Kabusk, Esquire, respectfully represents as follows: I. By official notice dated October 24,2001 the Department of Transportation, Bureau of Driver Licensing, mailed to Roderick A. Keck, O.L.N. 23133035, a notice informing him that as a result of his August 21,2001 conviction of violating Section 3731 of the Vehicle Code, relating to Driving Under the Influence, on February 4,2001 he was designated as a Habitual Offender because it was his third major violation within a five year period and that his driving privilege was being revoked for a period of five years, effective October 24,2001. 2. The official notice dated October 24, 2001 notified the petitioner that as a result of his conviction for driving under the influence he was required by law to have all vehicle(s) owned by him equipped with an approved ignition interlock system before his driving privilege could be restored. An individual who has been convicted on or after September 30, 2000 of a violation of Section 3731 of the Vehic1e Code, relating to Driving Under the Influence, and has previously been convicted of a violation of Section 3731 of the Vehic1e Code, relating to Driving Under the Influence, must have an Ignition Interlock installed in all their vehicles in order to have their operating privilege restored. 42 Pa. C.S. 7002. S. The petitioner was: (a) convicted on August 16, 1999 ofa violation on June30, 1999 of Section 3731 of the Vehic1e Code, related to Driving Under the Influence of Alcohol or a Controlled Substance, and (b) convicted on January 19, 2000 ofa violation on March 20,1999 of Section 3731 of the Vehicle Code, related to Driving Under the Influence of Alcohol or a Controlled Substance. 6. Mr. Keck filed an appeal of the above mentioned matter on or about November 26, 2001 in the Court of Common Pleas of Cumberland County. 7. The petitioner alleges in his petition that the Ignition Interlock System Requirement is unconstitutional. 8. The petitioner alleges in his petition that the Court at sentencing did not order the petitioner subject to the approved Ignition Interlock System requirement. 9. This Honorable Court has no jurisdiction to hear an appeal of the Department's notice to the petitioner that he will be subject to the Ignition Interlock requirement. 10. The Court of Common Pleas has jurisdiction pursuant to section 42 Pa. C.S. 933 the hear appeals from final orders from the pepartment of Transportation in the following cases: '! -~ '. ,<. - ^"~""" ';:.,' ~~t&~~;".._,; Section 1377 (relating to judicial review); Section 1550 (relating to judicial review); Section 4724(b) (relating to judicial review); Section 7303(b) (relating to judicial review); and Section 7503(b) (relating to judicial review). II. An appeal of the requirement for an Ignition Interlock requirement is not one of the matters which the Court of Common Pleas has jurisdiction pursuant to 42 Pa. C.S. 933. 12. The provisions relating to Ignition Interlock do not provide for an appeal to the Court of Common Pleas, therefore, there is no appeal of the requirement for Ignition Interlock to the Court of Common Pleas. See Brennan's Case, 344 Pa. 209, 25 A.2d 155 (1942). 13. Where no appeal is specified by statute the Pennsylvania Constitution and the Administrative Agency Law provide for an appeal. See Department of Transportation v. Hosek, 3 Pa. Commw. 580,284 A.2d 524 (1971). 14. When no appeal is specified by statute from a Department detennination the appeal properly should be with the Department not with the Court of Common Pleas. See Department of Transportation, Bureau of Traffic Safety v. Yarbinitz, 97 Pa. Commw. 169,508 A.2d 641 (1986). 15. This Honorable Court has no jurisdiction to hear this appeal from the requirement for Ignition Interlock and any such appeal lies with the Department in its Administrative Docket. 16. The Department acknowledges that the Commonwealth Court on January 11, 2002 filed the Opinion in the case of Schneider v. Department of Transportation, Bureau of Driver Licensing, _ A.2d _ (Pa. Cmwlth. 2002), No. 1513 C.D. 2001, however, the Department's position is that the case was decided incorrectly and it is the understanding of the undersigned that the Department will be seeking further review. 17.
