Defendant shall not abuse, harass, stalk or threaten any of the above persons in any place where they might be found. 2. Defendant is excluded from the residence at 208 Spring Lane, Enola, East Pennsboro Township, Cumberland County, Pennsylvania, and 3201 N. 2nd Street, Harrisburg, Dauphin County, Pennsylvania or any other permanent or temporary residence where Plaintiff or any other person protected under this Order may live. Plaintiff's name is William H. Martin, Jr. 2. I am filing this Petition on behalf of myself. 3. Names of all persons, including Plaintiff and minor children, who seek protection from abuse: William H. Martin, Jr., Plaintiff 4. Plaintiff's address is 208 Spring Lane, Eno1a, Pennsylvania 17025. 5. Defendant's address is 1250 Oyster Mill Road, Camp Hill, Pennsylvania 17011. 6. Defendant's date of birth is December 29, 1958. Defendant's social security number is unknown. Defendant's place of employment is Konico in Harrisburg, Pennsylvania. Defendant is over the age of seventeen (17) years old. 7. Plaintiff and Defendant were married on March 1, 1980 and remain married at this time. The Plaintiff filed for divorce in Cumberland County on October 24,2001 at No. 01- 6077 Civil Term. 8. The Defendant was previously charged with two counts of stalking relating to incidents involving Plaintiff and his girlfriend. It is unknown whether or not the Defendant is currently on probation as a result ofthose charges. 9. Plaintiff and Defendant are parents of the following minor child: Wesley David Martin, born November 29,1985. Custody is shared, however, there is no current order regarding custody of the minor child. No other minor children presently live with the Plaintiff. Defendant filed a protection from abuse petition docketed at No. 01-6462 which has been scheduled for a hearing on December 3, 2001 at 3:30 p.m. , ii I! 11. The facts of the most recent incident of abuse are as follows: Sporadically .' . throughout the past two years, Defendant has attempted to cause and has intentionally, knowingly or recklessly caused bodily injury and serious bodily harm to the Plaintiff and by physical menace , has placed the Plaintiff in fear of inuninent serious bodily injury. This has included but is not , limited to the following specific incidents of abuse: I, i' (a) Defendant has attacked Plaintiff with a knife; (b) Defendant has physically attacked Plaintiff at various times throughout the past two years. (c) Defendant has removed a handgun from Plaintiffs apartment. (d) Defendant has broken the windshield on Plaintiffs vehicle. (e) Defendant has flattened Plaintiffs tires. (f) Defendant has broken windows at Plaintiffs girlfriend's house. (g) Defendant frequently follows Plaintiff while he is driving and has attempted to force Plaintiff off the roadway. 12. Defendant has used and/or threatened to use against the Plaintiff the following weapons: a knife and a gun. 13. Plaintiff lives within the jurisdiction of East Pennsboro Township Police Department, Cumberland County, Pennsylvania. 14. There is an immediate and present danger of further abuse from the Defendant. Prohibit Defendant from having any contact with Plaintiffs relatives and Plaintiffs children listed in this Petition except as the court may find necessary with respect to partial custody and/or visitation with the minor child; D. Order Defendant to temporarily turn over weapons to the Sheriff of this county and prohibit Defendant from transferring, acquiring or possessing any such weapons for the duration of the Order; E. Order Defendant to pay the costs of this action, including filing and service fees; F. Order Defendant to pay Plaintiffs reasonable attorneys fees; G. Grant other such relief as the court deems appropriate; H. Order the police or other law enforcement agency to serve the Defendant with a copy of this Petition and any order issued in the order for hearing.
