18. The first warranty repair attempt is believed to have
occurred on or before June 10/ 1997/ when the vehicle/s odometer
showed 434 miles. On that date, a repair attempt was made to
remedy a problem indicated by the "check engine" light, A true
and correct copy of the repair invoice is attached hereto, made a
part hereof and marked Exhibit "B."
19. The second warranty repair attempt is believed to have
occurred on or before June 17/ 1997/ when the vehicle/s odometer
showed 1,045 miles. On that date, repair attempts were made to
remedy a defective radio. A true and correct copy of the repair
invoice is attached heroto, made a part hereof and marked Exhibit
"C."
20, The third warranty repair attempt is believed to have
occurred between July 7/ 1997 and July 22/ 1997/ when the
vehicle/s odometer showed 1/253 miles. On that date, a repair
attempt was made to remedy a defective transmission. Also on that
date, a repair attempt was made to remedy a fraying engine belt.
A true and correct copy of the repair invoice is attached hereto,
made a part hereof and marked Exhibit "D."
21. The fourth warranty repair attempt is believed to have
occurred on or before July 29, 1997/ when the vehicle/s odometer
showed 1/269 miles. On that date, repair attempts were again
made to the defective serpentine belt, A true and correct copy of

the repair. invoice is attached hereto, made a part hereof and
marked Exhibit "E."
22. 'fhe fifth warranty repair attempt in beHeved t.o have
occurred between August 28, 1997 and October 10, 1997, when the
vehicle's odometer showed 5,286 miles. On that date, repair
attempts were again made to the defective transmission, Also on
that dat.e, repair att.empts were again made to remedy a broken
belt.. Also on that dat.e repair at.tempts were made to remedy a
defective left door window switch panel, A t.rue and correct copy
of the repair invoice is attached hereto, made a part. hereof and
marked Exhibi t "F."
23. The sixth warranty repair attempt is believed to have
occurred between Sept. ember 30, 1997 and November 12, 1997, when
the vehicle's odometer showed 5,991 miles. On t.hat date, repair
attompts were again made to remedy a drive belt. problem. This
time the tensioner arm was bent straight.. A true and correct copy
of the repair invoice is attached heret.o, made a part hereof and
marked Exhibit "G."
24. The seventh w"rranty repair attempt is believed to have
occurred between October 20, 1997 and November 19, 1997, when the
vehicle's odometer showed 7,354 miles. On that date, repair.
attempts were again made to remedy the drive belt and to replace
the hood insulation. On this date, the tensioner assembly was
replaced. Also on that date, repair attempts we.re made to remedy
a defective coolant system. A true and correct copy of the repair

25, The eighth warranty repair attempt is believed to have
occurred between November 14, 1997 and November 17, 1998, when
the vehicle's odometer showed 7,492. On that date, repair
attempts were again made to remedy the "check engine" light. A
true and correct copy of the repair invoice is attached hereto,
made a part hereof and marked Exhibit "I."
26. The ninth warranty repair attempt is believed to have
occurred between November 18 and November 26, 1997, when the
vehicle's odometer showed 7,492 miles. On that date, repair
attempts Wt:!re made to remedy the defective cylinder head
assembly. Also on that date repair attempts were made to remedy
the check engine light and the left door panels, A true and
correct copy of the repair invoice is attached hereto, made a
part hereof and marked Exhibit "J."
27. In addition, Plaintiff avers the vehicle has been
subject to additional repair attempts for defects and/or non-
conformities and/or conditions for which the dealer did not
maintain records.
28. Plaintiff has been and will continue to be financially
damaged due to Defendant's intentional, reckless, wanton and
negligent failure to comply with the provisions of 73 Pa. C.8,A.
U951 ~ ~.
29. Plaintiff further avers he has resorted to Ford's

express warranties I however, such repair attempte have been
ineffective.
36, As a direct and proximate result of Defendant's failure
to comply with the express written warranties, Plaintiff has
suffered damages and, in accordance with 15 D.S.C. ~2310(d) (1),
Plaintiff is entitled to bring suit for such damages and other
legal and equitable relief.
37. Title 15 U,S,C. provides:
If a consumor finally prevails on an action
brought under paragraph (1) of this
subsection, he may be allowsd by the court to
recover as part of the judgment a sum equal
to the amount of aggregate amount of costs
and expenses (including attorney fees based
upon actual time expended), determined by the
court to have been reasonably incurred by the
Plaintiff for, or in connection with the
commencement and prosecution of such action,
unless the court, in its discretion shall
determine that such an award of attorney's
fees would be inappropriate.
38. Plaintiff avers that upon successfully prevailing upon
the Magnuson-Moss claim herein, all reasonable attorney fees are
recoverable and are demanded against Defendant.
WHEREFORE, Plaintiff respectfully demands judgment in his
favor and against Defendant in an amount equal to the purchase
price of the subject vehicle, plus all available collateral
charges and attorney fees.
