COMPLAINT
NOW comes the plaintiff, Sandy Panczyszln, by her allorney, John J. Baranski,
Jr., and files this Complaint against the defendant, and represents as follows:
1. The plaintiff Is Sandy Panczyszin, an lldultlndlvldual residing at 215
Mclean Hall, Shlppensburg University, Shlppensburg, Cumberland County,
Pennsylvania.
2. Tho defendant is Randy Womer, an adLJlt individual whose last known
address is 1435 Washington Avenue, Northhampton, Pennsylvania.
3, At various times during 1998, the parties entered into enforceable oral
agreements whereby plaintiff agreed to loan money to defendant or pay for other
valuable services used by defendant in exchange for defendant's promise to repay the
money to plaintiff or reimburse plalnllff for the cost of the services, specifically:
a. Defendant agreed to reimburse plaintiff for the $74.49 paid by
plaintiff to Friedman's Jewelry for an engagement ring, The ring was later returned and
exchanged by the parties for a Seiko wrist watch currently In defendant's possession
and a gold necklace currently In the plaintiff's possession,
b, Defendant agreed to reimburse plaintiff for one half the $67.94
paid by plaintiff for a rental vehicle from Airport Road Rent a Car, the car to be used by
the parties to travel to Knobel's camp ground.
c, Defendant agreed reimburse plaintiff for the $122.69 paid by
plaintiff for a rental vehicle from Airport Road Rent a Car, the car to be used by solely
by the defendant to travel from Allentown, Pennsylvania to Shlppensburg,
Pennsylvania, Defendant failed to return the car on time and Incurred an additional
$122.69 fee, which was charged to plaintiff's credit card. Defendant agree to reimburse
plaintiff for this additional charge as well.

d. Defendant agreed to reimburse plaintiff for one half the $26.00
paid by plaintiff to Sea Dip Motel in Myrtle Beach, South Carolina as a deposit for
lodging during Spring BI'eak, 1998.
e. Defendant agreed to reimburse plaintiff for one half the $250.21
paid by plaintiff to the Sea Dip Motel in Myrtia Beach, South Carolina for lodging during
Spring Break, 1996.
f. Defendant agreed to reimburse plaintiff for the $40.00 paid to
TODAY'S MAN for a shirt worn by defendant in a church function attended by
defendant.
g. Defendant agreed to reimburse plaintiff for all charges on plaintiff's
Cellular One phone bill attributable to defendant's separate cellular phone account,
account numher 717-357-2677. Plaintiff opened the account and included defendant
on the accnunt under a separate phone number as defendant was unable to obtain his
own account. Plalnllff later removed defendant's name from the account. To date, the
charges which plaintiff has paid on behalf of defendant total $322.49.
h. Plaintiff requested permission from defendant to cancel the Cellular
One contract. Defendant granted his permission to cancel and agreed to reimburse
plaintiff for the cost of the early cancellation fee and all remaining monthly service
charges. The charge for early cancellation is $150.00 plus $19.95 for each of the eight
months of service remaining under the contract.
i. Defendant agreed to reimburse plaintiff for the $144.11 paid by
plaintiff to TSR WIRELESS for a pager used by defendant.
j. Defendant agreed to reimburse plaintiff for the $149.99 paid by
. plaintiff to K-MART department store for a television that defendant gave to plaintiff as
a gift.
k. Defendant agreed to reimburse plaintiff for tho $26.32 paid by
plaintiff to AT&T WIRELESS SERVICES for cellular phone service used by defendant.
4. Plaintiff has retained receipts for Items "a." through "k." above and
these items are available for copying at the office of plaintiff's counsel.
5. At all times relevant hereto, plaintiff and defendant agreed that the above
Items were not gifts from plaintiff but were loans to defendant that were to be repaid by
defendant.

AMENDED COMPLAINT

3. Denied as conclusions of law, To the extent a response is deemed necessary, the
allegations contained in PaI'agrnph 3 of Plaintiffs Amended Complaint arc specifically denied.
To the contrary, there were never ony "enforceable oral agreements," entcred into between
Plaintiff and Defendant. along the lines alleged in Plaintifl's Amended Complaint. It is further
specifically denied that there are any agreements pursuant to which Plaintiff would "loan money
to Defendant," or "pay for other valuable services used by Defendant," in connection with which
Defendant "promised to repay the money to Plaintiff or reimburse PlaintitHor the cost of the
services," By way of further response, it is allcged and averred Ihat to the extent to which either
Plaintiff or Defendant spent monics fi'om which the other derived any bencfit, it was because the
two of them were involved in a personal relationship at the time, and the expenditures were
intended to be either gifts, not loans. and/or were expenditures which in fuet benefited the
Plaintiff, as well as the Defendant.
By way of further response, Plaintiff alleges and avers the following in connection
with subparagraphs (a) through (k) of Paragraph 3 of Plaintiff's Amended Compluint.
(a) It is specifically denied that there was any ngreemenl to reimburse Plaintiff
for the monies referenced in connection with this "engagement ring;"
(b) It is specificully denied thaI there was any agreement for Defendant to
reimburse Pluintiff for half the money for acar rental which, according to Plaintiffs own
allegations, benefited both parties;

(c) It is specifically denied that Defendant agrced to reimburse PlaintlfTfor
any of the car rentnl chnrgcs referenced;

(e) It is specifically denied that DIlfendant agrced to reimburse Plnintifffor the
lodging charges referenced, which Was intended to benefit both pnrties;
(I) It is specifically denied that Defendant ngrced to reimburse Plnintitffor the
cost of the shirt referenced;
(g) It is specifically denied that there wns any ornlngreement requiring
Defendnnt to reimburse Plllintiff for these telephone chllrges;
(h) It is speci ficlllly denicd thnt there was any oralngrecment rcquiring
Defendant to reimburse Plulnliff for these telephone chnrges;
(i) It is speciticlllly denied that there wns any oral agreement requiring
Defendant to reimburse Plllinliff for the pager charges;
