WHEREAS, RANDY R. CLARK and DEANNE CLARK, of 706 Stony Ridge Road, St. Louis,
MO 63129, is about to execute contemporaneously herewith, a contract, with F & M CONSTRUCITON,
of ~/~~ ;t;;~iSrhKd ~(~~ ' Pennsylvania, for the construction of a dwelling
located upon premises commonly known Lot 13 HIgh Meadows, Mechanicsburg, Cumberland County,
Pennsylvania, as set forth in the Deed dated ct- \ \ _ (') \ , 2001, at Deed Book
, Page , in the Recorder's Office for Cumberland County, Pennsylvania, as more
specifically described in Exhibit "A" which is incorporated herein and attached hereto.
NOW, September \1).. ,2001, at the time of and immediately before the execution of the
principal contract, and before any authority has been given by the said Owner to the said Contractor to
commence work on the said building, or purchase materials for the same in consideration of the making
of the said contract with Contractor and the further consideration of One Dollar ($1.00), to Contractor paid
by Owner, it is agreed that no lien shall be filed against the building by the Contractor, or any
subcontractor, nor by any of the materiahnen or workmen or any other person for any labor, or materials
purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens
being expressly waived.

ALL that certain iece, parcel or lot of land situate between Woodcreek Drive and the
Yellow Breeches Creek i Lower AlJen Township, Cumberland County, Pennsylvania; said
premises being known as ot 13 as shown on the "Revised Preliminary/Final Subdivision Plan
For High Meadow Phas IV - Lots 13, 14 & IS" and recorded on April 1, 1999 in the
Cumberland County Rec rder Of Deeds Office in Plan Book 78, page 99; and said premises
being further bound and d scribed as follows:
BEGINNING at point on the eastern right-of-way line of Wood creek Drive at the
northwest corner of lands now or fonnerly Richard H. Snyder; thence along said right-of-way
line by a line curving to e left having a radius of 305.00 feet, an arc length of 100.00 feet,
and a chord bearing of. Oa033'34" E a distance of 99.55 feet to a point at the southwest.
corner of Lot 14; thence along said lot S 85038'54" E a distance of 199.33 feet to a point;
thence along same S 760 '58" E 11 distance of 225.20 feet to a point in the Yellow Breeches
