AGREEM~t:IT TO RESOLVE EXCEPTIONS TO MASTER'S REPORT
AND NOW, comes Deneen M. Silvanl (the "Wife") and Mark J, SlIvanl (the
"Husband"), the parties to the above referenced matter and stipulate to the following:
WHEREAS, on or about June 11, 2002, following proceedings held on May 30,
2002, the Honorable E. Robert Elicker, II, the Divorce Master of Cumberland County,
flied a Master's Report and Recommendations of resolution of the economic issues In
the above referenced case (the "Master's Report"); and
WHEREAS, each of the parties has timely filed Exceptions to the Master's
Report; and
WHEREAS, the parties have resolved the Issues raised In their respective
Exceptions to the Master's Report In accordance with the terms and conditions'
contained herein.
NOW, THEREFORE, in consideration of the withdrawal of the respective
Exceptions to the Master's Report, AND INTENDING TO BE LEGALLY BOUND
HEREBY, the parties agree as follows:
1. Husband agrees to execute and deliver to Husband's attorney a special warranty
deed transferring all of his right, title and Interest in and to the real estate situate
,
at 7 Sherwood Drive, Mechanicsburg, Pennsylvania (the "Real Property"), in the
form of deed attached hereto as Exhibit A. Said deed shall be held in escrow by
Husband's allomey, pending confirmallon of the removal of Husband from the
mortgage to and underlying Note obligation on the said Real Property pursuant to
paragraph 2 herein, where upon, the deed shall be delivered to Wife.
2, Wife shall immediately apply for and take all steps necessary to refinance the
mortgage on the Real Property and shall complete the same within ninety (90)
days of the date of this Stipulallon, As part of said refinance, Wife shall payoff in
full all the joint debt assigned to Wife in the Master's Report.
3. In the event that the said refinancing Is not completed within the said ninety (90)
day period set forth In paragraph 2 above, the parties agree to list the house for
sale at a price to be determined by mutual agreement of the parties. In the event
the parties are not9.ble to agree, the listing price shall be that set by an appraisal
determined by an independent MAl appraiser of the parties mutual selection, or If
the parties are not able to agree on an MAl appraiser, by an appraiser seleoted
by the Court of Common Pleas of Cumberland County. The appraisal shall be at
Wife's expense, In the event the Real Property Is sold pursuant to this paragraph
3, the proceeds there from shall be ulled to payoff the aforementioned mortgage,
the joint debt assigned to Wife in the Master's Report and the balance thereof
shall be paid to Wife. Wife shall be solely responsible for all costs and expenses
associated with the sale of the house.

7. Neither party Is a member of the armed forces of the United States or its allies.
8. 'Plalntiff has been advised that counseling Is available and that Plaintiff may bave
the right to request that the court require the parties to participate in counseling.
WHEREFORE, Plaintiff requests the Court to enter a Decree in Divorce.

January 11, 1999.
2. The parties to this action separated on August 25, 1999 and have continued to
live separate and apart for a period of at least two years.

4. I understand that If a claim for alimony, alimony pendente lite, equitable
distribution of marital property, counsel fees, costs or expenses has not been

Memorandum
Wednesday, March 13, 2002
THE MASTER: Present for the Plaintiff,
Deneen M. Silvani, is attorney Stephen Jo Dzuranin, and
present for the Defendant, Mark J. Silvani, is attorney Philip
H. Spare.
The parties were married on February 4, 1989,
and separated August 25, 19990 They are the natural parents
of two minor children. The children see the parents on a
sl~red custody basis, so that each parent has approximately
50% of the time with the children.
A complaint in divorce was filed on January
II, 1999, raising grounds for divorce of irretrievable
breakdown of the marriageo Husband will not consent to the
divorce; therefore, Mr. Dzuranin is going to file an affidavit
under Section 3301(d) of the Domestic Relations Code so that
the divorce can conclude under the no-fault provisions of the
code. The parties have been separated for a period in excess
of two years. The complaint raised economic claims of
equitable distribution, alimony, alimony pendente lite and
counsel fees and costs. Counsel had previously indicated on
January 18, 2002, at a conference that there will be no
testimony with respect to the factor of marital misconduct
on the alimony claim.
Wife is 37 years of age and resides at 7
Sherwood Drive, Mechanicsburg, Pennsylvania 0 She is an office
manager for E.NoTo Facial Plastic Surgery group. She has an
Associates degree in nursing and has a net monthly income in
eltCeSs of $2,9000000 Wife has not raised any heal th issues 0
Husband is 43 years of age and resides at 112
C Vine Street, Shiremanstown, Pennsylvania 0 He has a
Bachelor's degree from Penn State University and is employed
at Tyeo Electronics as a systems analyst. His net monthly
income is in excess of $3,3000000 He pays child support in
the amount of ~;280.00 per montho Neither party is receiving
associated with those 0
There was a question on the value of the
marital residenceo My client will provide statements showing
the current outstanding balance on the mortgage on the marital
residence.
Mr. Silvani will provide an updated statement
on his retirement account.
My client will provide information on her
life insurance policy including the current value and on a
Lincoln Life annuity from her employment with Harrisburg
Hospital prior to 1995.
Information I would like from Mro Silvani
includes confirmation of all payments on marital debt as well
as current balances owing on any marital debt aCc0unts that
have not been paid off to the extent or not already provided.
I would also like Mro Silvani to provide any
information he has on his life insurance policy that he claims
to have cashed in prior to the parties' separation.
To the extent not already received or to be
received shortly by ce,unsel for Mro Silvani, my client will
provide information on the Allfirst account on which she is
listed as a joint owner with her mother 0 This may include an
affidavit from my client's mother stating the source of the
funds, what happened to the funds, and her intent with the
account.
My client will also provide information
concerning payments that she made on mad tal debt
post-separation.
1'0 the extent that Mr. Si.lvani is putting
the personal property at issue, we would ask for verification
on values from himo
Other issues for consideration by the Master
will be Mr. Silvani's inheritance from his mother including
the value and use of that inheritance.
I think that is all I need at this time.
10HB MASTER: Mr. Spare.
MR. SPARE: We will require Mrs. Silvani's
cooperation in the scheduling of an appraisal for the house to
get an updated value on that.
We will require Mrso Silvani's cooperation in
getting access to items of personal property, whether that be
in the marital home or in storage for purposes of having an
appraisal done on items of tangible personal property.
I would like to know as soon as possible
whether the rental value of the home will be an issue in the
Master's hearing; that was brought up as a possibility in some
discussions today and if so, we are going to need to know that
as soon as possible so that we can have an expert give a
rental valueo
I would also like to know whether or not
.
Mrs. Silvani is ~oeking some sort of credit tor payments on
the marital home since separation.
I would like verification of any amounts
that she paid toward reducing marital debto
Mr. Dzuranin mentioned that his client would
be providing information on the value of the Lincoln life
annuity, the Prudential life insurance account, and the
Allfirst Bank account that was jointly owned with Deneen's
mother.
Because the identification of tangible
personal property was a stumbling block on our settlement
negotiations today, I expect that the identification of
marital propert~ may also be an issue at the Master's hearing
because Mr. Silvani received a substantial amount of tangible
personal property as a result of an inheritance received from
his mother, and it is our position that any items of tangible
personal property, and actually any items at all that he
received from his mother's inheritance, are non-marital items
and are not to be divided or considered in the disposition of
this case.
THE MASTER: Are those items in the marital
residence?
MR. SPARE: Some of them.
THE MASTER: When did he receive the items?
MR 0 SPARE: During the marriage.
THE MASTER: But how long ago?
MR. SPARE: I believe his mother passed away
approximately 1998 but I would have to review the file to naH
that down.
'1'1-H!: MASTER: Well, we should have an idea of
what these items are that he is claiming are non-marital and
if they are to be appraised separatelyo They should be on a
list separately and noted so that we can determine whether
they have retained their non-marital nature or whether they
have, because of their use by the couple in the marital
relationship, became marital assets.
Do you have any Understanding on the
percentage of distribution?
MR. SPARE: I believe we have a 50/50 case
here. In our discussion this morning we were talking about. a
settlement in that range but I was told that the other side
may ask for more than that if we go to a Master's hearing.
MR. DZURANIN: That'B right. I think it is
not a 50/50 case. QUI' client should have a greater portion of
it but 1 have not thought about specific figures, primarily
because of the inheritance and may be because of other
factorso
THE MASTER: As I understand it, there is not
a whole lot left from the inheritance, is that correct?
MR. DZURANIN; Right.

THg MAS'I'ERI SO most of that Inheritance has
been spent in the mard/'tge?
MR 0 DZURANIN I No. it has not been spent in
the marriage, actually it was post-separation that it was
spent so he had a majority of it at the tIme they separated.
THE MASTER: Do you agree with that?
MRo SPARBI I agree that a great amount of
that money was spent since separation. It was spent in just
getting by, I'll say. in paying billso So to the extent that
the Master is interested in hearing about how a non-marital
asset was spent over the last two years, I guess. we will get
into that at the Master's hearing 0
MR. DZURANINI Our position is. it does not
matter how it was spent, it was something that he had that; she
didn't. She survived on her income post-separation. including
paying the mortgage and keeping the house up; whereas. his
client needed this extra asset that wasn't available to my
client.
(A discussion was held off the record.)
THE MASTER: What is the situation with
regard to the alimony claim? Is that going to be pursued?
MR. DZURANIN: I can't answer that at this
time.
THE: MASTER: All right 0
MR. SPARE: I would like to know well in

advance of the hearing whether that is going to be pursued.
THE MASTER: All right. We have a hearing
scheduled for Thursday, May 3D, 2002, at 9:00 a.m. Notices
will be sent to counsel and the parties 0
Upon hearing the remarks of counsel, it
appears as if there will be certain appraisals that need to be
accomplished. The party undertaking the appraisal first shall
be obliged to share that appraisal with opposing counsel at
least three weeks prior to the hearing 80 that opposing
counsel can have an opportunity to review the appraisal and
get any other appraisals that that attorney may think are
appropriate to rebut the appraisal that is presented.
Likewise, with regard to the matter involving
the alimony claim of wife, she is to notify, through her
counsel, Mr. Spare as to whether or not she intends to pursue
that claim within two weeks of today's date.
Couhsel should exchange witness lists two
weeks prior to the hearing on May 30. If the witness lists
are not provided or witnesses are not identified, those
witneAses will not be permitted to testify if their name
subsequently appears as a witness on the date of the hearing.
MR. S?ARE: One last thing. I think he made
a counsel f~es claimo I think I also should know within two
weeks whether that is being pursued.
THE MASTER: Mr. Spare has noted that wife

Three vehicles from the marriage are marital property.
1. 1996 Ford Taurus, which Is In the possession of the Plaintiff and has a
current Blue Book value of $2,1700000 As of November 1999, the lien
on this vehicle to Members First Credit Union was approximately
$6,524.00. The current outstanding balance on said loan Is
approximately $2,300.00. Exclusively the Plaintiff has made all
payments on this loan since the date of separation. The vehicle Is tilled
in the name of both partleso
2. 1995 Ford Thunderbird, which is In the possession of the Defendant
and has a current Blue Book value of $3,220.00. This vehicle has a
current lien In favor of First Union Bank with a loan balance as of July
26,2000 of $3,754.000 The Defendant has made all payments on this
loan since the date of separation. This vehicle is tltied in the
Defendant's name
30 Late model pick up truck, which Is currently located near the marital
residence. The value of this vehicle Is unknown, but Is believed to be
minimal. The Plaintiff believes the vehicle Is titled In the Defendant's
name and has no lien against It. The vehlclo Is not currently Inspeoted
and Is not registered or licensed.
Do Personal Property
The parties have accumulated numerous and various pieces of personal
property during the marriage, which Is marital subject to equitable distribution.
Atlached Is a listing of such property and Identification of who has possession
of this property. If the parties are able to reach a selllement, it may be
necessary to value this property through an appraisal. The current value of

Plaintiff docs not know of any person not a party to this proceeding who has physical
custody of the children or who claims to have custody or visitation rights with respect to the
children.
8. The best interest and permanent welfare of the children will be served by granting
thl! relief requested because:
a. defendant knows that Sarah is afraid of him;
b. defendant admits that he does not have a good relationship with Sarah;
c. defendant yells at Nathan when Nathan is fussy;
d. defendant has grabbed Sarah when he is angry with her;
e. defendant was fired from two jobs in the six month period between
November 1997 and May 1998;
f. since May 1998, when he was fired at the end of his probationary period,
defendant has not sought employment;
g. defendant attends classes four evenings per week and every Saturday;
h. when defendant is not in class, he spends little time with the children other
than watching Nathan on three days per week;
i. against plaintiff's specific instructions to the contrary, defendant frequently
has Sarah watch Nathan after school;
j. defendant docs not attend Sarah's school events;
k. defendant has been harassing and threatening plaintiff;

L EXCEPTIONS.
1. The Divorce Master CITed in his findings of fact and conclusions of law as
follows:
A. By failing to properly consider the tax consequences and other
ramifications of awarding Defendant-Husband the Individual Rctirement Account with
Edward Jones when analyzing the factors set forth in Section 3502 (A) of the Domestic
Relations Code. (Master's Report, Paragraph 10, pp. 5-6);
B. By failing to actually award Defendant-Husband at leas', 48% of the value
of the marital est lite as a result of awarding Husband the t:1ce value of the Individual
Retirement Account with Edward Jones (Master's Report, p. 10);
C. By awarding the marital home to Plaintiff-Wife without ordering her to
sell or refinance the home in an amount sufficient to remove Husband's obligation from
the joint note and mortgage in violation of the contractual terms of the parties' mortgage,
The Master's recommendation rcsults in thc continued economic entanglement of the
parties and will adversely affect Husband's ability to obtain credit and purchase a home

RECOMMENDATIONS
AND NOW, comes the Plaintiff, Deneen M. SlIvani, by and through her attorneys,
Wlx Wenger and Weidner, and files the following exceptions to the Divorce Master's
Report and Recommendations.
1. The Master erred and abused his discretion with respect to the following findings
of fact:
a. In finding that both parties contributed to the duties of homemaker during
the marriage (paragraph 7, page 5).
b. In failing to find that the husband had a substantial portion of his
Inheritance remaining at the date of separation (paragraph 8, page 5).
c. In falling to find thai the husband had a substantial non-marital fund
available to him, post separation, which was not available to the wife.
d. In failing to find that the wife had preserved marital assets, particularly the
marital home, by continuing to make the mortgage payments taxes and
insurance on the marital home, thereby Increasing the equity of this asset.
e. lnfalllng to find that the husband dissipated marital assets as the result ot
failure to make payments on martial debts that were solely In his name
and In which he had sole knowledge and control.
2. The Master erred and abused his discretion with respect to his recommendations
and distribution of the marital assets and liabilities as tollows:
a. By falling to award the marital assets on the basis of a 60/40 dlstrlbuti6n,
In favor of wife, based on the substantial factors warranting such
distribution.
b. By failing to divide the marital debt on a 40/60 basis, In favor of wlte,
based on the factors set forth In ~3502 of the Divorce Code, Including,
without limitation, the subst&ntial asset available to husband constituting
the Inherltanoe remaining on the date of separation, and husband's failure
to maintain payments on martial debt In his name alone.
o. By failing to award to wife at least a portion of her attorney's tees, which
were warranted under the circumstances.
WHEREFORE, the Plaintiff respeotfully requests this Honorable Court to:
1. Order a distribution of the marital assets based on a 60/40 distribution, In favor ot
wife, with a distribution of the marital home to wife, to be offset with husband's
pension benefit 10 husband.
2. Order distribution of the marital debt on the basis of a 40/60 distribution, In favor
ot wife, granting to eaoh of the parties proper credits for payments on the marital

PROCEDURAL HISTORY
A divorce complaint was filed on January 11, 1999, raising
grounds for divorce of irretrievable breakdown of the marriage. The
complaint raised economic claims of equitabie distribution, alimony,
alimony pendente lite, and counsel fees and costs.
The Master was appointed on February 18, 1999, and
counsel were directed to file pretrial statements on April 9, 1999, in
accordance with P.R.C.P. 1920.33(b), Counsel failed to file the pretrial
statements as directed and on June 15, 1999, the Master's appointment
was vacated.
The Master was re-appointed on August 16, 2001. Pretrial
statements were directed and filed and a pre-hearing conference was
held on January 18,2002. A four-party conference was then set for
March 13,2002, at which time the Master dictated a memorandum on
the record and set a hearing date for May 30, 2002.
Counsel and the parties appeared for the hearing on May 30,
2002. Upon appearing for the hearing, counsel and the parties indicated
that they had been unable to resolve the date of separation of the parties
and thereupon the Master conducted a hearing on that issue. Following
the testimony, the Mastel' issued his findings on the record determining
that the parties separated on August 25, 1999.
Following the Master's finding regarding the date of
separation, counsel then entered stipulations on the record. A set of

stipulations was prepared prior to the hearing and signed by counsel; an
additional stipulation relating to debt and credit for debt was placed on
the record. 80th stipulations are attached hereto.
After the admission of the stipulations on the record, counsel
offered their clients' testimony on the ff\Ctors relating to equitable
distribution. Wife also offered testimony on her claim for counsel fees.
She withdrew her claim for alimony.
Following the te!ltimony offered by the parties, the record
was dosed and the Master proceeded to prepare his report and
recommendations.

Counsel prepared stipulations, which they signed prior to
, the hearing, and which were admitted into the record by agreement. In
addition, coun!lel placed on the record stipulations relating to the marital
debt issues. 80th sets of stipulations are attached to this report and
made a part hereof.
DNDINGS OF FACT
Inasmuch as the stipulations encompass the vital statistic
information and facts relating to the factors dealing with equitable
distribution as well as an outline of assets and values and debt
obligations and credits each party is to receive, the Master does not

Consequently, wife's contribution by working to support the family
allowed husband to continue his t~ducation.
5. Both parties' opportunity to acquire assets in the future rely on
their employment income. Wife does have a pension plan through her
employment which is post-separation; husband has the opportunity to
participate in a 401 (k) plan with Tyco Electronics but does not currently
participate.
6. The source of income of both parties is related specifically to their
employment as well as any benefits which either may receive through
that employment.
7. Husband contributed funds from an inheritance from his mother
to the marital estate. The inheritance was approximately $80,000.00.
$8,000.00 was set aside Into accounts for the two children of the
marriage. Husband te,stified that approximately $10,000.00 remains of
the inheritance. A substantial part of the inheritance, therefore, was
used during the marriage to purchase marital assets, pay the mortgage,
bills, and living expenses.
Both parties contributed to the duties of homemaker during the
marriage.
8. The value of any property set aside to each party will be what they
receive in the distribution of marital assets; as previously stated,
however, husband does have some cash remaining from his inheritance
from his mother's estate and wife has whatever future benefits she may
acquire in her pension plan through her employment.
9. The standard of living of the parties established during the
marriage was middle-class.
10. The economic circumstances of the parties are based on their
respective earnings and benefits that they receive from their employment
and the non-marital assets and interests which have previously been
identified.
The Mastel' has considered that in awarding husband's account
with Edward Jones to him that there are certain tax consequences
arising out of the award. Should husband need to take funds from the
account before he reaches the age of 59 '/>, he will pay a penalty (it is not
anticipated this would be necessary under the circumstances in this case
although there was a question whether husband would be able to
withdraw funds without penalty to pay debt). However, at the time that
husband does withdraw funds from the account, even if it is after the

Husband shaJl be entitled to receive from the marital
home a microwave oven, a video cassette recorder, a Sharp television,
and earthen ware and glassware in a shed on the premises at 7

Wife's claim for alimony has been withdrawn.
COUNSEL FEES AND COSTS
DISCUSSION
Wife has requested a contribution from husband
toward payment of her cOllnsel fees and costs. In reviewing wife's c1aim~
the Master does not consider that husband conducted himself in any
way that created an unusual burden on wife for payment of fees and
costs based on obdurate, dilatory, and vexatious conduct. 80th parties
have incurred substantial fees and hopefully with the finalization of the
divorce proceedings the fees will cease. Further, the Master considered

speak to an attorney; and that he thought perhaps the parties should
pursue divorce. At thut time, wife Ilsked husband to separate physically.
Husbllnd, however, did not move out of the house but did move to
separate quarters.
Since August 25, 1999, the parties did not engage in
any ongoing marital sexual relationship or social activities. In October
1999 at husband's request wife opened a separate checking account and
contributed her share of expenses to husband by a check from that
account. Wife physically removed herself from the house with the
children on December 27, 1999. Wife did indicate that she spent
Christmas with her mother; however, she returned to have the children
spend some time with the father during the holiday, and then
subsequently left the residence on December 27. Wife resumed living in
the marital residence in February 2000 when husband vacated the
premises.
80th parties indicated that the marriage was causing
them difl1culties in the relationship with each other. The attempt to
reconcile was made by both parties but did not accomplish a resolution
of the marital relationship, and the Master finds that based on the facts
retated and tht~ testimony, that the parties did separate on August 25,
1999, when the marital relationship and activities thereto ceased.

d. Tho mortgage bulnnce as of 5/29/02 is $51,692.52. The taxel! and
homeowners insurance are paid as part of the monthly mortgage

e. The Plaintiff has paid all the mortgage payments, without default
since February, 2000.
f. The Plaintiff has had exclusive possession of the marital home
since February, 2000.
4. Mark SlIvani has a retirement account managed by Edward Jones.
a. The value of this account as of 12/31/99 was $49,262.56.
b. The value of this account as of 5/2902 Is $54,062.61.
c. The entire retirement account Is a marital asset.
d. There have been no post separation contributions made.
e. There have been no withdrawals from this account.
5. Deneen SlIvanl has an annuity with Lincoln Life Insurance Company.
a. The value of the annuity as of 3/31/99 was $414.62.
b. The value of the annuity as of 3/28/02 was $485.94.
c. The annuity is a marital asset.
6. Deneen SlIvanl has a whole life insurance polley with Prudential Lite
Insurance Company on which she has made payments post-separation.
a. The value of this policy as of 12/29/99 was $2,766.89, which Is the
marital portion of such policy.

7. In 1998 Mark Silvani roceivod an inheritance from his mother who
passed away on 3/30/96.
a. The inheritance consisted of approximately:

b. A portion of this inheritance was used during the marriage to
purchase marital assets, pay the mortgage, bills and living
expenses.
c. $8,000 of the inheritance was used to set-up accounts for the
children.
d. There was approximately $20,000 of the Inheritance remaining as
of 12/31/99. The Defendant paid the Janual'y, 2000 mortgage
payment.

days of the date of this Stipulation. As part of said refinance, Wife shall pay oft in
full all the joint debt assigned to Wife in the Master's Report.
3, In the event that the said refinancing Is not completed within the said ninety (90)
day period set forth In paragraph 2 above, the parties agree to list the house for
sale at a price to be determined by mutual agreement of the parties. In the event
the parties are not able to agree, the listing price shall be that set by an appraisal
determined by an independent MAl appraiser of the parties mutual selection, or If
the parties are not able to agree on an MAl appraiser, by an appraiser selected
by the Court of Common Pleas of Cumberland County, The appraisal shall be at
Wife's expense, In the event the Real Property is sold pursuant to this paragraph
3, the proceeds there from shall be used to payoff the aforementioned mortgage,
the joint debt assigned to Wife in the Master's Report and the balance thereof
shall be paid to Wife, Wife shall be solely responsible for all costs and expenses
associated with the sale of the house,
