attorneys, The Law Of fines of Patrick F. Lauer, Jr., filed a civil
action against the Defendant, Steve McCarren, before District

Defendant; the Defendant appealed to this Court/ the Plaintiff
filed a Complaint; the Defendant/Appellant filed an Answer and
Counter-claim; to which the Plaintiff/Respondent now Hies this
Reply; and in support thereof, avers as follows:

installing the cabinets until she could "liveH with them.

plaintiff. The defendant was in the middle of the job, the

with it for awhile.

COMPLAINT
The Plaintiff/Respondent, Martha Kitzmiller, through her
attorneys, The Law Offices of Patrick F. Lauer, Jr., brings the
following Complaint upon .the Defendant' B Appeal from Oistrict
Justice Judgment, and in support thereof avers as followSl
1. The Plaintiff/Respondent is Martha Kitzmiller, an adult
individual residing at 1051 Brandt Avenue, Lemoyne, Cumberland
County, Pennsylvanla 17043.
2. The Defendant/Appellant is Steve McCarren, an adult
individual, tradin~ or doing business as steve MoCarren at 270
Meadows Road, Newville, Cumberland County, Pennsylvania 17241.
3. This aotion is based upon a verbal contract to install or
remodel a kitohen in the Plaintiff's home.
4. In or around May of 199B, Ms. I(i tzmiller saw Defendant' s
advertisement in a looal ciroula.r offering to "sell, deliver and
install a used kitohen in very good condition for around $1,000."
See attaohed Exhibit "A" inoorporated herein by reference.
5. Ms. Kitzmiller met the Defendant at hie place of
business, showed him a drawing of her kitchen, and asked for light
oak oabinets to be installed.
See attached Exhibit "8"
incorporated herein by reference.

6. The Defendant indioated that he would soon be pioking up
some one-half dozen light oak kitchens from the depot.
7. Ms. Kitzmiller travellsd to the Defendant's place of
business a seoond time, inepected the cabinetry, and indioated that
the oolor and style would be fine.
8. The Defendant travelled to Ms. Kitzmiller's home, took
measurements of her kitchen, and asked for a $1,000.00 down
payment, whioh Mo. Kitzmiller provided.
9. Mo. Kitzmiller asked that the Defendant assemble the
cabinets for her kitchen before ordering counter-tops.
10. The Defendant agreed, but requested an additional $500.00
because of the large size of the kitchen.
11. Ms. Kitzmiller provided the additional $500.00.
12. The Defendant installed substandard cabinetry which had
broken handles.
13. The Defendant failed to supply a 33" oabinet neoessary to
complete the plan.
14. The Defendant installed mi.ematched sizes and styles of
oabinetry, some incorporating vinyl workings where other did not.
15. The Defendant failed to shim, or level, several of the
cabinets.
16. The Defendant installed a oabinet under the kitchen
window which was substantially different in size and shape from
I that discussed in the original remodelling plan.

The Defendant's substandard workmanship caused a water
leak whioh damaged Ms. Kitzmiller's clothes closet.
18. The Defendant never oomp1eted the project, epecificallYI
a. The Defendant failed to attach or level eight
baBe kitchen cabinete;
b. The Defendant failed to attach or level Hve
wall kitchen cabinete;
c. The Defendant failed to .l.netall two formica
counter tops upon the baee cabinets;
d, The Defendant failed to cut out a sink hole in
the formica counter top; and
e. The Defendant failed t.o inst.all the kitchen
sink or to connect the eupply water lines or drain.
19. Ms, Kitzmiller. received an estimate to repair and
complete the job which the Defendant performed in a substandard and
unworkDwnlike manner, failed to complete, or both.
20. The estimate quoted the price of $572.00 to repair and
complete the above-referenced repairs. See attached Exhibit "C"
incorporated herein by reference.
21. Ms. Kitzmiller has been unable to make full use of her
kitchen, including the water supply or drain of the sink, since
last summer through the date of this Complaint.
WHEREFORE, the Plaintiff, Martha Kitzmiller, respectfully
requeots the Court award her damages in an amount less than
$25,000, plus costs and interest on the jUdgment, and such other
relief as the Court deems appropri
