1 PROCEEDINGS
2 THE COURT: This is the time and place for a
3 nonjury trial in the case of Bankert versus Bishop. We
4 will let the record indicate that the Plaintiffs are
5 present in court represented by their counsel, Barbara
6 Sumple-Sullivan, Esquire. The Defendant is also present
7 in court representing himself.
8 Do Ms. Sumple-Sullivan and Mr. Bishop wish to
9 make opening statements?
10 MS. SUMPL2-SULLIVAN, Sure, Your Honor. Your
11 Honor, this is an action which is brought by the
12 Bankerts, an ejectment action, to receive possession of
13 the property that they own at 209 Portland Street.
14 The property had previously been owned by Mr.
15 Bishop and a Miss Accristo. The property was sold at a
16 sheriff's sale and a proper sheriff's deed was delivered,
17 dated December 7, 1998, to my clients.
18 Despite requests, Mr. Bishop has refused to
19 relocate from the property, and this is an ejection
20 action for my clients to regain possession of the
21 property.
22 MR. BISHOP: I wanted to state that I
23 notified the tax office before the sheriff's sale went
24 through and explained to them that I wouldn't have the
25 money for the taxes that were due until about another

Q. Can you describe for the Court how you became
aware that the property at 209 Portland Street was for
sale?
A. There was a notice in the Patriot News.
Q. After you saw the notice in the Patriot News,
did you take any actions to determine what the condition
of the title was or how that property would be
transferred?
A. We did a background check to make sure there
were no liens against the property.
Q. What was the date of the sheriff's sale, sir?
A. September 28.
THE COURT: What year was that?
THE WITNESS: 1998.

A. Yes, we did.

statements, don't have like a poiiee l~ecord or anything,
because I never threatened him.
THE COURT I You can cross-examine him on that
point, but he is purporting to say what you told him
which would be an admissible statement. If you feel it
is not factually accurate, you may cross-examine on that.
MR. BISHOP: That's what I want to do.
BY MS. SUMPLE-SULLIVAN:
Q. Continue, Mr. Bankert.
A. Mr. Bishop indicated that he would be
forcefully giving up the property, that he had a gun and
that he would not give up the property peacefully.
MR. BISHOP: That's a lie there.
THE COURT: It's not proper to comment on the
statements of the witness. You certainly can
cross-examine on that, though.
BY MS. SUMPLE-SULLIVAN:
Q. At any time since Mr. Bishop has been in your
property since December, has he ever paid you any rent
all ?
A. No.

1 A. Becaus€ the process is in litigation, any
2 conversation that I had would have to go through my
3 lawyer.
4 Q, But what I'm trying to state is what
5 conversations did we have. That's what I'm asking. What
6 conversations did we have?
7 A. We had conversat ions when you would stop me,
8 woulcln' t let me in the house, and talk to me about not
.9 giving up the property. Is there any way that you could
10 buy the property from me. My indication was, no, you
11 could not huy the property back.
12 BY MR. BISHOP:
13 Q. I understand that. But my question is when
14 did this gun thing come up, and was there a report filed
15 with the police?
16 A. No, there was no report filed. And you did
17 not indicate any bodily injury to me or my family, but
18 you did indicate that you would have me forcefully
19 removed from the property and that you did have a gun and
20 they would have to take you.
21 Q. I don't ever remember saying that.
22 A . I do.
23 THE COURT: You can testify yourself as to
24 what you remember, but you can't comment on his answers

A. What was due was '96 and '97 taxes was past

Q. Prior to that time, did you pay the taxes

A. No, I didn't have the money to pay the taxes.
I was laid off and I couldn't find other work. I
couldn't borrow money against the house because Leslie
Accristo has to cosign, and she won't cosign on a loan to
pay the taxes or they would have been paid instead of
borrowing money from my mom.

it's not paid by then, there is nothing I can do. I
explained to them that I couldn't get them paid. But I
believe somewhat -- in their words, they didn't care.
They just wanted the taxes paid.
Q. SO, again, Mr. Bishop, you don't allege any
kind of fraud by the tax office in their sale of this
property?
A. I don't know. I don't know their rules, so I
cannot allege that they were or that they weren't. You
know, I --

A. Yeah, and I don I t know if LesUe Accristo has
received all her notices or not. I asked her to bring

your knowledge?
A. That I remember of, no, there was nothing I
could file. The :mly thing I called them on the phone.
Q. Since you have been in the property --
A. 12 years.
Q. Have you negotiated any kind of lease

A. We have never discussed any lease agreements.
They have never come to me except one time. He has
talked to me from the sidewalk.
Q. Have you at any time paid them any kind of
rental for the property?
A. No, there has never been anything discussed.
Q. And you continue to maintain possession of
this property to this date. Is that right?

A. What I am looking at here is printed on both
sides of a form. On one side it is a nottce of public
tax sale dated August 10 of 1998. It is addressed to
Timothy J, Bishop and Leslie J. Accristo at 209 East
Portland Street, Mechanicsburg. It lists the price of
the sale, which includes the delinquent taxes together
with any municipal liens or any Department of Revenue
liens that may be in place, So that the figures shown
here is more than the year of the delinquent taxes.
Also, on the other side of this form, it's
indicating that sheriff's service was made on Mr. Bishop
by a deputy sheriff, whose name I cannot read, Leslie
something -- I'm searching for a date. On the 9th day of
September, 1998.
Q. In addition to the direct notices, did you
have an opportunity to post this sale at various
newspapers?
A. Yes,

3 MR, BISHOP: I basically don't know what to
4 say, I want to be able to pay my back taxes. I wanted
5 to be able to pay them, like I said, a month later,
6 because I didn't have the money, Once it went through,
'7 the tax office won't accept it.
8 I feel as if I'm being threatened with -- not
9 being threatened by the Plaintiffs, but I've lived there
1.0 for 12 years, I don't have the ability to communicate
11 with Leslie Accristo other than on the weekends when she
12 comes over to drop our daughter off, The house was paid
13 for, was paid off and I have no other place to go.
14 THE COURT: Ms, Sumple-Sullivan?
15 MS. SUMPLE-SULLIVAN: Your Honor, I -- again,
16 we're here on an action of ejectment. I think it is
17 clear from the record that all due notices and abilities
18 were given to Mr. Bishop to correct any kind of problem
19 that he had with the tax bureau.
20 By his own admission, he received the
21 warnings and was aware of the tax sale going through. He
22 received the warning. They gave him the right to file
23 objections to the tax sale within 30 days thereafter.
24 He, by his own admission, indicates that he did not make
25 his tax payment, These are the obligations that you have

1 as a citizen and a landowner.
2 The proper'ty was appropriately sold and was
3 purchased by the Bankerts in accordance with the
4 processes that are established by the court, At this
5 point, deed is prima facie, My clients are the owner of
6 that property and they have a right of possession based
7 on ownership, and that Mr. Bishop must be ejected from
8 the property to allow them to exercise their possession
9 of the property.

11 proposed Orders for the Court to sign in support of their

A pretrial conference was held in the chambers of
Judge Oler on Monday, Apl'U 5, 1999, Present on behalf of the
Plaintiffs was Barbara Sumple-Sullivan, Esquire, The Defendant
did not appear for the pretrial conference nor had he submitted
a pretrial memorandum.
This is an action in ejectment arising out of the
Plaintiffs' alleged ownership of property at 209 East Portland
Street, Mechanicsburg, Cumberland County, Pennsylvania. The
Defendant apparently maintains that in some way the title of the
Plaintiffs, which was received as the result of a sheriff's sale
on a tax debt, is procedurally defective.
This will be a nonjury trial which is not el<::>ected
to take more than one half day,
Defendant has not served answers to Plaintiffs'
interrogatories, which were served on February 24, 1999. By
separate Order of Court, Defendant will be directed to answer
the interrogatories without objection within fifteen days of
today's date. In addition, Defendant is directed to file with
the Court Administrator and to serve upon Plaintiffs' counsel a
pretrial memorandum in accordance with the local rules of court
within fifteen days of today's date.

the Tux Clnim Notice by n sherifr.24 Both of the notices contuined wtlrnings to the
Defendnnt of the pending tux sule of the properly lInd telephone numbers to cull fhr uny
questions regnrding the tux sule und whut could be done to stop it. H
Mr. Heisey stnted thut Defendunt hud not puid his delinquent tuxes, thut his joint
tenunt Leslie Aecristo wus ulso properly notified of the tux sule, and thut no objections to
the tux snle had heen filed by Defendunl. 211
Plaintil1s presented evidence that they had beeH unable to obtain insurance upon
the property which they purchased, because Defendant would not leave. They also
presented testimony that Defendant had threatened to damage the property and said he
had a gun.
Defendant, representing himself, testified that when he received notice of the tax
sale he telephoned the tax office to inform it that he would be able to make puyment on
the tux debt in the future, but that the tax ofl1ee demanded the money hy the dendline.
Defendant stuted that he remained prepared to make payments to sntisfy the debt.
Defendant further testified that the joint tenant, Ms. Aeerislo, did not receive proper
notice of the tax sale; however, Ms. Aceristo did not appear nt the triul and no support
for Defendant's assertion regarding her was presented.

By order of the court duted Muy 7, 1999, the Court rendered the verdiet in favor of
Pfuintitls quoted at the beginning of this opinion.21 From this order, Defendant has

DISCUSSION
Nuture of Aopeol: WolveI'
In the present euse, Defendunt hus appculed from a verdict as to which no post-
trial motion was filed. Although the issue of whether a verdict which has not been
reduced to judgment is app{~alable, and the issue of whether matters raised on appeal are
to be considered to have been preserved when no motioH for post-trial relief was filed, are
beyond the scope of this court's obligation under Pennsylvania Rule of Appellate
Procedure 1925, it may be noted that both questions have been answered in the negative.
Szakmeister v. Szakmeister, 344 Pa. Super. 465,496 A.2d 1199 (1985) (appeal quashed
where verdict not reduccd to judgment and no motion for post-trial relief filed).
Merits of Order Appealed from
In the absence of a motion for post-trial rclief, and based on Defendant's statement
of matters complained of an appeal, it appeurs that Defendant is challenging the
sufficicncy of the evidcnce to sustain thc verdict. "In considering the sufficiency of the
evidence to sustain the verdict, wc view the evidence in the light most favorable to the
vcrdict winllcr, granting that party the benefit of all reasonable inferences, and dctermine

I, SJatement of Facts
PlaintifTs acquired the property located at 209 E. Portland Street, Mechanicsburg,
Pennsylvania after a Sheriff's Sale. The Tax Claim Bureau Deed was recorded on December 7,1998.
Defendant has continued to reside in the property in question even though his interest in said property
was terminated as a result of the Sheriffs sale.
Because of Defendant's refusal to vacate the premises. Plaintifls filed a complaint for
ejectment on January 15. 1999. Defendant filed an Answer but did not serve PlaintitTs. Defendant
also requested that the matter be listed for trial. Defendant contends that he is still the legitimate
owner of the property and that the sale of the property was improper. He acknowledges he has no
lease.
Plaintiffs served Defendant Interrogatories on February 24, 1999 wherein they requested
Defendant to answer the following

Sumple-Sullivan, Esquire, The defendant is also present
in court representing himself, Do Ms. Sumple-Sullivan
and Mr. Bishop wish to make opening statements?
MS. SUMPLE-SULLIVAN: Sure, Your Honor. Your
Honor, this is an action which is brought by the Bankerts
to receive an injectment action to receive possession of
the property that they own at 209 Portland Street. The
property had previously been owned by Mr. Bishop and a
Miss Chris tow, The property was sold at a sheriffs sale
and appropriate per sheriffs deed was delivered dated
December 7, 1998 to my clients despite requests Mr,
Bishop has refused to relocate from the property and this
is an ejection action for my clients to regain possession
of the property.
MR. BISHOP: I wanted to state that I
notified the tax office before the sheriff's sale went
through and explained to them that I wouldn't have the
money for the taxes that were due until about another
month, because I had to borrow money. They went through
with the sale any way, the tax office, They said there
was nothing I could do after September, So, I have the
