BROUJOS: Do I do that to you? 9 THE COURT: Not today. It wasn't you today. I 10 just got off the phone with my wife. No, I'm only kidding. 11 Okay. Do you want to articulate? 12 MR. BROUJOS: If the Court please, the parties 13 request the Court to enter this temporary order: Parents 14 shall have shared custody on alternating weeks, commencing 15 October 10 at 2:00 p.m. to October 17, 2001, after normal 16 school hours. The receiving parent shall provide 17 transportation from the school. The child shall attend East 18 pennsboro school system. 19 Parent with custody of child shall keep the child 20 during holidays falling on their custody period or as agreed 21 by the parties. 22 Parties will continue counseling with a mutually , 23 agreed-upon family therapist. The schedule shall be 24 determined by the therapist. 25 THE COURT: Well, the schedule of counseling? 2 ',-.- . _"~,.o _ =" .,11 _ , Tln -"t r- 1 MR. BROUJOS: Of when they attend. 2 THE COURT: Okay. 3 MR. BROUJOS: Child, parents and spouses shall 4 attend. Costs shall be shared by the parties. 5 MS. KADEL: Costs of the therapy. And also one 6 question we have, we intend this to be interim. We have a 7 conciliation scheduled for November 1st. 8 Under this particular order or agreement -- I 9 think you are probably going to have a solution for me. 10 THE COURT: What I am going to say is I will be 11 happy to set a custody hearing right now, which will be a 12 couple months down the road. And I hope -- 13 First of all, you are both to be congratulated in 14 reaching this agreement because I have been doing this a lot 15 of years, and except in the very rarest of circumstances, the 16 agreements can and should be reached by the parents. 17 If they really set aside their own hurts, real and 18 imagined, between each other and put the child at the center 19 and determine what is in the best interest of the child, 20 because there is not a judge in the world that can make this 21 decision. 22 I don't tuck this kid in at night and know what 23 his needs and wants are. Mom and dad do. Congratulations for 24 coming this far. I am going to schedule this for before the 25 end of the year so that this temporary order will be in place 3 o,~.:l@'..~ ^.~ '. If a change is going to be made, it will 5 be after Christmas vacation. 6 I am going to set something up in December right 7 now. With the hope that I will not have to have a hearing. 8 But, again, as I said, I will be prepared to have the hearing 9 if necessary. And depending on who you have 10 MS. KADEL: We have Dawn Sunday for the 11 conciliation conference. So can that -- I didn't know if that 12 could be cancelled. 13 THE COURT: I don't see a need to have it. Today 14 you basically had the conciliation. 15 MR. BROUJOS: I suggest we cancel that. 16 MS. KADEL: Yes. 17 THE COURT: I will put it in there. KADEL: I am thinking if we need a hearing 6 then today doesn't really the resolution today doesn't have 7 a bearing on it. 8 THE COURT: That's correct. 9 -- a custody hearing is scheduled before this 10 Court on Friday, December 21, 2001, at 8:30 a.m. 11 MR. BROUJOS: I had one more matter when the Court 12 is ready. 13 THE COURT: Not quite. 14 MR. BROUJOS: One thing we neglected to discuss 15 was the Court's observation that the stepfather have anger 16 management. Could we include that in some way? 17 THE COURT: Yeah. I said anger management. A 18 parenting class may be every bit as warranted, and I am 19 talking about through Children and Youth or Children's 20 Playroom, the TIPS classes, things like that. 21 MS. KADEL: Well, I would suggest we leave it out 22 of the order, quite honestly. If we come before you at a 23 hearing in December, and he hasn't done any of the things you 24 suggested, I suspect it will have a bearing on your decision. 25 He is here today. MR. BROUJOS: If we could simply agree to that on the record, but not put it in the order. We will simply send a letter to the therapist indicating that anger management should be included in his agenda. MS. KADEL: I have no problem with that. That's fine. THE COURT: Okay. Fine. THE COURT: please keep the lines of communication open. Do you have E-mail? MRS. FUHRER: (NODDED HEAD) THE COURT: Do you have E-mail? MR. NESBIT: (NODDED HEAD) THE COURT: I tell you what I suggest, because oftentimes when you talk to each other, the tempers tend to flare. The old hurts that you had between each other come to the mind subconsciously. An exercise that I think works very well, and I am going to put this in the order, actually, that I am going to want each of you to E-mail the other every day to say something every day that the child has done in your custody. Commence the E-mail and say something that the child did good that day, and then I want the other parent to respond. And I want to see copies of those E-mails at the custody hearing. So it is 2 going to take a minute and a half a day that I am asking you 3 to devote to E-mailing each other, and I want you to copy 4 those and bring them in to me. 5 When you have the child, you E-mail her and say 6 what he's done, something good that day, and you respond: I 7 got it. Hey, this reminds me of this. That's good. Keep up 8 the good work. 9 And then I want, what, two months' work of those 10 copied? You copy what you send. You copy what you sent or 11 however you can work it out. But I want to see it:. Okay? 12 Good luck. He deserves two parents working together. So good 13 luck to you, and I will see you on the 21st. The Petitioner is Denise J. Fuhrer who currently resides at 308 Glenn Road, Camp Hill, Cumberland County, Pennsylvania 17011. 2. The Respondent is Edward W. Nesbit, Jr., who currently resides at 506 S. Baltimore Street, Dillsburg, York County, Pennsylvania 17019. 3. The parties are the parents of a minor child; namely Eric Nesbit, age 13. 4. That on September 2,1994, Judge Jeannine Turgeon of the Court of Common Pleas of Dauphin County entered an Order incorporating the custody stipulation reached by the parties. A true and correct copy of the Order and Stipulation is attached hereto, incorporated herein, and marked Exhibit "A". Since the entry of the Order, both parties have relocated to Cumberland County, 5. The Stipulation provided, in pertinent part, that Mother, Denise J. Fuhrer, was to have primary physical custody of the parties' child, Eric Nesbit. The Stipulation also addressed custody ofthe parties' child Jake Nesbit, however, Jake passed away subsequent to the entry of that Order. Father, Edward W. Nesbit, Jr., was awarded partial physical custody every other weekend from 4:00 p.m. on Friday until 7:00 p.m. on Sunday and every other Friday from 4:00 p.m. to 8:00 p.m. 7. On or about Friday, September 29, 2001, Eric Nesbit went for his weekend of partial custody with his father, Edward W. Nesbit, Jr. His father has failed to return Eric to his Mother's residence since that time. 8. Further, Eric attends the East Pennsboro Middle School, however, Father failed to take Eric to school on Monday, October 1,2001 and Tuesday, October 2,2001. Eric was in school on Wednesday, October 3, 2001, however, he arrived at the school late. 9. Moreover, on Tuesday, October 2,2001, the school had "back-to-school night" which Father failed to attend with Eric. Father also failed to take Eric to his confirmation class which was the evening of Wednesday, October 3, 2001. 10. Father has contacted the Cumberland County Children and Youth Servic:e Agency to allege abuse of Eric by his stepfather, William B. Fuhrer. Based on Petitioner, Denise J. Fuhrer's, conversation with the Children and Youth case worker, Luanne Cummings, it is her understanding that Ms. Cummings advised Mr. Nesbit to return the child to the home of Denise [-i J. Fuhrer pending resolution of the investigation as a "safety plan" was in place. 11. Respondent, Edward W. Nesbit, Jr., has willfully failed to abide by the September 2, 1994 Custody Order in that he has failed to return the child to the primary custody of the Petitioner, Denise J. That on September 2,1994, Judge Jeannine Turgeon of the Court of Common Pleas of Dauphin County entered an Order incorporating the custody stipulation reached by the parties. A true and correct copy of the Order and Stipulation is attached hereto, incorporated herein, and marked Exhibit "A". Since the entry of the Order, both parties have relocated to Cumberland County. 5. The Stipulation provided, in pertinent part, that Mother, Denise J. Fuhrer, was to have primary physical custody of the parties' child, Eric Nesbit. The Stipulation also addressed custody of the parties' child Jake Nesbit, however, Jake passed away subsequent to the entry of that Order. ,-, ,. ~.." -.,.,,..,. 6. Father, Edward W. Nesbit, Jr., was awarded partial physical custody every other weekend from 4:00 p.m. on Friday until 7:00 p.m. on Sunday and every other Friday from 4:00 p.m. to 8:00 p.m. 7, On or about Friday, September 29,2001, Eric Nesbit went for his weekend of partial custody with his father, Edward W. Nesbit, Jr. His father has failed to return Eric to his Mother's residence since that time. 8. Further, Eric attends the East Pennsboro Middle School, however, Father failed to take Eric to school on Monday, October 1, 2001 and Tuesday, October 2, 2001. Eric was in school on Wednesday, October 3, 2001, however, he arrived at the school late. 9. Moreover, on Tuesday, October 2, 2001, the school had "back-to-school night" which Father failed to attend with Eric. Father also failed to take Eric to his confirmation class which was the evening of Wednesday, October 3, 2001. 10. Father has contacted the Cumberland County Children and Youth Service Agency to allege abuse of Eric by his stepfather, William B. Fuhrer. Based on Petitioner, Denise J. Fuhrer's, conversation with the Children and Youth case worker, Luanne Cummings, it is her understanding that Ms. Cummings advised Mr. Nesbit to return the child to the home of Denise J. Fuhrer pending resolution of the investigation as a "safety plan" was in place. 11. Respondent, Edward W. Fuhrer who currently resides at 308 Glenn Road, Camp Hill, Cumberland County, Pennsylvania 17011. 2. The Respondent is Edward W. Nesbit, Jr., who currently resides at 506 S. Baltimore Street, Dillsburg, York County, Pennsylvania 17019. 3. The parties are the parents of a minor child; namely Eric Nesbit, age 13, date of birth May 23, 1988. The Petitioner and Respondent have been separated since approximately 1991 and divorced in approximately 1992. Pursuant to Order dated September 2,1994 from the Court of Common Pleas of Dauphin County, Respondent was awarded, inter alia, partial physical custody every other weekend from 4:00 p.m. on Friday until 7:00 p.m. on Sunday. As well as in the intervening weeks on Friday evening from 4:00 p.m. until 8:00 p.m. A true and correct copy of the Order and Stipulation is attached hereto, incorporated herein, and marked Exhibit "A". Since the entry of the Order, both parties have relocated to Cumberland County 4. During the week preceding Father's visitation which was to occur on September 29,2001, Petitioner advised him that she would like to modify the Friday schedule somewhat in that she was proposing that Eric would not be brought to Father's home until his homework was completed after school on Fridays and that she would like to return to the terms of the September 2, 1994 Order. Father expressed dissatisfaction with this request and threatened that he would not return Eric at the appropriate time following his weekend. 6. Subsequently, Eric went for his scheduled period of partial custody with his Father on September 28,2001 and Father has yet to return Eric to the primary physical custody of his Mother since that visit. 7. Upon Eric's arrival at Father's home, Father contacted Cumberland County Children and Youth Services and alleged that Eric was being abused by his stepfather, William B. Fuhrer, 8, Eric is a student in the Supplemental Learning Support Program at East Pennsboro Middle School. Father failed to take Eric to school on Monday, October 1,2001 and Tuesday, October 2,2001. Eric was taken to school late on Wednesday, October 3, 2001. 9. Moreover, Eric missed "back-to-school" night on October 2, 2001 and failed to attend the first class for his confirmation studies on Wednesday, October 3, 2001. 10. A Custody Complaint was filed by Respondent, Edward W. Nesbit, Jr., on Wednesday, October 3, 2001 requesting that he be granted primary physical custody of the minor child. A custody conciliation conference has not yet been scheduled. 11. Petitioner, Denise J. Fuhrer who currently resides at 308 Gleno Road, Camp Hill, Cumberland County, Penosylvania 17011. 2. The Respondent is Edward W. Nesbit, Jr., who currently resides at 506 S. Baltimore Street, Dillsburg, York County, Penosylvania 17019. 3. The parties are the parents of a minor child; namely Eric Nesbit, age 13, date of birth May 23, 1988. The Petitioner and Respondent have been separated since approximately 1991 and divorced in approximately 1992. Pursuant to Order dated September 2, 1994 from the Court of Common Pleas of Dauphin County, Respondent was awarded, inter alia, partial physical custody every other weekend from 4:00 p.m. on Friday until 7:00 p.m. on Sunday. As well as in the intervening weeks on Friday evening from 4:00 p.m. until 8:00 p.m. A true and correct copy of the Order and Stipulation is attached hereto, incorporated herein, and marked Exhibit "A". Since the entry of the Order, both parties have relocated to Cumberland County 4. Sometime in 1998, the parties verbally modified the Order to extend Father's alternating Friday custody from 4:00 p.m. to overnight rather then a return at 8:00 p.m. "....'~"" ." , , ~ - r- . During the week preceding Father's visitation which was to occur on September 29,2001, Petitioner advised him that she would like to modify the Friday schedule somewhat in that she was proposing that Eric would not be brought to Father's home until his homework was completed after school on Fridays and that she would like to return to the terms of the September 2, 1994 Order. Father expressed dissatisfaction with this request and threatened that he would not return Eric at the appropriate time following his weekend. 6. Subsequently, Eric went for his scheduled period of partial custody with his Father on September 28, 2001 and Father has yet to return Eric to the primary physical custody of his Mother since that visit. 7. Upon Eric's arrival at Father's home, Father contacted Cumberland County Children and Youth Services and alleged that Eric was being abused by his stepfather, William B. Fuhrer. 8. Eric is a student in the Supplemental Learning Support Program at East Pennsboro Middle School. Father failed to take Eric to school on Monday, October 1, 2001 and Tuesday, October 2,2001. Eric was taken to school late on Wednesday, October J, 2001. 9. Moreover, Eric missed "back-to-school" night on October 2,2001 and fmled to attend the first class for his confirmation studies on Wednesday, October 3, 2001. 10. A Custody Complaint was filed by Respondent, Edward W. Nesbit, Jr., on Wednesday, October 3,2001 requesting that he be granted primary physical custody of the minor child. A custody conciliation conference has not yet been scheduled. 11. Petitioner, Denise J. Fuhrer who currently resides at 308 Glenn Road, Camp Hill, Cumberland County, Pennsylvania 17011. 2. The Respondent is Edward W. Nesbit, Jr., who currently resides at 506 S. Baltimore Street, Dillsburg, York County, Pennsylvania 17019. 3. The parties are the parents of a minor child; namely Eric Nesbit, age 13, date of birth May 23, 1988. The Petitioner and Respondent have been separated since approximately 1991 and divorced in approximately 1992. Pursuant to Order dated September 2, 1994 from the Court of Common Pleas of Dauphin County, Respondent was awarded, inter alia, partial physical custody every other weekend from 4:00 p.m. on Friday until 7:00 p.m. on Sunday. As well as in the intervening weeks on Friday evening from 4:00 p.m. until 8:00 p.m. A true and correct copy of the Order and Stipulation is attached hereto, incorporated herein, and marked Exhibit "A". Since the entry of the Order, both parties have relocated to Cumberland County 4. Sometime in 1998, the parties verbally modified the Order to extend Father's alternating Friday custody from 4:00 p.m. to overnight rather then a return at 8:00 p.m. -"74?!f"""~ """' ~""1-'. _, ,-" ~-, - ,~. .. 5. During the week preceding Father's visitation which was to occur on September 29,2001, Petitioner advised him that she would like to modify the Friday schedule somewhat in that she was proposing that Eric would not be brought to Father's home until his homework was completed after school on Fridays and that she would like to return to the terms of the September 2, 1994 Order. Father expressed dissatisfaction with this request and threatened that he would not return Eric at the appropriate time following his weekend. 6. Subsequently, Eric went for his scheduled period of partial custody with his Father on September 28,2001 and Father has yet to return Eric to the primary physical <custody of his Mother since that visit. 7. Upon Eric's arrival at Father's home, Father contacted Cumberland County Children and Youth Services and alleged that Eric was being abused by his stepfather, William B. Fuhrer. 8. Eric is a student in the Supplemental Learning Support Program at East Pennsboro Middle School. Father failed to take Eric to school on Monday, October 1, 2001 and Tuesday, October 2,2001. Eric was taken to school late on Wednesday, October 3, 2001. ., < 9. Moreover, Eric missed "back-to-school" night on October 2, 2001 and failed to attend the first class for his confirmation studies on Wednesday, October 3, 2001. 10. A Custody Complaint was filed by Respondent, Edward W. Nesbit, Jr., on Wednesday, October 3,2001 requesting that he be granted primary physical custody of the minor child. A custody conciliation conference has not yet been scheduled. 11. Petitioner, Denise J. Fuhrer, has been Eric's primary caretaker since birth and has had primary physical custody of her son for the past ten (10) years. l;'l'1l11li"!.',.r" ~ r -,~ . .' ,.. 12. Petitioner believes that entry of an immediate Temporary Order is necessary to confirm that she have primary physical custody of Eric in order to ensure his physical and emotional welfare. 13. Plaintiff does not know of a person not a party to the proceedings who has physical custody of the child or claims to have custody or visitation rights with respect to the chlild. 9. Each parent who has parental rights to the child which have not been terminated and the person who has physical custody of the child are parties to the action, 10. The Child has been periodically physically abused by Bill Fuhrer, occupant of the residence in which Mother and Child have resided. Child was afraid to divulge the physical abuse until he was physically abused on September 27,2001. 11. The events of physical abuse that occurred are as follows: A. On September 27,2001 Child came home at dusk after a scooter ride. After he entered the house, Bill Fuhrer, herein referred to as Bill, was angry at Child for coming in late; threw his shoe at Child which hit him on the arm; ran across the room making wide punches, hitting Child on the back of the head; tackled the Child; hit him as Child was getting up and then kicked Child, causing him to hit the floor and marking the floor; kicked Child in the ribs and pulled Child by the neck; inflicting marks and bruises on right side of his back, causing injury in the ribs, bruise on the left arm where the shoe hit him; causing pain in the back of the head where Child had been hit; and causing headaches, at one point for two hours; and causing Child to cry. B. On or about December of 2000, during a school day, at approximately 8:00-9:00 p.m., Bill pushed Child into the bathroom; shut the door; grabbed the collar of Child and ^-'-- - - ft_=" slanuned Child into a mirror; hit Child in the head twice; causing a bump on the head for a week or two, black and blue marks on the back; and hit Child in the head with his open hand. Co On or about the summer of2000, at or around dinnertime from 5:00-6:00 p.m., claiming that Child was "disrespectful", Bill kicked Child in his shins and forced or pushed Child's face into a table; causing injury and pain and a bruise on the shins. D. Bill regularly embarrasses Child in front of people, calling him an f.. .ing moron, a dummy, and stupid. E. Periodically, Bill has threatened to put Child "through the wall" (sometime in the year 2000); and has threatened Child in front of his friends in the house as "stupid", "1'11 kick your ass", and "you might not live another day." F. Bill also threatened Child with similar remarks in front of Child's step- grandparents. 12. During the events that have been related above, Child relates that although Mother got upset during some of these events, she made no effort to help Child. Plaintiff reported the events of September 27, 2001 to Children & Youth Services, which talked with Father over the phone, but did not personally interview Father or Child. In addition, Father reported the incident to the East Pennsboro Township Police. 13. Child fears Bill and is forced into a situation where the Mother leaves at 7:00 a.m. to go to the Osteopathic Hospital in Harrisburg, returning after 3:00 p.m., leaving Bill in the house all day long, where he has a residential virtual office for AT&T. 14. Both parties shall have shared legal cus.tody of their son, Eric Nesbit, born May 23, 1988. 2. Primary physical custody shall be in the Father. 3. Mother shall have partial physical custody as follows: (a) Every other weekend from Friday at 7:00 p.m. until Sunday evening at 9:00 p.m. commencing on Friday, December 28, 2001. (b) Commencing 2002, Mother shall have the child from December 24 at noontime to December 25 at noontime. Father shall have custody December 25 to December 26 at noon- time. Thereafter, the parties will alternate custody during the Christmas holiday in the same manner. (c) The parties shall alternate the holidays of Easter, Memorial Day, July 4 and Labor Day and Thanksgiving. (d) Regardless of the visitation schedule, Father shall always have the child on Father's Day and Mother shall always have the child on Mother's Day. 4. Summer vacation shall be as follows: (a) Father shall have uninterrupted physical custody of the child after termination of school to June 16. (b) Mother shall have uninterrupted physical custody of the child from June 16 to July 27. (c) Father shall have uninterrupted physical custody from July 27 to the commencement of school. Thereafter, Mother's alternating period of weekend physical custody shall resume the first weekend after the first full week of school. 5. Father shall provide Mother with all report cards, status reports, or other writings issued by the school regarding Eric's education. 6.
