TO THE HONORABLE, THE JUDGES OF SAID COURT:
AND NOW COMES, Defendant, MICHAEL DENNIS A VERY, by and through his counsel,
Lisa Marie Coyne, Esquire, and files this Petition for Modification of Existing Custody Order, and in
support thereof, avers as follows:
I. Defendant, Michael Dennis Avery, currently resides at 2506 Mill Road, Mechanicsburg,
Cumberland County, Pennsylvania.
2. Plaintiff, Mayling Bittner Avery, currently resides a.t 906 N. Pitt Street, Rear, Carlisle,
Cumberland County, Pennsylvania.
3. The parties are the parents of one minor child; LORRAINE ELLEN AVERY, born
October 20,1994.
4. On April 18,2002, the Honorable Edgar B. Bayley entered an Order of Court regarding
custody of the said child. A copy of said order is attached hereto, made a part hereof and marked Exhibit
"A".
5. Defendant is disabled as a result of a motor vehicle accident and resides full-time with
his parents at 2506 Mill Road, Mechanicsburg.
6. Defendant requests modification of the existing custody order so as to provide Defendant
more time with his minor daughter who, when not in school during the summer months, is in daycare.
7. Defendant proposes altemating weeks of custody during the summer months and
increased periods of custody during the school year.
8. A modification of this existing custody order will result in the minor child spending
increased quality time with each parent especially in light of the fact that Defendant is unable to work as
a result of the motor vehicle accident.
WHEREFORE, Defendant respectfully requests that this Honorable Court modify the existing
custody order in such a manner as to increase Defendant's periods of partial custody of the minor child
and in such other manner which is in the best interest of the child.

the within Stipulation and Agreement between MAYLING BITTNER, F/KIA MAYLING
A VERY, hereinafter "Mother" and MICHAEL DENNIS A Vl~RY, hereinafter "Father",
regarding LORRAINE ELLEN A VERY, hereinafter "Child", born October 20, ]994, it is
hereby ordered as follows:
1. The parties shall have shared legal custody of the Child, meaning that they shall
share the legal right to make major decisions affecting the best interest of the Child and all of the
major matters related to the Child, including but not limited to, medical, religious and educational
decisions.
2. Mother shall have primary custody of the Child.
3. Father shall have partial physical custody and visitation of the Child as follows:
(a) Alternating weekends from after school on Friday through Sunday evening at
8:30 PM..
(b) Beginning the week of September 4, 2001, Tuesday and Thursday evenings of
the week before Father's alternating weekend and alternating weeks thereafter, from after
school until 8:30 PM, Father will give Mother twenty-four (24) hours notice if he is not
going to exercise the evening visitation.

(c) Holidays shall be defined as New Year's Day, President's Day, Easter,
Memorial Day, Independence Day, Labor Day and Thanksgiving. The holiday
visitation will run from 8:30 PM the night before until 8:30 PM the day of the
holiday.
(i) In odd numbered years Plaintiff will have the Child for President's
Day, Memorial Day, Independence Day, and Thanksgiving; in even number years,
Plaintiff will have the Child for New Year's Day, Easter, and Labor Day.
(ii) Christmas shall be defined as Christmas Eve at Noon on December
24 through Noon on Christmas Day and Christmas Day shall be defined as Noon
on December 25 through Noon on December 26. Plaintiffwil1 have the Child on
Christmas Eve in even numbered years and Christmas Day in odd numbered years,
Defendant will have the Child on Christmas Eve in odd numbered years and
Christmas Day in even numbered years.
(d) During summer vacation, primary custody will remain with the Mother,
with the Father continuing to have his alternating weeknight and weekend schedule
of visitation. Each parent will be granted two we"ks of vacation, which may be
consecutive, upon providing the other parent at least thirtY (30) days notice in
advance of the anticipated vacation date.
(e) School holidays in excess of two days, including the Christmas holiday, will
be split as evenly as reasonably possible.
4. Mother and Father agree that although the Child is attending public school this
year, she will be re-enrolled and will attend St. Patrick's School in Carlisle, Pennsylvania
beginning the Fall of2002. Father is to have complete access to school records and is pennitted to

pick up the child from school.
5, Neither parent shall do anything which may estrange Child from the other parent
or injure the opinion of the Child as to the other parent, or which would hamper the free and
natural development of the Child's love and affection for the other parent.
6, The failure of either party to insist on strict performance of the provisions of this
stipulation and agreement shall not be construed as a waiver of any subsequent default of the
same or similar provision.
7. Father agrees to submit to random urine drug tests at the Omega Medical
Laboratories at the Camp Hill Shopping Mall, the costs of which will be evenly split by the
parties,. Father will establish such account with Omega as is necessary for billing purposes. Each
party will deposit $100,00 into the account when it is established. Father will sign such releases as
are required to pennit Mother and her attorney full and complete access to all test results upon
request, Father will be notified 24-hours in advance of testing date and to abide by any time table
set by the testing facility. Father agrees that in the event he fails to submit to any test required by
. the testing facility, without reasonable cause the test may be deemed to have been positive for
cocaine or crack cocaine and all visitation and partial physical custody with the Child shall
immediately tenninate pending further Order of the Court.

CONCILIATION CONFERENCE SUMMARY REPORT
IN ACCORDANCE WITH THE CUMBERLAND COUNTY CIVIL RULE OF
PROCEDURE 1915.3-8(b), the undersigned Custody Conciliator submits the following
report:
1. The pertinent information pertaining to the child wlilo is the subject of this litigation
is as follows:
Lorraine Ellen Avery, born October 20, 1994.
2. A Conciliation Conference was held on July 27, 200S, with the following individuals
in attendance:
The mother, MayIing Bittner Avery, with her counsel, Luther E. Milspaw, Jr.,
Esquire, and the father, Michael Dennis Avery, with his counsel, Lisa Marie Coyne,
Esquire.
3. Father is seeking expansion of an existing CustodJ' Order which has been in place
since April 18, 2002. Father is seeking more periods of temporary custody with the
minor child. Mother is unwilling to agree to a change. The Conciliator feels that the
status quo has been in place for such a period of time that the Conciliator is not
inclined to recommend any modification of the Olrder until the Court has had an
opportuuity to take testimony at a hearing. Accordingly, a hearing will be scheduled.
However, another issue arose at the Conciliation Conference with respect to
transportation of exchange of Custody and the Conciliator has recommended in the
attached Order that that issue be addressed to allow father's mother to facilitate
exchange of custody.
