AND NOW, this (/...~ay of March 2002, comes Plaintiff, SALVATORE M. CRIBARI, by and
through his attorneys, Johnson, Duffie, Stewart & Weidner, and files these Objections to Sheriffs
Determination, and in support thereof avers as follows:
1. Plaintiff is an execution creditor of Defendant in the above-captioned case.
2. On or about February 15, 2002, Claimant filed an Adverse Property Claim, a true and correct
copy of which is attached hereto as Exhibit "A".
3. On March 1, 2002, the sheriff made a determination in favor of Claimant, a copy of which is
attached hereto as Exhibit "B".
4. The Sheriff's determination was rnade without any factual hearing.
5. The Sheriff failed to take into account well-established authority which places the burden of
proof upon the Claimant. Alloway v. Martin, 434 Pa. Super. 518, 644 A.2d 201, 203 (1994); and 13
Standard Pa. Practice 2d 28, 973.45 (1996).

6. The Sheriff's determination in favor of Claimant (in violation of appellate authority of this
Commonwealth) constitutes a deprivation of Plaintiff's legitimate property interest in the levied upon property
and a violation of Plaintiff's due process rights.
7. The Sheriff's determination gives me to a cause of action under 42 U.S.C. 31983.
WHEREFORE, Plaintiff respectfully requests that this Honorable Court enter an Order reversing the
Sheriff's determination and finding that the personal property in question belongs to the Defendant.
