COMPLAINT IN CIVIL ACTION 1. Plaintiff, BRUCE SUPPLY CORPORATION (hereinafter "Plaintiff') a corporation with offices at 300 Smith Street, Keasbey, New Jersey 08832. 2. Defendant, NOVCO SUPPLY, INC. (hereinafter "Defendant") is a corporation organized and doing business under the laws of the Commonwealth of Pennsylvania with its last known address at 629 W. Main Street, Mechanicsburg, Cumberland County, Pennsylvania 17055. 3. On or about October 8, 2001, Defendant submitted a Credit Application (hereinafter "Application") to Plaintiff seeking to establish or to maintain the ability to purchase Plaintiffs goods and materials on credit. A true and correct copy of the Application is attached hereto, marked as Exhibit "1". 4. Between on or about October 15, 2001 and November 15, 2001, Plaintiff, at the request of Defendant, sold and delivered certain goods and rendered services at the times and in the amounts fully set forth on Plaintiffs invoices, a true and correct copy of which are attached hereto, made a part hereof and marked as Exhibits "2" through "8". 5. The prices charged for the goods and materials were the fair, reasonable and market prices of the same at the time they were sold and delivered and further, are the prices that the Defendant agreed to pay. Plaintiff has demanded payment of the balance due as set forth on Plaintiff's statement of Defendant's account, a true and correct copy of which is attached hereto, made a part hereof and marked as Exhibit "9" pages 1 and 2 of $3,217.35 including accrued service charges through February 28, 2003, but the Defendant has failed and refused to pay. 7. Exhibit "9" references all of the debits and credits that were made to the account including payments that had been made and applied. The remaining balance is the balance that is due. 8. In addition to the above, Plaintiff demands interest at the legal rate of 6% per annum from an average due date of March 31, 2003. WHEREFORE, Plaintiff demands judgment in its favor and against the Defendant, NOVCO SUPPLY, INC. in the sum of $3,217.35 plus interest at the rate of six percent (6%) per annum from an average due date of March 31, 2003 plus cost.
