STIPULATION AGAINST MECHANICS' LIENS
WHEREAS, William M. Miller, Jr. and Peggy 1. Miller, of 1744 Conway Heath, Camp
Hill, Pennsylvania 17011 entered into a contract with J. W. Mumper Construction, Inc.,
Contractor, of 1 Bull Run Court, Mechanicsburg, Pennsylvania, to provide materials and perform
labor necessary for the construction of a two (2) story Mediterranean wood frame home
consisting of three (3) bedrooms and three (3) car attached garages, upon the following tract of
land known as Lot #3, Halyard Drive, River Bend, East Pennsboro Township, Cumberland
County, Pennsylvania, more specifically described as follows, to wit:
ALL THAT CERTAIN piece, parcel or lot of lands situate in East Pennsboro Township,
Cumberland County, Pennsylvania; designated as Unit No. 3 on the PreliminarylFinal Subdivision
Plan by Rettew Associates, for River Bend, A Planned Community dated November 15, 1996, last
amended January 7, 1999 and recorded in the Office of the Recorder of Deeds in and for
Cumberland County on February 24, 1999, in Plan Book 78, Page 75, and being designated as Unit
No, 3 in a Declaration of River Bend, A Planned Community, dated October 9, 1998 and recorded
in the Office of the Recorder of Deeds in and for Cumberland County, in Miscellaneous Book 591,
Page 477, being further bounded and described as follows, to wit:
BEGINNING at a point on the Westerly right-of-way line of Halyard (a 40 foot wide public
street) at a corner of Lot Number 2; thence along said Lot Number 2 the following two (2) courses
and distances: (I) North 64 degrees 15 minutes 30 seconds West, a distance of 60.98 feet to a
point; (2) South 84 degrees 03 minutes 28 seconds West, a distance of 279.15 feet to a point at a
corner of existing Lot Number 5 (Meminger Subdivision); thence along said Lot, North 29 degrees
54 minutes 22 seconds West, a distance of 14.0.06 feet to a point on line oflands now or formerly of
John A Wright and Bonita M. Wright; thence by said lands North 60 degrees 05 minutes 38
seconds East a distance of 174.72 feet to a: point at a corner of Lot Number 4; thence along said Lot
the following three (3) courses and distances: (1) South 29 degrees 54 minutes 22 seconds East, a
distance of 153.29 feet to a point; (2) North 84 degrees 03 minutes 28 seconds East, a distance of
206.45 feet to a point; (3) South 45 degrees 04 minutes 12 seconds East, a distance of 30.00 feet to
a point on the Westerly right-of-way line of Halyard; thence along said right-of-way line by a line
curving to the left and having a radius of 270.00 feet, an arc length of 90.42 feet and a chord
bearing of South 35 degrees 20 minutes 09 seconds West, a distance of 90.00 feet to a point, the
Place of BEGINNING. CONTAINING 44,033 square feet or 1.01 acres.
NOW, THEREFORE, it is hereby stipulated and agreed by and between the said parties as
part of the said contract and for the consideration therein set forth, that neither the undersigned

contractor, any sub-contractor or material man, nor any other person furnishing labor or materials to
c the said contractor under this contract shall file a lien, commonly called a mechanics' lien for work
done or materials furnished to the said building or any part thereof.
This Stipulation is made and intended to be filed with the County Prothonotary within ten
days after date, in accordance with the requirements of Act of Assembly of Pennsylvania, in such
case provided.
IN WITNESS WHEREOF, the said parties hereto have hereunto set their hands and seals
this day of October, 2001.
