AND NOW, comes Monroe Township Municipal Authority, of 1220
Boiling Springs Road, Mechanicsburg, Pennsylvania, by and through
its Solicitors, James D. Bogar, Esquire, and Jennifer B. Hipp,
Esquire, and files the following municipal claim against GARY J.
LOPER and MARJORIE A. LOPER, husband and wife, adult individuals,
owning property located at 328 Old Stone House Road, Boiling
Springs, Monroe Township, Cumberland County, Pennsylvania 17007,
their last known mailing address being: 328 Old Stone House Road,
Boiling Springs, Pennsylvania 17007. GARY J. LOPER and MARJORIE
A. LOPER are the owners of all that certain lot of ground,
including any improvements thereon, being more fully described as
follows:
ALL THAT CERTAIN lot or piece of land situate in the Village
of Churchtown, Monroe Township, Cumberland County,
Pennsylvania, bounded and described in accordance with a
Survey and Plan thereof made by William B. Whittock,
Professional Engineer, dated May 29, 1969, as follows:
BEGINNING at a point on the western line of Main Street,
said point being one hundred thirty-four (134) feet
Southeast of the southeastern line of West Street; thence
along the western line of Main Street, South 24 degrees 30
minutes East, ninety-nine and forty hundredths (99.40) feet
to the northern line of a ten (10) feet wide alley; thence
along the same, South 65 degrees 30 minutes West, forty-two
and seventy-four hundredths (42.74) feet to an angle
therein; thence continuing along the same, South 38 degrees
24 minutes 45 seconds West, one hundred forty-nine and
seventy-nine hundredths (149.79) feet to a corner of land
now or late of Sarah Liggett; thence along said land, North
27 degrees 49 minutes West, one hundred sixty-seven and
fifty hundredths (167.50) feet to a corner of land now or
late of Mrs. K. Lucas; thence along said land, North 65
degrees 30 minutes East, one hundred eighty-six (186) feet
to the point and place of BEGINNING.
HAVING thereon erected a two-story frame dwelling known as
S/S Main Street, Box Number 91.
BEING the same premises which Ted D. Rhykerd and Susan J.
Rhykerd, husband and wife, by deed dated December 20, 1982,
and recorded December 21, 1982, in the Cumberland County
Recorder of Deeds Office in Deed Book "Z", Volume 29, Page
830, granted and conveyed unto Gary J. Loper and Marjorie A.
Loper, husband and wife.

Monroe Township Municipality Authority hereby files this
Municipal Lien for Services and Sewer Rates levied and assessed
from July 2, 2001 through and including March 31, 2003. Said
Authority services and sewer rates were levied and assessed
pursuant to Authority Resolution No. 02-04, same being known as a
Resolution of the Board of Monroe Township Municipality Authority

imposing user charges to be collected from the owner of each
improved property served or to be served by the Authority's sewer
system, in conjunction with all prior relevant Resolutions and
Ordinances, including, but not necessarily limited to, Monroe
Township Ordinance No. 3 of 1978 and Monroe Township Ordinance
No. 99-6, as amended; and providing for payment and collection of
such user charges. Attached hereto and incorporated herein are
the statements forwarded by Monroe Township Municipal Authority
to Gary J. Loper and Marjorie A. Loper for sewerage due to be
treated from July 2, 2001 through March 31, 2003, which services
total is in the amount of $1,000.56, which sum was duly assessed
against Gary J. Loper and Marjorie A. Loper, and the real
property described herein from the date of said billing
statements as attached hereto, and for which sum, with interest
in the amount of ten (10%) percent, along with penalties and all
costs, including attorneys' fees, a municipal lien is claimed
against the above-described real property and premises in
accordance with the Act of May 16, 1923, P.L. 207, ~7, as
amended, 53 P.S. ~7101, et seq, as amended (Municipal Claims and
Tax Liens).

Dear Mr. Loper:
I write to you on behalf of the Monroe Township Municipal Authority relative to
your sewer account #1144. This account is delinquent. As of the last billing
notice, same being dated 2/15/03, the delinquency is in the amount of $996.27.
The purpose of this letter is to request that this account be brought current. If the
account is not brought current within ten (10) days of receipt of this letter, a
Municipal Lien will be placed against real estate owned by you, same being
known and numbered as 328 Old Stone House Road, Boiling Springs. This
will result in filing fees, service costs and attorney's fees. Attorney's fees that are
incurred with respect to the collection of this delinquent account will be assessed.
Attorney's fees will be charged at the current rate. Attorney's fees will be
imposed and/or assessed if this amount remains delinquent after thirty (30) days
from mailing of this notice (if by certified mail) or within ten (10) days after mailing
of this notice (if by regular mail). The imposition of assessment of attorney's fees
may be avoided by your making payment in full of the delinquency within ten (10)
days of receipt of this letter as set forth herein.
