Hughes, husband and wife, promise to pay to the order of William H. Hooke, Jr., the sum of Twenty-five Thousand and 00/100 ($25,000.00) Dollars without defalcation, with interest accruing at six (6%) percent per annum to be paid in full eight (8) months from the date of this Note or upon sale of Lots 2, 3 and 4 of the Scott S. Hench Subdivision Plan, in North Middleton Township, Cumberland County, PA, whichever occurs first. And to secure the payment of said amount, I/We do hereby empower and authorize, irrevocably, any attorney of any Court of Record to appear for me in such Court, in term time or vacation, at any time hereafter, and confess judgment, without process, in favor of the holder of this Note, for such amount as may appear to be unpaid thereon, whether due or not together with costs, and to waive and release all errors which may intervene in such proceedings and to consent to immediate execution upon such judgment, with five (5%) percent attorney's fees charged; hereby ratifying and confirming all that my said attorney may do by virtue hereof. ALL THAT CERTAIN tract of land situated in North Middleton Township, Cumberland County, Pennsylvania, being Lot No. 4, as shown on a Plan entitled Final Subdivision Plan for Scott S. Hench dated January 6, 2006 by Marshall Engineering, of Carlisle, Pennsylvania, and recorded in Cumberland County Plan Book 93, Page 8, being bounded and described as follows: BEGINNING at a rebar set on the eastern side of Sterrett's Gap Avenue (T-504) at the dividing line between Lot 1 and a proposed private drive as shown-on the above referenced plan; thence by the dividing line North 86 degrees 51 minutes 00 seconds East 255.67 feet to a rebar set; thence by the dividing line between Lots 3 and 4 as shown on the above reference plan North 06 degrees 30 minutes 00 seconds East 85.77 feet to a rebar set; thence by the same South 83 degrees 45 minutes 37 seconds East 148.70 feet to a rebar set; thence by lands now or formerly of Colella Family Partners and Colella Family Trust South 06 degrees 30 minutes 00 seconds West 112.04 feet to a point; thence by lands now or formerly of Plaza K. CONTAINING 0.7142 acres, more or less. The private right of way shown on the aforementioned subdivisions plan shall remain a private right and that the purchasers or owners of said lot(s), their heirs, successors and assigns, shall be responsible for the construction, maintenance, repair and snow and ice removal of said private right of way, which restrictions and/or conditions shall be deemed to be covenants running with the land. North Middleton Township shall not now, nor at any time in the future have responsibility for the construction, maintenance, repair or snow and ice removal of any private right of way shown on this plan, and, no further subdivision of any lot shown on this plan or the tract from which such lots have been subdivided shall be allowed, unless and until such right of way is constructed or improved to current township standards as a local street and offered for dedication in accordance with the requirements of the North Middleton Township Subdivision and Land Development Ordinance. SUBJECT to a Declaration of Joint Road Maintenance Responsibility and Shared Driveway for the Scott S. Hench Subdivision Plan as set forth in Misc. Book 729, Page 4281. Further, subject to a Joint Road Maintenance Agreement as set forth in Misc. Book 729, Page 4508. The undersigned hereby certifies that the debt secured by the above-mentioned Judgment has been fully paid or otherwise discharged, and upon the recording hereof, said Judgment shall be, and is, hereby fully and forever satisfied and discharged.
