to return of its security deposit in the amount of $695.00, plus interest, late charges, and reasonable attorneys' fees. WHEREFORE, Plaintiff demands judgment against Defendant in the amount of Six Hundred Ninety Five and no/100 Dollars ($695.00), plus interest at the rate of six percent per year from February 1, 2001 until time of judgment, plus late charges, attorneys' fees and costs.
