to do, Further, during Defendant's phone call with undersigned
counsel, the Defendant indicated that he guessed he would have to
drive to Carlisle the next day,
7, Defendant claims in his petition that the appeal was due on
the 14th or the 15th of January; however, the appeal was not actually
due until the 21" of January. It is further averred that the
Defendant knew that the appeal was due on the 21" as evidenced by his
various phone calls to the Plaintiff and his counsel; therefore, no
extension would have been necessary at the time of the filing of his
petition,
8, Defendant further claims that because of inclement weather, he
was unable to make it to the Cumberland County Courthouse,
Undersigned counsel was in hearings in the Courthouse, before the
Honorable Judge Hoffer on the 14'h, and on an afternoon arbitration
panel on the 15th. The courthouse was open to the public on both days,
despite the inclement weather.
9, It is averred that Defendant's appeal was not due until
January 21, 1999, and that Defendant was well aware of that date; but
was attempting to negotiate with Plaintiff by delaying his appeal,
10. It is averred that on both days that Defendant alleged that
he was unable to make it to the courthouse, the courthouse was open
for business, and he could have called and found out that he could
have mailed his appeal, However, since the appeal was not due until
the 21" of January, it is irrelevant what the weather was like on the
14'h or the 15th of January,
11, It is averred that the Defendant is the owner and not an
employee of his business, and thus, it is dubious that he could not
schedule time off to drive to the courthouse, or to drop a letter in
the mail.
12, Defendant should not be able to manipulate the system
because, and only because he is pro se, Undersigned counsel is not
excused from driving in inclement weather, nor are courthouse
personnel, The business of the courts must not be controlled by fair
weather complainants,
