HomeMy WebLinkAbout03-2537 THiS AGREEMENT made the ~_ day of May, 2003, by and betweenj~&A Custom Built Homes, Inc., a Pennsylv-ania Corporation, hereinafter referred to as Contractor, ~/ AND Gerald L. Crispino/and Diane J. Crispino, Husband and Wife, hereinafter referred to as Owner, whereby the former undertook and agreed to erect and construct a single family detached residence on that certain lot of ground situate in South Middleton Township, Cumberland County, Pennsylvania, known and numbered as Lot No.: 73 on the Final Subdivision Plan, Forgedale Crossing - Section Number 3, recorded in Cumberland County Plan Book 85, page 92 and as more part[culad¥ set forth and described on Exhibit A attached hereto and made part hereof. Now therefore, this Agreement witnesseth: That the said Contractor, for and in consideration of the sum of One Dollar ($1.00) to Contractor in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves and their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic' s liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described, and the said Contractor, for themselves, their subcontractors and others under them hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of them and agree that this instrument, waiving the right of lien, shall be an independent covenant. Cnspmo ALL THAT CERTAIN tract of land situated in the South Middleton Township, Cumberland County, Pennsylvania being Lot No 73; as shown on a Final Subdivision Plan, Forgedale Crossing ' Section Number 3, dated September 15, 2000, prepared by John K, BJxler, III, R. S,,i of Carlisle, Pennsylvania, in Plan Book 85, Page 92, being bounded and described as follows: BEGINNING at a point, said point being located on the northern dedicated right of way line of Coventry Drive and located at the common property corner between Lot No 74 and Lot No, 73 as depicted on the aforementioned plan; thence along Lot No 74, North 03 degrees 17 minutes 08 seconds West, a distance of 150,00 feet to a point located on the section line between Forgedale Crossing, Section 'Number 3 and Forgedale Crossing, Section Number 2B; thence along said section line and Lot Nos. 57 and 58 of Forgedale Crossing, Section 2B, North 86 degrees 42 minutes 52 seconds East, a distance of 100.00 feet to a point located at the common property comer between Lot No, 73 and Lot No, 72; thence along Lot No. 72, South 03 degrees 17 minutes 08 seconds East, a distance of 150 00 feet to a point located on the northern dedicated right of way line of Coventry Drive; thence along the northern dedicated right of way line of Coventry Drive. South 86 degrees 42 minutes 52 seconds West, a distance of 100 00 feet to the point of BEGINNI1NG. Being the same premises which S&A Custom Built Homes, Inc., a Pennsylvania corporation, by its deed dated May ?/~, 2003 and to be recorded contemporaneously herewith in the Cumberland County Recorder of Deeds office granted and conveyed unto Gerald L. Crispino, Jr., and Diane J. Crispino, husband and wife~, the Mortgagors herein. Exhibit "A"
