. S. The Plaintiff, ut Defendant's specillllnstance and request, sold to Defendant or
Thrlny Payless, Inc. certain goods and merchundise in the amount and for the prices set
forth in its invoices to Defendunt, taken from Plaintiff's hooks und records, a true and
correct copy of which is attached hereto, made a part hereof and marked Exhibit "A ".
6. The prices charged Illr the aforesuid items are just and reasonable and are
those which Defendant promised to pay Plaintiff.
7. Defendant or Thrifty Payless, Inc. received and accepted the goods described
in the invoices referred to above, and a tolal principal amount which became due as a result
thereof, after allowunce for all proper credits for payments and/or returned merchandise, if
any, was $11,153.11.
8. By virtue of its purchase of Thrifty Payless, Inc. Defendant is indebted to
Plaintiff for those purchases made by Thrifty Payless, Inc.
9. Plaintiff is ulso entitled to receive interest on the above amount determined by
applying the statutory interest rate of 6.00% ~_anmilll to the past due balance. As of
October 21, 1998 the total amount of interest due to Plaintiff is $485.85.
10. Plaintiff is entitled to have the 6.00% interest charge continue to accrue as set
forth above, from October 21, 1998 on down to the date of judgment in this matter.
J I. The Plaintiff has made demand against the Defendant for the aforesaid sum,
but Defendant failed or refused to pay the same or any part thereof.
WHEREFORE, Plaintiff demands judgment against the Defendant for $11,638.96
together with the continually uccruing interest charge at the statutory rate of 6.00% I!!lf
annum from October 21, 1998, and cost of suit.
COUNT II
(Alternativc to Count I - Unjust Enrichmcnt)
12. Plaintiff Incorporates the allegations of every paragraph enumerated above of
this Complaint as if said parlllgraphs were fidly set forth here atlcngth.
13. The goods, wares, merchandise, and/or services, described in the exhibits
attached hereto were purchased by the Defendant, and the Defendant received and accepted
the benefit of such goods, wares, merchandise, and/or services provided by the Plaintiff.
14. At all times material hereto, Dcfendant was awarc that Plaintiff was providing
the aforesaid goods, wares, mcrchandise, and/or services to Defendant, and that Plaintiff
expected to be paid for such.
15. At all times matcrial hcreto, Defendant, with the aforesaid knowledgc,
permillcd Plaintiff to provide and/or deliver said goods, wares, merchandise, and/or services,
and to incur damages.
16. At all limes material hereto, the Defendant was unjustly enrichcd by rctaining
the bencfit of receiving said goods, wares, mcrchandise, and/or serviccs wilhout paying
Plaintiff fair and reasonable compensation.
17. By reason of the aforesaid unjust enrichment of Defendant at Plaintiff's
expense, an implied contract exists hetween the Plaintiff and the Defendant, and the
Defendant is llbligated to pay Plaintiff the UUlIntum mel1lil value of the vlllue of the goods,
wares, merchllndise, and/or services .described in the exhibits aUlIched hereto, In the amount
of $11,153.11.
