Whereas, the PEERLESS INSURANCE COMPANY, located at Keene, N.H., has filed in this
Department a certified copy of its charter and a detailed statement of its Assets and Liabilities,
and otherwise complied with the requirements of Section 661 of the Act of Assembly of the Commonwealth of
Pennsylvania, entitled "An act relating to insurance; amending, revising and consolidating the Law &c.,"
approved the 17th day of May, A.D. 1921, as well as with the requirements of the laws of this Commonwealth
applicable to such company in doing business herein.
Now Therefore, I, M. Diane Koken: Insurance Commissioner of the Commonwealth of Pennsylvania, do
hereby certify, in accordance with Section 1, of the Act of Assembly approved June 29, 1923 and known as act
No. 373 of the Laws of 1923, that the Peerless Insurance Company, of Keene, N.H., is
duly authorized to become and be accepted as sole surety on all bonds, undertakings and obligations required or
permitted by law or the ordinances, rules or regulations of any municipality, board, body, organization, or
public officer.

CUSTODY STIPULATION & AGREEMENT
THIS STIPULATION AND AGREEMENT entered into the day and year hereinafter set
forth, by and between KAREN LINDSEY, (hereinafter referred to as "Mother") and MITCHELL
LINDSEY, (hereinafter referred to as "Father").
WHEREAS, the parties are the natural parents of one child, namely Cameron N. Lindsey,
bom August 25, 1994, (hereinafter referred to as "Child"); and
WHEREAS, the parties live separate and apart, and wish to enter into a comprehensive
stipulation and agreement relative to physical and legal custody of their child.
NOW THEREFORE, in consideration of mutual covenants, promises and agreements as
hereinafter set forth, the parties stipulate and agree as follows:
Father and Mother shall have shared legal custody of Child. Each parent shall have
an equal right, to be exercised jointly with the other parent, to make all non-
emergency decisions affecting the Child's general well-being including, but not
limited to, all decisions regarding his health, education and religion.
2. Mother shall have primary physical custody of Child.
Father shall have the following periods of partial physical custody of the Child. This
schedule is based upon a two-week custody schedule:
During the months that Father has Mondays and Tuesdays off:
Week One: Father will have a ]period of custody from 7:00 p.m.
on Sunday until 7:00 p.m. on Tuesday. Father will pick up child at
Mother's house on Sunday and Mother will pick up child at
Father's house on Tuesday.
II.)
Week Two: Father will have a period of custody from 7:00 p.m.
on Friday until 7:00 p.m. on Tuesday. Father will pick up the child
at Mother's house on Friday and Mother will pick up the child at
Father's house on Tuesday.
During the months that Father has Thursdays and Fridays off:
I.)
Week One: Father will have a period of custody from 7:00 p.m.
on Wednesday until 4:00 p.m. on Friday. Father will pick up the
child at Mother's house on Wednesday and Mother will pick up
the child at Father's house on Friday.
II.)
Week Two: Father will have a period of custody from 7:00 p.m.
Wednesday until 7:00 p.m. on Sunday. Father will pick up the
child at Mother's house on Wednesday and Mother will pick up
the child at Father's house on Sunday.
4. The parties acknowledge that:
a.)
Father's schedule changes three (3) times per year and it is hereby stipulated
that Father shall provide the next year's schedule as it is made available to
him.
b.)
With regard to schedule changes throughout the year, Father will provide no
less than thirty (30) days notice prior to a schedule change.
The non-custodial parent shall have no less than three (3) hours of physical custody
on the Child's birthday. In the event both parties have the day off work, it
contemplated that the child's birthday shall be divided equally in periods of time
from 8:00 a.m. to 2:00 p.m. and 2:00 p.m. until 8:00 p.m.
6. The parties shall alternate custody of the child on New Years Eve and New Years Day.
These periods of custody shall run from 7:00 p.m. on New Years Eve until 7:00 p.m. on
New Years Day. Mother shall have custody of the child over the New Years holiday in
2004 and all even numbered years thereafter and Father shall have custody of the child
over the New Years holiday in 2005 and all odd numbered years thereafter.
7. Each party shall be entitled to two (2) non-consecutive weeks of partial physical custody
for vacation during the year provided they give the other parent 30 days prior
notification.
If either parent removes Child overnight from the jurisdiction of Cumberland County,
Pennsylvania, they must notify the other parent and provide an address and telephone
number where Child can be reached.
Mother shall have physical custody of Child on Mother's Day from 9:00 a.m. Until 7:00
p.m. Father shall have physical custody of Child on Father's Day from 9:00 a.m. Until
7:00 p.m.
10. The parties shall alternate the following holidays: Labor Day, Memorial Day and July 4th
fi'om 9:00 a.m. until 9:00 p.m. Father shall have the Labor Day holiday in 2004.
11. The Thanksgiving holiday shall nm from the Wednesday before the holiday after school
until the Friday after the holiday at 7:00 p.m. The parties shall alternate the
Thanksgiving holiday. Father shall have physical custody during this holiday in 2004
and all even numbered years thereafter. Mother shall have physical custody during this
holiday in 2005 and all odd numbered years thereafter.
12. The Christmas holiday shall be split such that Mother shall always have physical custody
of the Child on Christmas Eve until 10:00 p.m. and Father shall always have physical
custody of the Child from Christmas Eve at 10:00 p.m. until Christmas Day at 2:00 p.m.
The remainder of the Christmas holiday break from school shall revert to the schedule
listed in paragraph 3 above.
13. The holiday schedule shall take precedence over the regular schedule herein.
14. Transportation shall be shared by the parties such that the receiving party shall pick up
the Child at the other parent's home.
15. Neither party shall consume alcohol to the point of intoxication while the Child is in their
physical custody.
16. The non-custodial parent shall be entitled to liberal telephone contact with the Child
while in the care of the other parent.
17. The parties shall keep each other advised in the event of serious illness or medical
emergency conceming the child and shall further take arty necessary steps to ensure that
the health and well-being of the child is protected. During such illness or medical
emergency, both parties shall have the right to visit the child as often as he or she desires
consistent with the proper medical care of the child.
18. Any modification or waiver of any of the provisions of llhis Agreement on a permanent
basis shall be effective only if made in writing, and only if executed with the same
formality as this Stipulation and Agreement.
19. The parties acknowledge that they may vary any and all terms of this agreement so long
as they mutually agree to the variation. In the absence of mutuaI agreement, the terms of
this agreement shall be controlling.
20. The parties desire that this Stipulation and Agreement be entered as an Order of Court
and that it supersede all prior Custody Orders, making them null and void.
