Defendants are in substantial default under the Mortgage and the Mortgage Note, in that Defendants have failed to make the following payments of real estnte taxes as required under the provisions of the Mortgage: 1996 laxes 1997 laxes 1998 laxes $270.81 930.41 894.81 9. Defendants are in substantial default of their obligations under the Mortgage and the Mortgage Note, as Defendants have failed to make monthly payments when due for the months of July, August, September, OClober, November, and December of 1998. 10. Plaintiff has provided Defendants with notice of Homeowners' Emergency Mortgage Assistance ACI ofl983 as required by Act of 1983, December 23, P.L. 385 No. 91 (35 P.S, ~1680,401c el seq), and Defendanls has not soughl rellef under said Act. A lrue and correcl copy of said nolice is attached hereto as Exhibit "0" and is made a part hereof. 11. Plainliff is not required 10 provide Defendants with NOlice of Intenlion 10 Foreclose as required by Ihe ACI of 1974. January 30, P.L. 13, No. 6, ~403 (41 P.S. ~403), as the original principal balance of the obligation exceeded $50,000.00. Plaintiff has provided Defendants with written notice of default, demand for payment, and notice of cure rights, a true and correct copy of which is attached hereto as Exhibit "E" and is made a part hereof, as required under the tenns of the Mortgage. 12. Under the lerms of Ihe Mortgage Note and the Mortgage, Plaintiff has elected to declare the entire balance of the Mortgage immediately due and owing, 13.
