" SEPAHA'I'ION AGREEM1mT MADE this L~f.ir- day ~~ \IY::'Q~-_, 1998, by a~d between, James K. Bailey, of PennsYlvanIa, hereinaf.ter referred to as "Husband"; and Chrilltine DaJ.1ey, of Pennsylvania, hereinafter referred to 8B "Wife". WHEREAS, the parties hereto are Husband and Wife having been married on --~;f~-~_._Ij,~_.; and WHEREAS, the pnrb.1es intend to live separate and apart, and the parties are intending to fHe for divorce; and WHEREAS the parties henJto have accumulated certain property throughout their marriage and wish to make a disposition thereof; and WHEREAS, each of the parties herein have been advised by independent legal counselor have that right to be advised by independent legal counsel as to the nature and effect of a separation agreement and with said advice have determined that the following agreement is fair and reasonable and enter 1nto the same with full knowledge of the extent of the estate of the other and their respective rights. NOW 'l'HEREFORE, WI'rNEssE'rH, in considerntion of the promise and mutual undertakings herein contained, intending to be legally bound hereby, the parties do mutually agree as follows: 1. SEPARATION: The parties may !lve apart for the rest of their liv~1s. Each shall be free from interference, direct or indirect, by the other as fully as though unmarried. Eaoh may fOl: his or her separate benefit, engage in any employment, bu~iness or prOfession he or she may choose. 2. MU'I'UAl, ES'rATE WAIVER: It is the intentIon of the parties hereto that from and after the date of this agreement, nelthE'r shall have any spouse's rights in the property or estate of the other, and to that end, both waive, relinquish and fo~eboar their rights of dower or curtesy, rights to inherit, rights to claim or t.ake a husband or wife's or family exemption or allowance, to be vested with letters of administrat.ion or testament.ary, and to take against any wi 11 of the other. The p~rties further agree that they may and can hereafter, as though un'mar-ried, without any joinder by him or her, sell, convey, transfer and/or encumber or hereafter own or possess real or personal property and further agree that the recording of this agreement shall be conclusive evidence to all of his or her right to do so. And the said Husband and Wife do hereby irrevocably grant, each to the other shOUld the exercise of this power hereby given become necessary, the right and power to appoint one or more times any person or persons, whom Husband and Wife shall . , . , , designate, to be the attorney~ln-faat for the other, in their name and in their stead, ~o execute and acknowledge any d~ed or deeds, releasee, quitclaims or satisfactions, under,sual or otherwise, to enable either party to alienate his or her real or personal property, but without any power to impose personal HabH i ty for breach of warranty or othcl:w ius. Each of the parties hereto further waive any right of election contained in Chapter ~2 of the Pennsylvania Probate, Estates and Fiduciaries Code, or such right in this of any other jurisdiotion. J. DIVORCE: At such time as the parties are ready, Husband and wife, shall complete a divorce and shall each bear all expenses connected therewith. 4. lI'l"I'ORNEY'S 1'1mS: Both of the parties shall bear their own attorney's feou in this matter, and both and each of the parties waive any claim against the other for any attorney's fees in this mat.ter. 5. ALIMONY, ALIMONY PENDEN'l'E LI'l'E, SPOUSAL SUPPOR'1', COSTS, AND EXPENSES: The parties, for and in consideration of this agreement, do hereby waive, one from the other and one t.o the other, any and all rights t.hey may have to alimony, alimony pendente lite, costs, expenses and support for each other. This does not include any obligation t.o repay any past support. 6. PERSONAl. PROPER'!'\': All property at the home located at. 30 JJurgan Avenue, Shippensburg, Pennsylvania, shall be the sole propert.y of IHfe. Husband shall pay to Wife the sum of $38,000.00. The said sum of $38,000.00 shall be paid to Wife in bi-weekly installments equal to 1/2 of wife's mortgage payment and shall bare interest. at the rate equal to t.he rate of the said mortgage note being 8. 6~5 percent. Husband shall pay the sum of $116.67 bi-weekly until the principal is fully paid. 7. PE:NSION RIGHTS: Each of the parties waive any claims to any pensions that. either may have through his or her employment or otherwise. 8. REAL ESTATE: All real estate shall be transferred to WJ,fe. 9. EQUITABLE DISTRIBUTION 01' PROPERTY: By this agreement, the parties have intended to effect an equitable distribution of tneir marital property. '1'he parties have det.ermined that an equitable distribution of such property conforms to a just and right standard with due regard to the rights of Husband and Wife. The distribution of existing marital proporty is not intended by the parties t.o constitute, in any way, a sale or exchange of assets, and the distribution is being effected without t.ho introduct.ion of outside funds or other property not constituting a part of the martial estate. 10. DEPAUW': If either pnrty fnila in due performanoe of his or her obligationa hEll"eunder', the other party shall have the right, of hia or her eleo~ion, to Bue for damagea for a breach of thia agreement, or to rescind the same and seek such legal remediea aa mny be available to him or her. Nothing herein oontained shall be con at rued to restrict or impair either party's rights to exercise this'election. 1I. APPIJICABl,E LAW: This agreement ahall be governed by the lawR of the Commonwealth of Pennsylvania. 12. MODII'ICA'rION AND WAIVEH: No modifioation or waiver of any of the terms hereof shall be valid unless in writing and signed by both of the partiea. No waiver of any breaoh hereof or default hereunder ohal1 be deemed a waiver of any subsequent breach Dr default of the aame or similar nature. 13. RECONCILIATION: The parties shall only effect a legal reconoil iation which superaedes this agreement by a signed agreement containing a speoific statement that they have reoonoiled and that thls agreement shall be null and void; otherwise, this agreement shall remain in full force and effect. Further, the parties may attempt a reconciliation whioh action if not consummated by the aforesaid agreement, shall not affect in any way the legal effeot of thia property and separation agreement or cause arty new martial rights or obligationa to accrue. 14. ENFORCEABILITY AND CONSIDERATION: This Agreement shall survive any action for divorce and decree of divorce and shall forever be binding and conclusIve on the partIes, an independent legal action may be brought to enforce the terms of thia agreement by either Husband or Wife until it shall have been fully satisfied and performed. Consideration for this contract an,d agreement is to be found in this mutual benefit to be obtained by both parties hereto and the covenants and agreements of each of the partIes to the other. 'l'he adequacy of the consideration for the mutual undertakings herein set forth is stipUlated, confessed and admitted by the parties intend to be legally bound hereby. . . 15. WHOI,E AGREEMENT: This agreement constitutes the entire understanding of the parties. It auperscdes any and all prior agreements between them. There are no representations or w~rranties other than those expreasly herein set forth.
