STIPULATION AGAINST LIENS

THIS AGREEMENT made the 3rd day of October, 2001, by and between RIDGEVIEW
CUSTOM HOMES, LLC, hereinafter referred to as Contractor, and HERBERT G. WEAVER,
hereinafter referred to as Owner, whereby the former undertook and agreed to erect and construct
a custom built home on that certain lot of ground situate at Lot No. 65, Indian Hills, South
Middleton Township, Cumberland County, Pennsylvania, more fully described in Exhibit "A"
attached hereto and made a part hereof.
NOW THEREFORE, WITNESSETH: That the said Contractor, for and in consideration of
the sum of ($1.00) Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves
and their subcontractors, and all parties acting through or under them, covenant and agree that no
mechanic's liens or claims shall be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise, for, towards, in, or about the
erection and construction of the said buildings on the lot above described, and the said Contractor,
for themselves, their subcontractors and others under them hereby expressly waive and relinquish
the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any
of them, and agree that this instrument, waiving the right oflien, shall be an independent covenant

ALL that certain tract of land situate in South Middleton Township, Cumberland County,
Pennsylvania, and more particularly identified as follows, LOT NO. 65 on the Final Subdivision
Plan of INDIAN HILLS - SECTION II, recorded in the Office of the Recorder of Deeds in and for
Cumberland County, Pennsylvania, in Plan Book 77, Page 72, et seq., bounded and described as
follows:
BEGINNING at a point along the southern right of way line of Evergreen Drive (50 feet right of
way) at the dividing line between Lot No. 64 and Lot No. 65 of the afore-mentioned subdivision
plan; thence along said southern right of way line of Evergreen Drive South 88 degrees 58 minutes
00 seconds West a distance of 1 07.59 feet to a point; thence South 0 1 degrees 02 minutes 00 seconds
East a distance of 150.00 feet to a point; thence North 88 degrees 58 minutes 00 seconds East a
distance of 107.59 feet to a point at the dividing line between Lot No. 64 and Lot No. 65 of the
afore-mentioned subdivision plan; thence along said dividing line North 01 degrees 02 minutes 00
seconds East a distance of150.00 feet to a point at the dividing line between Lot No. 64 and Lot No.
65 and the southern right of way line of Evergreen Drive (50 feet right of way), the point and place
of BEGINNING.
CONTAINING 16,138.50 square feet.
LOT No. 65 is subject to all associated rights and provisions of a 30 feet wide Storm Drainage
Easement
LOT No. 65 is subject to all applicable notations and conditions set forth by final subdivision plan
approval ofIndian Hills, Section No, II.
