WHEREAS, Shawn E. Bailey and Suzanne M. Bailey, Owners, are about to
execute contemporaneously herewith, a contract with Chateau Custome Home
Builders for the construction of a residential dwelling on Lot 8, Hampden
Station, cumberland County, Pennsylvania, described in Exhibit"A" hereto
attached.
NO.1, /0-31 ,2001, at the time of and immediately before
execution of the principal contract, and before any authority has been
given by the said Owners to Contractor to commence construction, or
purchase materials for the S2me in consideration of the making of the said
contract with Contractor and the further consideration of One Dollar to
Contractor paid by Owners it is agreed that no lien shall be filed against
said real estate or improvements erected thereon by the contractor, or any
subcontractor, nor by any of the materialmen or workmen or any other person
for any labor, or materials purchased, or extra labor or materials
purchased for the said construction, the right to file such liens being
expressly waived.

EXHIBIT "A"
ALL THAT CERTAIN parcel of land located in the Township of Hampden, County of Cumberland,
Commonwealth of Pennsylvania being shown and designated as Lot 8 on a plan entitled "Final
Subdivision Plan - Phase I For Hampden Station", by Dawood Engineering, Inc" plan dated November
18,1999 and last revised April 27, 2000.
Said parcel being more fully described as follows:
BEGINNING atan iron pin to be set along the eastem right-of-way line of Armitage Way atthe dividing
line between Lot 7 and Lot 8 as shown on the above said plan;
Thence along Lot 7, South 61 degrees 36 minutes 03 seconds East a distance of 126.25 feet to an iron
pin to be set along lands now or formerly of Pamay Development Co. Inc.;
Thence along said lands, South 00 degrees 30 minutes 57 seconds West a distance of 207.86 feet
to an iron pin to be set at the dividing line between Lot 9B and Lot 8;
Thence along Lot 9B, South 89 degrees 38 minutes 47 seconds West a distance of 21.72 feetto an
iron pin to be set at the dividing line between Lot 8 and Lot 9;
Thence along Lot 9, Nprth 38 degrees 40 minutes 57 seconds West a distance of 231.79 feet
(erroneously shown as 231.55 feet on said plan) to an iron pin to be set along the southern right-of-way
line of Armitage Way;
Thence along said right-of-way, along a curve to the left, having a radius of 200.00 feet, a delta angle
of 30 degrees 13 minutes 55 seconds, an arc length of 1 05.53 feet, and a chord bearing and distance
of North 33 degrees 23 minutes 26 seconds East, 104.31 feet to an iron pin to be set at the dividing
line between Lot 7 and Lot 8, the place ,of BEGINNING,
CONTAINING 0.5862 acres or 25,535 square feet more or less. (Erroneously shown as 25,827 square
feet or 0.5934 acres on said plan).
Subject to a storm water easement (as shown on said plan) and all covenants and agreements of
record.
