AND NOW comes the Appellant, Shane T. Gordon, by and through his attorney, Patrick F.
Lauer, Jr., Esquire, and respectfully avers the following:
1. Appellant resides at 120 Evergreen Lane, Pahnyra, Dauphin County, Pennsylvania 17078.
2. The Appellant received a notice dated October 26, 2001, that as a result ofhis alleged violation on
June 16, 2001 of Pennsylvania Vehicle Code Section 6308(A), offenses related to alcohol, his driving
privileges were being suspended for a period of one year, effective suspension date November 30,
2001, at 12:01 a.m A true and correct copy of the Notice is attached as Exlnbit "A".
3. The Appellant tiled a Summary Criminal Conviction Appeal in Dauphin County Court
regarding an incident that occurred on June 29, 2001 in which he was convicted before District Justice
Joseph S. Lindsay on August 6, 2001.
4. Dauphin County Court scheduled a Summary Criminal Conviction Appeal Hearing for
December 20,2001 at 8:30 a.m
5. The Appellant submits that there has not been a final disposition of his appeal and that he
, I would be unduly prejudiced if the suspension were to be imposed at this time.

6. There was insufficient evidence to convict the Appellant.
7. The period of suspension is incorrect and should only be for ninety day, not one year.

YOU MAY NOT RETAIN YOUR DRIVER'S LICENSE FOR IDENTIFICATION
PURPOSES. However, yoU may applY for and obtain a photo
identification card at any Driver License Center for a cost
of 9.00. You must present two (2) forms of proper
identification (e.g., birth certificate, valid U.S.
passport, marriage certificate, etc.) in order to obtain
your photo identification card.

steps to acknowledge this suspension.
