At all times relevant hereto, the defendant was the holder of a credit card, which at the request of the defendant was issued to the defendant by the plaintiff under the terms of which the plaintiff agreed to extend to defendant the use of plaintiff's credit facilities. 2. Defendant accepted and used the aforesaid credit card so issued and by so doing agreed to perform the terms and conditions prescribed by the plaintiff for the use of said credit card. 3. The defendant received and accepted goods and merchandise and/or accepted services or cash advances through the use of the credit card issued by the Plaintiff. A true and correct copy of an Affidavit of Account is attached hereto as Exhibit "A". 4. All the credits to which the defendant is entitled have been applied and there remains a balance due in the amount of $3,297.27. 5. Plaintiff has made demand upon the defendant for payment of the balance due of $3,297.27 but the defendant has failed and refused and still refuses to pay the same or any part thereof. 6. Defendant's last payment on account was made on May 12, 2003. WHEREFORE, plaintiff claims of the defendant the sum of $3,297.27 plus applicable costs, interest and attorney's fees. Hippensteel, Prv Se, hereby responds to Plaintiff, Discover Bank's Complaint a,; follows, but preliminarily objects to Plainti#~'s improper Verificatio~r: 1. The form of the corresponding paragraph of PlaintiBfs Complaint is objected to in that it fails to conform to the Pennsylvania Rules of Civil Procedure in that it fails to li~xrit itself to one allegafion of fact that can be admitted ox denied. Byway of further response: Defendant admits that Defendant requested a credit account with Plaintiff; Defendant admits that Plaintiff extended Defendant credit; Defendant admits that there are applicable terms and conditions on the account despite that fact that Plaintiff ht~s failed to attach the operative written docu~ouent in direct contravention to the P~~rrnsylvania Rules of Civil Procedure. If any other allegations axe to be read from th.e corresponding pazagraph of Plaintiff's Complaitztt, they ace denied as wiascertainable by Defendant. 2. The form of the corresponding paragraph of Plaintiff s Complaint is objected to in that it fails to conform to the Pennsylvania Rules of Civil Procedure in that it fails to lunit itself to one allegation of fact that can be admitted or denied. By way of further response, Defendant adpoits that Defendant accepted and used a credit card issued by Plaintiff. The remainder of the corresponding paragraph of Plaintiff s Complaint constitutes a conclusion of law to which no responsive pleading is required and they are therefore denied. By way of further response, the corresponding averment of Plaintiff s Complaint seems to suggest the breach of a contract, but the operative document is not attached to PlaintifFs Co~oaplaint in direct contravention to the P~~nusylvania Rules of Civil Procedwre. 3. By way of further response, the corresponding averment of Plaintiff s Complaint seems to suggest the breach of a contract, but the operative document is mot attached to Plaintiff's Complaint inn direct contravention to the Pennsylvania Rules of Civil Procedure. 5. Byway of further response, it is admitted that Plaintiff has made demand of Defendant to pay the alleged amount. The amount alleged is denied as a conclusion of law to which no responsive pleading is required and they are therefore denied in that it relies on the tenths of a contract, but the operative document is not attached to Plaintii~s G~mplaint in direct contravention to the Pennsylvanita Ztules of Civil Procedure. It is admitted that Defendant has failed to make some payments on the account. It is sF~ecxfically demoted that Defendant has ever refused to pay any part of the account. 6. Admitted.
