Martin, Inc., Contractor IN THE COURT OF COMMON PLEAS CUMBERLAND COUNTY, PENNSYLVANIA STIPULATION AGAINST LIENS WHEREAS, Michael P. Starvaggi and Jean M. Starvaggi, of Cumberland County, Pennsylvania, is about to execute contemporaneously herewith, a contract with Michael L. Martin, Inc. of Cumberland County, Pennsylvania, for the erection of a dwelling upon a lot of land situate as follows: ALL THAT CERTAIN piece or parcel of land, situate in Hampden Township, Cumberland County, Conunonwealth of Pennsylvania, bounded and described in accordance with Final Subdivision Plan prepared by Haman & Associates, a copy of which in recorded in the Recorder of Deeds {)ffice in and for Cumberland County, Pennsylvania in Plan Book 84, Page 80, bounded and described as follows, to wit: BEGINNING at a point on the southern right-of-way line of Shasta Way at the conm~on front property comer of'Lot No. 1 and Lot No. 2 as shown on the above referenced plan of lots; thence along said right-of-way line of Shasta Way by a curve having a radius of 210 feet and an arc length of 92.37 feet to a point; thence continuing along said right-of-way line of Shasta Way North 55 degrees 43 minutes 15 seconds East, a distance of 60.58 feet to a point on the western right-of-way line of Cherokee Drive; thence along said right-of-way line of Cherokee Drive South 34 degrees 16 minutes 45 seconds East, a distance of 145.00 feet to a point at the dividing line between Lot No. 2 and Lot No. 3; thence along said dividing line South 55 degrees 43 minutes 15 seconds West, a distance of 150.00 feet to a point at the dividing line between Lot No. 1 and Lot No. 2; thence along said dividing line North 34 degrees 16 minutes 45 seconds West, a distance of 125.01 f~et to a point, said point being the Place of BEGINNING. BEING Lot No. 2 on the Final Subdivision Plan of Michael A. Ryan and Joyce M. Ryan, said plau recorded December 27, 2001 in Plan Book 84, Page 80. CONTAINING 21,166.011 square feet or 0.4859 acres. Starvaggi and Jean M. Starvaggi, to the said Michael L. Martin, Inc. to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with Michael L. Martin, Inc. and the further consideration of One Dollar, to Michael L. Martin, Inc. paid by Michael p. Starvaggi and Jean M. Starvaggi, it is agreed that no lien shall be filed against the building by the contractor, or any sub-contractor, nor by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived.
