NOW, THEREFORE, in consideraL ion of tho covenants contained in
said contract., and ot:' ;U. 00 and other good and valuable
considerat.ion, it is hereby E1tlpulated and agt'eed by and between
said parties as part of said contract that there shall be no lien
or right to file a lien, against the property, or any part or parts
thereof, for work or labor done 01' materials furniflhed in the
performancE~ of the work embraced in said cont.ract., or any part or
parts thereof, or extra work thereunder or changes made therein; and
that no such lien be or claim shall be filed, or in any way
at tempted to be enforced by, or on behalf of, the Contractor, or by
or on behalf of, any subcontract.ors, material men or other person
concerned in 01' about the performance of work embraced in said
contract, nor shall there by any claim for work or materlals
against the Owner, his heirs, executors, administrators or assigns,
other than t.he ]egal claim of the Contractor as provided in said
contract.
AND, in order to giV(, the Owner full power and authorit.y t.o
protect it.f3elf and the Improvement.s and the Pl'emises against. any
and all claims filed by Cont.ractor, or by any subcont.ractor or
anyone actinq under or t.hrough Cont.ractor in violat.ion of t.he
foregoing covenant, Cont ractor, for i tseH, i t.s successors and
assigns, and all such persons, hereby irrevocably aut.horizes and
empowers any att.orney of any Court. of Common Pleas of t.he
Commonwealth of Pennsylvania t.a appear fol' it,t.hem, or any of
them,in any such Court. as at.torney for it or them, and in hiB, its
or their name, mark satisfied of record at the cost. and expense of
Contract.or or of any such subcont.ractor, laborer or materialmen any
such claim or mechanics' lien or judgment thereon entered in it.s or
their names against the Improvement.s or the Premises or any part.s
thereof and for such act or acts this shall be good and sufficient.
warrant. and aut.hority and a reference t.o the' Court and t.o t.he
docket in which and where thiEI Agreement flhalJ have been filed
shall be a sufficient exhibit of t.he authority herein cont.ained t.o
warrant such action, and the Conlcractor, for itself and all
subcont.ractor",, laborerfJ and matcl,-ia]mon, does hereby release all
errors and defects whaU;oever in the entry of any such sat.i.sfact.ion
or t.he exercise of the authol'ity hereby conferred.
